About this file

This is a Documented Quote modification issued by the Colorado Department of Labor & Employment, Division of Vocational Rehabilitation, for the procurement of a tractor with adaptive technology for client purchase under the case services program in Fort Morgan, Colorado. The solicitation requests a single tractor unit equipped with comprehensive attachments and features including a front loader package, backhoe, mower deck, pallet forks, quick couplers, and hydraulic systems. Acceptable tractor models are the Kubota B2650HSD or John Deere 2025R, or equivalent models that meet or exceed specified performance standards. The documented quote was published on November 28, 2016, with a submission deadline of Tuesday, December 6, 2016, at 3:00 PM Mountain Time, and an estimated notice of award on December 9, 2016. Bidders were instructed to submit sealed pricing sheets in a separate envelope along with signature pages, supporting documentation, and all required attachments. A service center preference existed for locations within fifty miles of Fort Morgan, Colorado, with bidders required to identify the nearest service center location if none existed within that radius.

Evaluation was based primarily on total cost for the tractor and all required features and warranty, with CDLE reserving the right to reject any or all bids and waive minor irregularities as deemed in its best interest. Pricing was required to be firm for either 90 days or another specified period, include all shipping costs with FOB Destination terms, and standard payment terms were Net 45 with provisions for more favorable terms if offered. The solicitation required submission of a Substitute W-9 form to collect voluntary minority and women-owned business enterprise information, and Service-Disabled Veteran Owned Small Businesses could qualify for preference if proper U.S. Department of Veterans Affairs certification was submitted. Reciprocal preference against non-resident bidders was applicable per Colorado Revised Statutes Section 8-19-101, and all items bid were required to be new product with newly manufactured components unless otherwise specified.

Failure to do so shall be deemed a waiver of any rights to subsequently modify the terms of performance, except as outlined or specified in the DQ. Confidential/Proprietary Information

Any proposed restrictions on the use or inspection of material contained within a proposal response shall be clearly stated in the proposal response. Bidders may request the CDLE to consider confidential or proprietary information through the following steps:

Step 1. The bidder, with its proposal, shall submit written requests for confidentiality. The bidder must provide a justification and state specifically what elements of the proposal are to be considered confidential/proprietary.

Step 2. Confidential/proprietary information must be readily identified, marked, and packaged separately from the rest of the proposal. Commingling of confidential and/or proprietary information with other information is NOT acceptable.

Step 3. The Purchasing Director will make a written determination as to the apparent validity of any written request for confidentiality. Neither a proposal in its entirety, nor proposal price information will be considered confidential and proprietary. Any information that will be included in a resulting contract cannot be considered confidential.

Step 4. In the event CDLE does not concur with the bidder’s request for confidentiality, the written determination will be sent to the bidder. Ref. Section 24-72-201 et. seq., C.R.S., as amended, Public (open) Records.

PCS shall collect M/WBE and/or small business enterprise information by utilizing a substitute W-9 form (Attachment C) submitted with bidder’s DQ response. All information is submitted voluntarily by the bidders.

2.14.

Except as otherwise disclosed with particularity, through its submission of a quote, the bidder certifies that the prices in the quote have been arrived at independently without any consultation, communication, agreement with, or knowledge of the contents of the quote by any other competing bidder. For purposes of this paragraph, “consultation, communication, agreement with, or knowledge” does not include knowledge of prices gained through availability of established price lists or catalogues made available to the public by the competing bidder. No attempt has been made or will be made by the bidder to induce any other person or firm to submit or not to submit a DQ response for the purpose of restricting competition.
