About this file

This document is a Terms and Conditions agreement for DHS acquisition of commercial items (70Z03826QB0000123), effective November 28, 2025, under HSAR Deviation 25-09. The solicitation applies to purchase orders for commercial products and services with terms superseding all other conditions upon acceptance. Service Contract Labor Standards apply to all purchase orders, with wage determinations provided for identified places of performance. The offeror must hold prices for sixty calendar days from the date specified for receipt of offers unless another period is specified in an addendum.

Technical acceptability is evaluated as either "acceptable" (meets all SOW requirements and demonstrates thorough knowledge) or "unacceptable" (fails to meet requirements), and offerors must provide detailed explanations of delivery capabilities, certifications (FAA 145, EASA, DOD, OEM), quality control procedures, and ability to repair products per SOW specifications. Price evaluation uses FAR 12 criteria to determine fair and reasonable pricing. The contract includes extensive Federal Acquisition Regulation (FAR) clauses incorporated by reference, including provisions addressing responsibility certifications, delinquent taxes, felony convictions, protests, security prohibitions (covered telecommunications equipment, FASCSA orders, Iran sanctions, Sudan restrictions), sustainable products and services, DEI compliance, and labor standards. Quality assurance requirements mandate immediate notification of supply changes, material changes, or defects; contractor compliance with records retention and Government facility access; and flow-down of all requirements to supply chain. Packaging must avoid popcorn, shredded paper, Styrofoam, or peanut packing, with proper internal labeling and external marking per specifications. Deliverables ship F.O.B. Destination to USCG Aviation Logistics Center, Elizabeth City, NC, with inspection and acceptance performed by local USCG personnel at destination. All items require Certificates of Conformance per FAR 52.246-15, and invoicing must be submitted electronically to ALC-Fiscal@uscg.mil within five days of shipment. The Government may increase quantities for Line Item 1 up to fourteen units within one calendar year of Purchase Order award at the unit price specified.
