I. SPECIAL PROVISIONS

I. LOCATION / SITE DESCRIPTION

This project is within the location of a previous AML reclamation project which reclaimed an existing refuse pile, created natural stream channels, and installed an AMD treatment facility.

Since that time some of the features have failed and new issues have developed.

The “Existing Failed Reforestation Area” as shown on Sheet 7 of the Construction Drawings was an area that was originally planted with trees. This area has not had success at sustaining trees or vegetation. This area will be utilized for the placement of excess excavated material generated from the excavations of this project. Upon completion of the earthwork procedures, this area will be regraded, imported topsoil will be added and the area will be seeded. Please see the revegetation plan consisting of plants conducive to the growth and development of butterflies, specifically Monarch butterflies in this area.

There are four (4) access roads associated with this project. Access Road #1 will serve as a access to the Existing AMD Treatment System and will remain in place upon completion of the project. Access Road #2 will serve as access to the Existing Failed Reforestation and will remain in place with the exception of the portion of the roadway that crosses the existing channel, this area will be restored to approximate original contour. Access Road #3 will begin at the location of Stabilized Construction Entrance #3. This access is referenced to as a

Temporary Road, the contractor shall place this access in areas minimalizing disturbance to the existing refuse and stabilization may be required in some areas. This road will be regraded and seeded as defined in Section 6.0 of the specification. Access Road #4 will serve as access to the Existing Limestone Pond and will remain in place upon completion of the project.

There are several areas within the natural stream channels that have experienced erosion in the beds due to large rain events in recent years. These areas are defined as “Proposed Channel

Repair” and are numbered 1-9. These eroded channel areas have been redesigned as grouted riprap channels to help minimize the erosion in the future.

There are (4) existing seep areas that have developed. These areas are defined as “Proposed

Seep Collector” and are lettered A-D. Seep Collector A-C will be excavated and will be backfilled with aggregate to allow the seepage from these areas to naturally drain to an existing stream channel downslope of these areas. Seep Collector D will contain piping to direct the water to an existing stream channel downslope of this area.

There is a small Existing Limestone Pond located on the Southern end of the project that will be excavated and filled with Limestone.

There are two (3) existing ditches that will be reclaimed as part of this project. These ditches are defined as “Existing AMD Collection Channel”, “Existing Roadside Collection Channel”, and “Existing Vegetated Channel”. The reclamation of these channels is represented by

“Channel Reclamation 1-3”. The Existing AMD Collection Channel currently receives runoff from an existing pipe exiting the existing AMD Pond which conveys the water several hundred feet to the south where it enters the existing AMD treatment facility. The Existing

Roadside Collection Channel collects runoff from main access road and conveys the water several hundred feet to the south where it enters the existing AMD treatment facility. The

Existing Vegetated Channel runs parallel to an Existing Stream Channel near the AMD treatment ponds. This channel will not be required. The three referenced ditches collects a significant amount of surface water runoff which is also directed into the treatment facility.

The removal of these channels and the construction of the “Proposed AMD Collection

Channel” and the “Proposed Road Channel Extension” as referenced in the next paragraph will reroute clean water from entering the Treatment System.

There will be three (3) new channels constructed as part of this project. The “Proposed AMD

Collection Channel”, “Proposed Roadside Channel Extension” and the “Proposed Diversion

Channel”. The “Proposed AMD Collection Channel” will collect water from the “Proposed

Limestone Pond” and relay this runoff directly to the existing channel below. The “Proposed

Road Channel Extension” will collect water from the Existing Roadside Collection Ditch and relay this runoff directly to the existing channel that runs near the AMD treatment facility.

The “Proposed Diversion Channel” will route water away from the Slip Repair and route this runoff directly to the existing channel below.

There is an existing Clean Water Channel that will be reclaimed as part of this project.

A small Slip Area has developed on the site. A subsurface investigation has been conducted on the slide area to determine the depth and limits of the slide. Based upon this information a plan has been developed to repair the slide. The seepage areas have been investigated, and a plan has been put together to install an drainage system and regrade the areas.

The existing AMD treatment facility is currently not operating correctly and needs to be maintained. Currently the system consists of an equalization pond, a SAP cell, and a constructed wetland. The proposed design will utilize a Siphon System to flush the Proposed

Limestone Bed into the Proposed Sump and then into the Proposed Wetland.

Directions to Site:

From bridge at Thomas, take US 219 North for 3.7 miles, then turn right onto Kempton

Road. Follow Kempton Road for 1.2 miles, then turn left onto a gravel road. Continue for

0.4 miles to the site.

The GPS location is as follows: 39° 12’ 18.92”N -79° 30’ 4.36”W

3.0 QUALITY CONTROL

3.1 Description

This Work shall consist of testing for verification that the materials supplied, and the work performed are in accordance with these Specifications. Work shall be performed to the satisfaction of the State to be considered complete.

3.2 Materials

The Contractor shall submit a minimum of two (2) copies of shop drawings, catalog cuts and material certifications (as applicable) to the Engineer for all offsite materials to be incorporated into the Work. At least 1 copy submitted must be electronic.

Written approval from the Engineer will be required prior to incorporation of these items into the Work.

The Contractor shall submit at least two (2) copies of the results of all tests conducted on in-situ material, concrete, and grout to be used in this project. At least 1 copy must be electronic.

Test sampling of concrete shall be in accordance with ASTM C172. Temperature testing of concrete will be in accordance with ASTM C1064. Slump testing of concrete will be in accordance with ASTM C143. Air content of the concrete shall be tested according to ASTM C231, ASTM C173, or ASTM C138. Concrete cylinders formed for compressive strength testing shall be formed in accordance with ASTM

C31. Concrete compressive strength testing shall be in accordance with ASTM C39.

Four concrete test cylinders shall be made and tested: one test cylinder shall be tested at 7 days age, one test cylinder at 14 days age, one test cylinder shall be tested at 28 days age, and one cylinder shall be held as a spare. Concrete must have a compressive strength of at least 4,000psi within 28 days, a slump of 1-4 inches, an air content of 6-

7.5%, and a temperature of 50°F-90°F at pouring to be acceptable, unless otherwise specified in the Plans or these Specifications. Concrete used in road crossings, such as headwalls or wingwalls for a culvert crossing a road, must meet the requirements of Section 601 of the WVDOT Standard Specifications for Roads and Bridges, 2023

Edition, and the MM-109, if applicable. In the event of a conflict between these

Specifications, the WVDOT Standard Specifications for Roads and Bridges, 2023

Edition or the MM-109 then the most stringent requirement shall prevail. In the event of a conflict between the above that is more fundamental, such as what material to use or what construction methods to employ, then the order of priority would be the MM-

109 (for roads only), then the WVDOT Standard Specifications for Roads and

Bridges, 2023 Edition (for roads or bridges only), and then these Specifications.

Outside of work on, under, or near roads and bridges, these Specifications prevail entirely. Notwithstanding the above, a conflict in one requirement does not relieve the Contractor of abiding by all other requirements in these Specifications.

For ease of reference, the WVDOT Standard Specifications for Roads and Bridges, 2023 Edition can be found at the below:

https://transportation.wv.gov/highways/TechnicalSupport/specifications/Documents/

2023_Standard_%2812-16-22%29.pdf

These requirements apply to both precast concrete and concrete that is cast-in-place.

Unacceptable concrete must be replaced at the Contractor’s expense. Custom concrete mixes outside of these tolerances can be approved by the Engineer on a case-by-case basis. The State reserves the right to reject concrete based on a visual inspection without waiting on testing results.

Test sampling and compressive strength testing of grout shall be in accordance with

ASTM C1019. Slump testing of grout shall be in accordance with ASTM C143.

Grout must have a compressive strength of at least 2,000psi within 28 days and a slump of 8-11 inches to be acceptable, unless otherwise specified in the Plans or these

Specifications. Unacceptable grout must be replaced at the Contractor’s expense.

Custom grout mixes outside of these tolerances can be approved by the Engineer on a case-by-case basis. The State reserves the right to reject grout based on a visual inspection without waiting on testing results.

At a minimum, the pipe / fill compaction tests will include moisture content and density tests of the soil in accordance with the provisions of ASTM D698 (Standard

Proctor) field density tests following compaction. A new Standard Proctor will be run when soil type changes occur on site and/or at the direction of the Engineer or State representative.

Soil tests shall determine the optimal additives required for areas of soil disturbance to be fully re-vegetated (or 3 tons per acre preferred minimum). Normally, this includes – at a minimum – soil pH test results as well as available nutrients within the soil, including, at a minimum: nitrogen (N), phosphorus (P), potassium (K), calcium

(Ca), magnesium (MG), and Sulfur (S). At a minimum, the soil testing report will recommend what soil amendments in which concentrations are ideal for regrowth. If problems with re-vegetation occur, additional, more specialized tests may be required to be performed at the Engineer’s discretion and the Contractor’s expense.

Limestone and Sandstone shall be subjected to a Sodium Sulfate test in accordance with AASHTO T104. All stone shall have a maximum weighted loss of twelve (12) percent when subjected to five (5) cycles of the Sodium Sulfate Soundness Test –

ASTM C88 (ASTM C88-05 Standard Test Method for Soundness of Aggregates by

Use of Sodium Sulfate or Magnesium Sulfate), as modified by the American

Association of State Highway and Transportation Officials (AASHTO) T-104. All

Stone shall be commercially supplied and shall be tested for calcium carbonate.

Limestone shall be tested for calcium carbonate equivalency which must be 70% or greater and be certified as such.

Sandstone shall be certified to be non-acid producing. Sandstone to be sound, non-acid producing, durable, non-calcareous sandstone from a State approved source.

Shale is not acceptable. The State reserves the right to reject sandstone based on a visual inspection without waiting on testing results.

Note that the WVDOT Standard Specifications for Roads and Bridges, 2023 Edition specify quality control and testing procedures that ARE REQUIRED for any applicable asphalt replacement repaving, shoulder stone, guardrail replacement, etc.

The Contractor is to ensure these are implemented, that materials and installations permanently installed meet or exceed all required tests, and the Contractor shall provide the results to the State and the WVDOH for record.

The Contractor shall select an independent testing laboratory for testing. The laboratory shall be under the direct supervision of a Registered Professional Engineer or PhD. The laboratory must be approved by the State, prior to testing.

The Contractor shall furnish a certified technician to perform the required testing at the project site. The certified technician shall submit a copy of their certification, and a copy of that certification shall be submitted to State at the Pre-Construction

Conference. The certified technician shall be responsible for chain of custody of any samples that leave the site.

Testing shall be performed as required by these Specifications and or as ordered by the Engineer or State representative in writing. The Engineer will determine the locations and time of any testing herein specified and the need and extent of any testing in addition to that which is herein specified.

The Contractor shall be responsible for performing laboratory tests of the coal, mine spoil, and any natural soil to identify the compaction requirements for their use as fill and cover material, respectively. In addition, field density tests shall be performed in accordance with these Specifications. All test results shall be submitted to the

Engineer for approval of compaction criteria prior to finalizing compacting the fill material and after fill material is placed to verify that the required compaction is obtained.

Only new and first-class materials, which conform to the requirements of these

Specifications, shall be used unless specified otherwise. When requested by the State, the Contractor shall furnish a written statement of the origin, composition, and manufacturer of any or all materials (manufactured or produced) that are to be used in the work. The sources of supply of each material used shall be approved by the

Engineer before delivery is started. If, at any time, sources previously approved fail to produce materials acceptable to the State, the Contractor shall furnish materials from other approved sources.

3.5 Method of Measurement and Basis of Payment

There shall be no measurement of the “Quality Control” item as it is a lump sum. The quality control work done will be paid at the contract lump sum price bid for this item.

Said lump sum bid cannot be more than 3% of the TOTAL AMOUNT BID for the project. Nothing herein shall be construed to limit or preclude partial payments on this item up to 100% of the quality control bid amount. Neither deduction nor increase will be made in the lump sum “Quality Control” item amount regardless of decreases or increases in the final total contract amount or for any other cause.

3.6 Pay Item

Item 3.0, “Quality Control”, per lump sum cannot be more than 3% of the TOTAL

AMOUNT BID for the project.

4.0 SITE PREPARATION

4.1 Description

4.1.1 Subgrade Preparation

This work shall include stripping and stockpiling topsoil (if encountered) from the construction area, subgrade preparation of areas to the lines and grades defined on the plans. This work will not include preparation associated with the Erosion and

Sediment Control or the Drainage Structures.

4.1.2 Clearing and Grubbing

Work performed under this section shall include the removal and disposal of all trees, stumps, shrubs, and any other vegetation along with wood, debris, or garbage of any nature. This includes those areas specified below, shown on the Plans, and any other areas as approved by the State via Change Order. This work shall also include the preservation from damage for all vegetation, utilities, or any other object not being specifically removed according to the Specifications and Plans.

4.1.3 Topsoil Removal

The existing site, being mostly refuse, will have minimal topsoil. This work shall include stripping and stockpiling topsoil from the construction area, keeping it free of refuse material, separate from stockpiled soil, and using the topsoil for soil cover and revegetation at the end of the construction.

4.1.4 Demolition of Structures

Work performed under this section shall consist of complete demolition and removal of such buildings, mining related structures, equipment and materials, existing ruins and foundation structures, as are specifically designated on the Plans for removal or encountered during construction, except as is otherwise specified.

Demolished concrete and cinder block structures and foundation ruins (if encountered) may be disposed of on-site, if approved.

All steel residue and wood (burned) must be removed from the site. All on-site garbage (as well as all other debris of any type and quantity), mining equipment, and metal structures encountered shall be removed from the site to an off-site disposal area in accordance with these Specifications to a Landfill approved by the

State to accept the applicable waste type. Certified disposal weight tickets shall be provided to the WVDEP. The Contractor is advised to perform a thorough site reconnaissance to quantify all garbage designated for removal prior to submitting a bid.

Asbestos Material Identification and Removal (if present) - This Work shall consist of a Contractor-provided Competent Person – as defined by Title 29, Subtitle B, Chapter XVII, Part 1926 of the CFR Code – performing a thorough search of all existing structures on the project to ensure that there are no asbestos materials present. If any areas are suspected of containing asbestos, then an inspection would need to occur – at the Contractor’s expense – by a company possessing a valid, current Asbestos Contractor License in the State of West

Virginia. Each on-site representative of the company performing the asbestos survey or mitigation would need to be a Licensed Asbestos Contractor in the State of West Virginia. If asbestos was found, an estimate for removal and proper disposal would need to be obtained by the Contractor and submitted for the

Engineer’s approval. At that point, the Contractor would be responsible to perform all notifications as required by all Federal and State law – particularly NESHAP as outlined in Title 40, Chapter I, Subchapter C, Part 61, Subpart M of the CFR Code.

No work would be allowed at the location of the asbestos until the removal process was completed. No asbestos mitigation or removal is anticipated for this Work

– if the Contractor determines asbestos is present and subsequently receives a positive test for asbestos, a Change Order would be negotiated with the State for the proper mitigation to occur through the Contractor. All mitigation by the

Contractor (or their Sub-Contractor) would need to be in accordance with all

Federal, State, and Local laws.

Materials and Equipment Storage - The Contractor shall obtain approval from the

Engineer for proposed materials and equipment storage areas prior to use.

Refueling or fuel storage should not occur within 100ft of a wetland, water body, stream, or ditch leading into the same – see additional requirements for fuel storage in the “Spill Containment Area” below. Areas utilized shall be restored to an “as good as” or “better” condition than existed prior to construction or shall otherwise be reclaimed as directed or approved by the Engineer.

4.1.5 Existing AMD Treatment System Removal
