TECHNICAL EXHIBIT 9

USAG ANSBACH ENVIRONMENTAL COMPLIANCE

ISO 14001 CONTRACTORS AND SUPPLIERS ENVIRONMENTAL PERFORMANCE

REQUIREMENTS

USAG Ansbach Environmental Management System (EMS) The U.S. Army Garrison Ansbach (USAG Ansbach) operates an Environmental Management System (EMS) in accordance with Executive Order 13423 “Strengthening Federal, Environmental, Energy and Transportation Management”, International Standard ISO 14001:2004 (E) “Environmental Management Systems,” as well as DoD and IMCOM-E requirements.

The EMS is an overall management system that includes organizational structure, planning activities, responsibilities, practices, procedures, processes and resources for developing, implementing, achieving, reviewing and maintaining the environmental policy of an organization.

The USAG Ansbach EMS is designed to ensure that all military personnel, civilian employees, and contract employees of either the Garrison or tenant organizations, whose work activities can cause real or potential significant environmental impact, are aware of how their work relates the environmental performance objectives established under the USAG Ansbach EMS and are competent to perform their roles, responsibilities and authorities while supporting the Garrison’s mission.

Contractors and their personnel are especially required to be aware of and comply with the Garrison’s EMS policy when performing work at the installation. Information about EMS will be delivered at the project kick-off meeting in the form of a flyer, and an additional short in-brief is available upon request.

The contractor must be familiar with the information package provided during the Pre-construction meeting.

The Garrison has established an EMS Policy and defined the following significant aspects to focus on by setting objectives and targets:

• Soil and groundwater contamination • Air Emissions

• Product Procurement • Endangered Species Management

• Energy Consumption • Erosion

• Water Consumption • Spill Management

• Environmental Noise • Hazardous Waste Generation

• Fuel Consumption • Solid Waste Generation

Our goal is to reduce the Garrison’s carbon footprint and to continually improve the protection of the environment. The Garrison committed to integrate relevant environmental considerations into all their activities, also performed by contracts and services.

In Conjunction with EMS, the following special aspects are addressed

Contractors have to be certified and qualified for the work they perform.

Respective documentation must be available on site.

Air Emissions:

• No open burning of waste materials is permitted.

• Work involving ozone depleting chemicals must be performed by certified technicians.

• Contractors will ensure that their staff is trained in the proper use and handling of all materials and chemicals to ensure air emissions/odors are minimized.

• Motor vehicle idling is not allowed.

• Use dust suppression methods – wetting, etc.… to minimize particulates in the air.

• Transport dusty materials in covered vehicles.

• Minimization of all air emissions is required.

Asbestos and Lead Based Paint:

• Notify EMD of asbestos and lead-based paint removal prior to the project start date.

• Dispose material properly and send copies of waste manifests to EMD.

Cleaning Equipment:

• Clean construction equipment prior to entering roadways (without water, use broom or other scraping device).

• Do not clean equipment in locations where contaminates can enter sewers, watercourses or aquifers.

• Vehicle washing is not allowed on Army installations.

Surface Water Control:

• Control all surface water and groundwater including rainfall and run-off.

Ensure that erosion is controlled and that flooding of excavations or damage to structures does not occur.

• Intercept surface drainage as far back from excavations as practical by means of ditches, berms, silt fences or other interception methods as may be required for effective control.

• Direct pumped water or run-off to settling ponds or sediment basins prior to discharge to adjacent storm sewers or watercourses.

• Use straw or similar to cover bare exposed soil or, provide settling ponds and sediment basins where needed.

• Control overflows rates from settling ponds or sediment basins to ensure minimum solids transportation.

• Washing paved areas is prohibited.

• Disposal or discharge of any type of pollutant into a storm drain or surface water is prohibited.

• Keep gutters and drainage ditches open at all times to provide adequate surface drainage.

Energy Consumption:

• Contractors and Suppliers will use energy efficient equipment to the extent possible when undertaking any work on a job site.

• Contractors and Suppliers staff when on a job site will turn off lights and equipment when not in use and where practical.

• Minimization of energy consumption is required.

• Provide a metering system to measure the amount of energy used during the construction project and report measurements to DPW Utilities department.

Water Consumption:

• Contractors and Suppliers will use water saving processes whenever practical.

• Leaking equipment or hoses will be replaced.

• Minimization of water consumption is required.

• Provide a metering system to measure the amount of water consumed during the construction project and report measurements to DPW Utilities department.

Hazardous Materials (HM):

• Hazardous materials brought on site and used shall be managed in accordance with applicable Laws/ Regulations.

• Maintain copies of MSDSs for all HM onsite.

• No containers or items used to apply HM can be washed onto the ground, or into storm drains or surface water.

• Secondary containment is required for all containers containing water-endangering substances.

• Containers must remain closed when not in use.

• Storage of diesel and the filling of equipment/vehicles etc. must be accomplished according to the guidance of the Berufsgenossenschaft Bau B 171, Technische Regeln fuer brennbare Fluessigkeiten (TRbF) and Verordnung ueber Anlagen im Umgang mit wassergefaehrdeten Stoffen

(VAWS).

Pesticides:

• Do not use pesticides on Army installations.

Hazardous Waste Management & Solid Waste Management

• No open burning is permitted.

• Hazardous waste generated by contractors will be collected properly and disposed of offsite complying with all relevant laws.

• It is not allowed to use government containers to dispose any type of contractor generated waste.

• Do not empty fuels, lubricants, herbicides, pesticides, fungicides, paint;

solvents or other chemicals into sewers or streams, only legal disposal methods are acceptable.

• Whenever possible Contractors and Suppliers should seek recycling opportunities for the management of waste.

Contaminated Soil/ Construction Debris Removal:

• If contamination of soil or debris is discovered during construction, work must be stopped and EMD has to be informed.

• If there is a suspicion of contamination, material has to be sampled, analyzed and classified for correct disposal.

• Storage of contaminated material is only allowed in closed containers or on a paved area, which has to be approved by the COR and the EMD. Piles must be covered with UV light resistant foil. All soil piles must be removed before end of contract period.

Spills:

• All contractors that transport, process, store, or in any way handle HM, HW, POL, or other restricted items are required to develop and post a Red Plan (Ölalarmplan) at the worksite

• Clean up and dispose of any spillage that may occur whether on land or water.

• Keep spill kits on-hand in case of spills.

• Notify Fire Department and EMD staff immediately in case of any spills.

Sensitive Areas/Landscape Preservation:

• Minimize removal of vegetation.

• Do not drive heavy vehicles/equipment across unpaved surfaces especially during wet conditions.

Noise:

• Use vehicles and equipment with efficient muffling devices.

• Provide and use devices that will minimize noise levels in construction areas.

• Minimize noise resulting from activities while on site whenever practical.

• Motor vehicle/ engine idling is prohibited.
