Contract Discrepancy Reports
Quality Assurance. The government will evaluate the contractor’s performance under this contract using the method of surveillance specified in the PWS and based on adherence to guidelines established in Deliverables and PRS. When an observation indicates defective performance, the COR will submit a Contract Discrepancy Report (DA Form 5479) through the Contracting Office.

x Surveillance Documentation o DA FM 54372 - Contract Monitoring & Surveillance Report o DA FM 5475-R - COR Schedule o DA FM 5477-R - Customer Complaints o DA FM 5476-R - Surveillance Activity Checklists o DA FM 5479-R - Contract Discrepancy Report o Progress schedules approved by the Contracting Officer o Progress reports submitted by the contractor o Laboratory test reports (Note: in some construction contracts the technical specifications require laboratory tests for some materials used in the performance of the contract, including, samples, photographs, witness statements, and other factual data) o Records of unusually severe conditions that affected contract performance in accordance with the respective default clause. For example, weather conditions are particularly important for construction contracts and other contracts that call for performance outside.

246.407 Nonconforming supplies or services.
(f) If nonconforming material or services are discovered after acceptance, the defect appears to be the fault of the contractor, any warranty has expired, and there are no other contractual remedies, the contractingofficer—
(i) Shall notify the contractor in writing of the nonconforming material or service;
(ii) Shall request that the contractor repair or replace the material, or perform the service, at no cost to the Government;
and
(iii) May accept consideration if offered. For guidance on solicitation of a refund, see Subpart 242.71.
(S-70) The head of the design control activity is the approval authority for acceptance of any nonconforming aviation or ship critical safety items or nonconforming modification, repair, or overhaul of such items (see 209.270). Authority for acceptance of minor nonconformance’s in aviation or ship critical safety items may be delegated as determined appropriate by the design control activity. See additional information at PGI 246.407.
