This may include but is not limited to bump hats, work gloves, quality flashlights, boots, clipboards, ladders and miscellaneous tools.

Samples: The Facility shall receive sample labels of chemicals and materials from the contractor or its technicians.

Ineffective Chemicals: Success in pest elimination is largely determined by the skill of the technician and the cooperation received from all concerned and involved in a particular pest problem. In cases where it has been determined that a particular chemical in use at this Facility has lost its effectiveness (e.g., due to a resultant increase in resistance in the target pest population) the Contractor shall replace such ineffective chemicals with more effective alternative choices upon the approval of the Facility.

Safety and Chemical Data: In the event of a chemical intervention, the Contractor shall adhere to the following:

- Within thirty (30) days from the commencement of a chemical intervention, the Contractor shall provide to the Facility safety and technical data for chemicals to be used in the treated areas.

- Provide to the Facility a list of chemicals including trade name and name of active and inert (including carriers) ingredients and a list of the respective chemical classifications for each product intended to be used.

- Material Safety Data Sheets must be provided to the Facility.

- Provide to the Facility a list of poison control centers and respective telephone numbers applicable to the Facility.

- Chemicals should be applied at night or on weekends, and the Contractor shall cooperate with the Facility representative to properly ventilate, where necessary, the premises before tenants re-occupy the building.

- Use of spray or aerosol pesticides should be a rare event and only performed with the Facility’s pre-approval.

- Contractor shall place proper public notices or otherwise inform building occupants regarding what pesticides will be applied, where pesticides will be applied, and when pesticides will be applied.

- Contractors must comply with all local and state regulations codes regarding timely prior notices.

The contractor shall respond to requests for emergency service on the day of the request.

The contractor shall respond to special service requests within one (1) working day after receipt of request.

All emergencies and special services shall be recorded. In the event that such services cannot be completed within the above-stipulated time frame, the contractor shall immediately notify the Facility Agency representative and indicate an anticipated completion date.

Rodent Elimination

Snap traps and other trapping devices (including glue boards) used in the elimination of active rodent infestations must be checked daily. The Contractor shall dispose of rodents killed or trapped within 24 hours.

Trapping should not be performed during periods when maintenance will be delayed by holidays, weekends, etc. Traps should be placed out of the general view and located so as not to be affected by routine cleaning procedures. When using traps for monitoring, the visit interval may be adjusted as necessary once the Contractor obtains approval from the Facility Business Office or their designee.

All rodenticides, regardless of packaging, should be placed either in locations not accessible to children, wildlife, and domestic animals, or in EPA-approved tamper-resistant (often termed "tamper-proof") bait boxes.

Bait box servicing shall depend upon the level of rodent infestation. All bait boxes shall be labeled (including Contractor's name, address, and telephone number) and dated at the time of installation and each service. All bait boxes shall be placed and maintained in accordance with EPA regulations with an emphasis on the safety of non-target species to the greatest possible extent. The following three points shall be strictly adhered to:

The lids of all bait boxes must be securely locked or fastened shut.

Bait must always be placed in the baffle-protected feeding chamber of the box and never in the runway of the box.

All bait boxes must be securely attached or anchored to the floor, ground, wall, etc., so that the box cannot be picked up or moved.

Liquid and solid poison baits shall be placed in distinctively marked bait stations of sturdy plastic, metal or wood construction--no paper or cardboard stations--and should be placed in areas normally inaccessible to clients of the Facility. Covered bait stations shall be used in dietary, food processing, storage and handling areas. Paraffinized or weather resistant baits shall be used in damp and wet areas. All bait stations and traps shall have such tags or labels affixed so as to enable the technician to enter his signature and date after each service. All bait stations and trap locations shall be marked by placement, or a distinctively colored removable self-adhesive sticker placed on the nearest wall or column to make quick identification of each location.

The Contractor shall make seasonal adjustments such as color of bait trap, quantity of traps, and the location of traps. The Contractor shall make a floor plan (or utilize floor plans supplied by the Facility) and exterior plan of each area where bait stations and traps are located, number each bait station and trap and enter the location of each numbered bait station and trap in the diagram. These floor plans or diagrams shall be kept with the other records on the Facility as required by the Facility. A detailed report of trap monitoring shall be completed on each visit, indicating the service of each pesticide bait station and trap and turned in at the completion of each service visit as required by the Facility. Similar records should be kept for any traps (e.g.

glue boards) and for any treatments (chemical or non-chemical).

Summary of OMH Procurement Lobbying Guidelines

OMH has issued Guidelines pursuant to the New York State Finance Law Sections 139-j and 139-k, which prohibit lobbying on procurement contracts. For purposes of the law, procurement contracts include most contracts/Purchase Orders with an estimated annual expenditure in excess of $15,000 per year, as well as amendments and modifications to such contracts which were not contemplated by the original contract and represent a material change in the scope of the contract.

The law provides that, during the Restricted Period of an agency procurement for goods or services, vendors (or offerors) may only contact the agency’s designated contact person(s), and all contacts, whether permissible or impermissible, shall be recorded:

Vendor Requirements

Must limit communications with OMH during the Restricted Period of each procurement to the OMH-designated point(s) of contact

The Restricted Period is the period from the date of the earliest method by which an agency solicits a response from vendors to a contract opportunity until the date the contract is awarded and, if applicable, approved by the Comptroller’s Office.

Must affirm in writing vendor’s understanding of and agreement to comply with the OMH Procurement Guidelines

Must certify whether vendor has been found non-responsible within the previous four years by any

Governmental Entity for failure to comply with State Finance Law 139-k or for the intentional provision of false or incomplete information regarding its procurement lobbying law compliance.

OMH Requirements

Must include a summary of OMH’s procurement lobbying guidelines in each initial solicitation document

Must designate a single point or points of contact for each procurement

Must require OMH staff to record all Contacts from offerors during the Restricted Period of each procurement

A Contact is any communication with OMH under circumstances where a reasonable person would infer that the communication was intended to influence the procurement

Must refer all impermissible Contacts for investigation by OMH

Must make a responsibility determination with regard to State Finance Law Section 139-j and 139-k compliance prior to award of the contract

Must include a provision in all procurement contracts which allows OMH to terminate the contract if the vendor’s certification is found to be intentionally false or intentionally complete.

OMH is expanding on that requirement, requiring that

(1) Offerors affirm they have complied with the OMH Guidelines throughout the procurement process, and (2) Offerors agree that OMH shall have the right to terminate any contract, purchase order or purchase authorization resulting from the procurement in the event that the affirmation is found to be intentionally false or intentionally incomplete.
