Question Response
Tech Technical Requirements
Section 4.11 (Elevators / Vertical Transport) refers to the SI Facilities Design Standards, stating that the design shall be in full compliance with Division 14. In Division 14 of the SI Facilities Design Standards, Item I states that the use of machine room-less (MRL) elevators shall not be utilized unless express approval is received from the Smithsonian. Please clarify whether the Developer may utilize MRL elevators. This is a standard industry practice for elevators in garages and currently what elevator manufacturers are quoting and installing on all comparable garage projects.
The Smithsonian hereby approves the use of machine room-less (MRL) elevators for the CPF.
Tech Data Room
On 3/1/18 we received a response from the Smithsonian regarding the Mechanically Stabilized Earth (MSE) wall, clarifying that the drawings for it are located in the Data Room within the folder:
“02.02.08 Retaining Wall As-builts”. We are still unable to locate these documents, specifically the construction submittals and as-built information related to the MSE wall and the architectural precast panels. Below is a summary of what we have identified within the folder: “02.02.08 Retaining Wall As-builts.” Please advise where specifically the drawing for this MSE wall is located.

Tech Data Room
The existing water pressure indicated on the original construction documents (1974, P-10, Detail 9) is shown to be 100 psi. Please confirm if this is still the case for the building.
So confirmed. The water pressure available into the
GSB Building is 100psi (plus); however, a pressure reducing valve is in place resulting in supply to the building system at 65psi (as indicated on the installed pressure gauge).
A water flow test is recommended to get more accurate readings of available pressure and flow rate, particularly for upper levels off the CPF.
Tech PA Section 6.7 & Exhibit G
With regard to cameras, Section 6.7 from the Project (Concession) Agreement reads:
Whereas Exhibit G (Operating Standards) from the Project (Concession) Agreement reads:
Please clarify the Smithsonian’s requirements with regard to cameras.
Both statements are correct. The developer will install and maintain the CCTV system and Smithsonian will have access to view the cameras as needed. The cameras need to be compatible with the American Dynamics / SoftwareHouse system in place at the Zoo.
Tech Clarifications Requests for Clarifications and Amendment [part 1 of 2] L5 references van and gator services provided by Smithsonian Enterprises. Please clarify what, if any, van and gator services will be provided by the Parking Operator
The Developer is not required to provide any van or gator services other than what the Developer deems necessary for its internal operations. The Smithsonian intends to operate an employee shuttle independently of the Developer.
Tech Technical Requirements
Is the Bus drop-off and turn-around required to be inside the CPF?
The Smithsonian hereby clarifies that there is no requirement to include the bus drop-off and turn-around within (inside) the CPF. The bus-drop off and turn-around may be outside / adjacent to the structure.
Tech Technical Requirements
Please revise the requirements relating to bathroom facilities. The Developer should be permitted design flexibility as to their location as long as they meet a minimum quantity threshold.
The Smithsonian hereby revises the criteria for restroom facilities, setting out that the CPF must include no fewer than 21 stalls; however, the Developer to exercise discretion as to the specific location of the facilities within the CPF (whether on a single floor or on multiple floors).
Fin Clarifications
Requests for Clarifications and Amendment [part 1 of 2] provided confirmed revenue and vehicle counts. Please clarify how per-vehicle gross revenue is above the $22.00 entry fee. Breakout of numbers follow:
2014 2015 2016
Gross $4,146,142 $6,345,037 $7,149,358
Discount -$978,527 -$1,715,447 -$1,886,547
Net $3,167,615 $4,629,590 $5,262,811
Vehicles 188409 282957 302317
Per Vehicle Gross $22.01 $22.42 $23.65
There are two factors why revenue for 2015 and 2016 yields more than $22 per paid vehicle. First, the Zoo has occasional Facility Rental Income where certain random parking lots are rented. For example, the Marriot may ask to use one of our parking lots off hours. There is no pattern but revenue for this was as follows:
2014 = $0 2015 = $7,400
2016 = $13,264 Second, the Zoo utilizes a premium reservation service called Parking Panda, which for the time period in question collected a NET of $27.90 per paid vehicle, yielding the following:
2014 = $0 2015 = $138,921 2016 = $216,110
Leg PA Article 1
The definition of “Engineering, Procurement, and Construction Contract” states the construction contract between the Developer and the construction contractor is to be entered into (and amended) “with the approval of the Smithsonian.” In that team members, including the construction contractor, have already been identified and prequalified (i.e., approved) as part of the RFQ process, we see this particular requirement as unnecessary.
Smithsonian wants to ensure that the specific contract identifies the protections for the Smithsonian that are required by the procurement and that we do not get into a situation where two contractors are at odds over the terms of the contract and responsibilities
Leg PA Section 5.23 Though the recently amended Project (Concession) Agreement reduces Liquidated Damages from $15,000/day to $8,000/day, the lower amount is still excessive in relation to the Minimum Annual Concession Fee.
The Smithsonian hereby revises the amount of the Liquidated Damages from $8,000 per day to $3,000 per day.
Leg PA Section 5.27
With regard to Construction Security vs. Bond Security, the Smithsonian’s response to Question L2 (ref: Amendment #2) states it “shall review this (Section 5.27) further and provide any appropriate revisions in the next version of the Agreement.” Please advise regarding the status of the Smithsonian’s further review of Section 5.27. We again request that Construction Security be reinstated and Bond Security be removed, as the former is more appropriate and applicable than the latter, meaning the performance and payment bonds should correspond to construction cost, not project cost.
Section 5.27 has been revised to read as follows:
“The Developer shall purchase both payment and performance bonds, in the name of both the Developer and the Smithsonian, each of which bonds shall be in an amount not less than the contract sum of all [construction contract] costs the Developer’s Project costs, as approved by the Smithsonian and shall protect the Smithsonian and the Parking System Site from any and all mechanics’ and materialmen’s liens which may be levied for labor or materials furnished in connection with the Project and to insure proper completion of the Project.”
Leg PA Section 11
The termination provisions in Section 11 – particularly “Termination for Convenience by the Smithsonian” (Section 11.5) and “Termination Due to Material Change Costs” (Section 11.7) – are cause for concern, the specifics of which are difficult to capture here in a question and are best discussed with the Smithsonian in the appropriate forum.
Please identify any requested changes or specific concerns with these provisions.
