N/A
Q: Quite often OEMs have different discount levels for Equipment vs Accessories which can determine the discount level we can provide off of the MSRP. Please define what is meant by accessories in each category. For example, Batteries, Chargers, belt clips, headsets, blue tooth microphones, antennas are often considered accessories. We noticed that there is a separate category 8 for antennas & 14 for batteries and chargers for example. Or is there a way to offer 2 different discount levels in a category, ie one discount for equipment and another for accessories for the same category and manufacturer?
A: No. Vendors must use the State-Supplied Price Sheet to provide a single discount for each category.
23
N/A
Q: On the NJStart Bid Solicitation Page, there are 17 items with NIGP Codes. We are not sure what the intent of providing this information is for. Can you explain?
A: These codes listed on the Items Tab of the Bid Solicitation indicate all of the unique commodity codes pertaining to this Bid Solicitation. These codes are then used to generate the Bidder’s list. These do not reflect individual line items. Bidders should only refer to the State-Supplied Price Sheet when providing pricing.
24
NA
Q: Prices will vary by vehicle type or situation and location for performing the work. Per Unit Cost would be difficult to provide without a statement of work. Do we put “no bid” for per unit cost and just fill out the hourly rates?
A: Please see response to Question 17.
25
N/A
Q: Mobile radio installations & removals vary by vehicle and scope of work. Do we provide a separate installation & removal pricing schedule as a catalog item with equipment? Or is that reserved for labor schedule and provide hourly rate only since cannot specify per unit without the statement of work.
A: The State-Supplied Price Sheet has been revised in order to address this question. Please see the attachment entitled, “T0109 State-Supplied Price Sheet Revised 12.12.23.”
26
Section 4.2.1; 4.2.2
Q: Is there a category for providing consulting services?
A: No. All Categories pertaining to this Bid Solicitation are listed in Bid Solicitation Section 4.2.1 and Section 4.2.2, as well on the State-Supplied Price Sheet.
27
Section 3.27; 4.19
Q: With current supply chain issues, equipment & accessory pricing has become quite the challenge with OEMs and distributors constantly changing pricing. With that in mind, If we represent a manufacturer and they increase their pricing multiple times during the term of the contract or the current year, will NJ allow us to increase our pricing as long as we keep the same discount level? Section 4.19 allows for annual review but there is no guarantee the state will approve the price increases or if there is a significant change, allow more than one price increase per year. Would there be exceptions to the annual price increase by allowing it more often based on the OEM as long as the discount level holds? How flexible will the State be with price increase requests if they are significant? Please also see the question regarding prevailing wage increases (if applicable), would they be automatically approved for corresponding price increases.
A: Per Bid Solicitation Sections 3.27 and 4.19, the State will accept revised Catalogs annually from the Contract Effective Date. Additionally, Section 6.1 of the New Jersey Standard Terms and Conditions states “In an exceptional situation, the State may consider a price adjustment. Requests for price adjustments must include justification and documentation.”
28
Section 3.27
Q: If we provide solutions that integrate multiple brands of communication products, how do handle with the product tabs? Do we just use the brand of the major component or is there another recommendation for how to bid it?
A: As per Bid Solicitation Section 3.27, “The State-Supplied Price Sheet includes multiple tabs labeled “Brand 1” through “Brand 20”. Bidders may propose a maximum of 20 brands. Therefore, if the Bidder wants to propose multiple brands, then the Bidder must fill out all required fields for each brand using the tabs provided. For example if the Bidder proposes five (5) different brands, then tabs “Brand 1”, “Brand 2”, “Brand 3”, “Brand 4”, and “Brand 5” must be filled out”.
29
Section 3.13; 3.14
Q: If we represent an OEM brand catalog, what information or forms are required besides the manufacturer authorization letter? Do we need to provide with the bid the forms indicated in section 3.13 for example? Or any other forms or letters?
A: All Bidders are required to submit the forms listed in Bid Solicitation Section 3.13 at the time indicated. The forms are also listed in the Bid Solicitation Forms Packet, attachment entitled, “T0109 Bid Solicitation Checklist and Forms Packet Revised 12.12.23.”

Q: Would the State accept the following changes to the Contract Terms and Conditions to better align with the Contractor's business practices? Pricing: In developing an offer, will the State entertain pricing adjustments throughout the term? In some cases, the manufacturer may incur cost increases which would impede Contractor's ability to hold discount pricing for the duration of the Agreement. Purchase/Credit Cards: Use of Purchase Cards (P-CARDS) or Credit Cards must be done at the time of order. Any Net terms invoice paid by P-CARDS or Credit Cards after time of order are subject to a processing fee. Warranty: OEM Warranty will apply and will be the sole warranty for the Products. Contractor will provide product only. In no event will Contractor perform any services, installations, or removals or product.

31
Section 4.14

Section 4.19
Q: Can you explain the process to do Yearly Price increases?
A: Per Bid Solicitation Section 4.19, “Requests for price list updates shall be limited to the category of product that a Contractor is awarded and shall meet the definition/requirements of the category. The file name should contain the Contract number and date of the revised price list. The Contractor must provide the revised price list for the specific category awarded to the procurement via email, in pdf or Excel format. The correspondence to the Division with the revised price list shall reference the location of the specific price line that has been revised. The revised price list will not be considered valid until it has been reviewed and approved by the Procurement Bureau and published in NJSTART.
Price list annual refresh requests must be submitted to the State Contract Manager or designee for approval, at least 30 calendar days prior to each annual contract effective date. Failure to meet this submittal date requirement may result in disapproval of that year’s request. Compliance with the aforementioned requirements are the basis for approval and or disapproval.”

If awarded, Contractors have the option to provide the State with higher discounts.

Q: Regarding sections 3.27 and 4.3.4 of the Bid Solicitation, for those entities within the state that do not wish to contract with a particular Vendor for programming services, is the Vendor able to omit Programming charges from their quotes? For those entities who wish to contract with the Vendor for programming services, is the Vendor able to show Programming separately on their quotes?

Q: Regarding section 4.19 of the Bid Solicitation, while escalation clauses are not allowed, would the State consider a clarification that any multi-year service agreements would be subject to an annual update to align to the latest pricing approved on the contract?
A: Please see response to Question 27.
50
N/A
Q: Given that Contractors are able to request annual price updates per section 4.19 of the Bid Solicitation, would the State please confirm that during any renewal periods, the extensions would be executed at the updated pricing and rates rather than those in effect in the previous year? Additionally, since Contractors can submit annual pricing refreshes, would the State consider an adjustment to State Contract Clause 6.1 to state "Except for the annual pricing updates, and unless otherwise agreed to in writing by the State, all prices quoted shall be firm through issuance of contract or purchase order and shall not be subject to increase during the period of the contract." All else would remain.
A: The State does not accept the proposed revision. Pricing and rates for contract extensions will be reflected in the text of the extension itself and/or accompanying price sheets. No other pricing guarantees will be made at this time.
51
Section 5.11
Q: Regarding section 5.11 of the Bid Solicitation, we request a modification allowing the payment to be remitted within 45 days after the end of a quarter to allow the state and the Vendor to review the report and confirm values prior to payment. Would the State consider an extension to the 30-day time period to 45 days? Additionally, would the State be amenable to adding a clarification that the Vendor is able to remit fee payment using the form of payment they choose?
A: The State does not accept any proposed revision to the identified section. Terms and conditions on publicly bid procurements must be consistent for all potential Bidders, and cannot be based on a single vendor’s terms.
Payments must be made no later than thirty (30) days after the end of each calendar quarter, and must be made directly to Periscope on behalf of the State, as provided in Section 5.11(C) of the Bid Solicitation.

| Q: Does the Using Agency still have the option to procure extended warranty, maintenance, and support services beyond the Vendor’s warranty even after the initial warranty period? A: Please see response to Question 15.
53
Section 4.4.1
Q: Is it acceptable for our warranty to only cover material defects in the products or installation?
A: Per Bid Solicitation Section 4.4.1, the manufacturer’s warranty shall include all repairs, replacement, parts, service, labor and shipping. Warranty for software shall include any updates, upgrades, or new releases made available during the warranty period.
54
Section 4.4.4
Q: What if it is a noncritical issue that can easily be diagnosed and/or rectified over the phone?
A: Per Section 4.4.4(1), the Using Agency will assign the Severity Level, which dictates Contractor requirements for response time and trouble clearance. Response status is to be provided by telephone. Trouble clearance can be cared for over the phone, or on-site as required.
55
Section 4.3.2
Q: Regarding section 4.3.2 item 3 of the Bid Solicitation, based on the wide range of products offered on this Bid, we ask that the request to ship stocked equipment within 48 hours be modified to "3. Based on the wide range of products covered by this Bid Solicitation, the Contractor shall provide its latest shipping estimates within 48 hours following receipt of an order. Contractor should ship any stocked equipment when commercially practical;"
A: As per Section 4.3.2(3){c}, “A delivery schedule shall be negotiated between the Contractor and the Ordering/Using Agency as part of the ordering process.”
56
Section 4.3.4
Q: Regarding section 5.6 of the Bid Solicitation, given the wide range of products being proposed on this Bid, shipping times may vary. Would the State accept a modification to this clause so it would read as follows: "Unless otherwise noted in this Bid Solicitation or on the State Supplied Price Sheet, all delivery times may be requested by the Using Agency after receipt of order (ARO) and prices for items in Quotes shall be submitted Freight On Board (F.O.B.) Destination (30 calendar days ARO/F.O.B.)". All else the same.
A: Please see response to Question 55.
57
Section 4.9
Q: Regarding section 4.9 of the Bid Solicitation, for those entities within the state that do not wish to contract with the awarded Contractor for installation services, is the Vendor able to omit Installation charges from their quotes? For those entities who wish to contract with a Vendor for installation services, is the Vendor able to show installation separately on their quotes?
A: If a State Agencies requests supply and installation of equipment, the awarded contractor must supply and install, and quote accordingly. Otherwise, Agencies have the right to buy equipment and install it themselves.
58
Section 4.5.1
Q: Regarding section 4.5.1 of the Bid Solicitation, would the State clarify whether the clause stating "Contractors are not permitted to submit their own maintenance agreement to the Using Agencies." is meant to only refer to subcontractor maintenance agreements? Alternatively, if this clause is meant to prohibit the Contractor from providing Maintenance Agreements directly to the Using Agencies, can the State clarify whether Contractors are expected to submit the Maintenance Agreements as part of this bid?
A: Section 4.5.1 does not refer “only” to Subcontractor maintenance agreements. This section prohibits Contractors from submitting any maintenance agreement directly to the Using Agencies as the terms of any maintenance are controlled by this Contract’s terms. Maintenance agreements are not required to be submitted at the time of Bid. However, Maintenance pricing based on time and material / hourly prices must be provided at the time of bid on Schedule H of the price sheet, as stated in Section 3.27 of the Bid Solicitation. Additionally, as clarified in the amended Section 4.5.1, Contractors are permitted to submit a Statement of Work detailing end-user and Contractor responsibilities, but additional maintenance terms will not be accepted.
59
Section 4.4.1
Q: Regarding section 4.4.1 of the Bid Solicitation, Warranty for Subscribers, inclusive of Mobiles, begins upon shipment of the radio. We would like to offer a 30-day grace period from shipment to allow for installation of mobiles. Upon lapse of this grace period due to Customer imposed delays, the warranty would begin. Does the State accept this alternative approach?
A: As per Section 4.4.1, the Warranty period begins at user acceptance. For equipment that requires installation, acceptance is when the equipment is installed by the Using Agency or the Contractor, and the equipment is determined to be in good working order by the Using Agency. Acceptance for equipment that does not require installation is when the equipment is delivered and received by the Using Agency. Such acceptance will not be unreasonably withheld.
60
Section 4.4.2

Question: Who determines the quality of the replacement parts? It says the Contractor has the burden of proving suitability and interchangeability, but to whom? |
A: The Using Agency will determine if the replacement/substitute part is acceptable and is of equal or better quality of the original part upon review of the product specification sheet submitted by the Contractor.
61
Section 4.16.1
Q: Who determines whether it is within reason?
A: The Using Agency will determine whether the parameters outlined in Bid Solicitation Section 4.16.1 are within reason.
62
Section 4.21.1
Q: Do these products need to be Zetron brand only or can they be from other reputable manufacturers?

A: Please see response to Question 12.
66

Q: How much notice is given? 30 days should be reasonable.
A: Per the NJSSTC Section 6.1, “The Director must be notified, in writing, of any price reduction within five (5) days of the effective date.” Regarding the approval of a price increase, the Contractor will be notified by the Bureau once an increase has been approved by the Director, and the change has been applied in NJSTART.

Q: If the State is seeking to implement best pricing practices while benefiting from price decreases, will the Contractor be permitted to honor and reflect MSRP fluctuations and market trends as a part of routine contract administration? If Contractors are to be prohibited from honoring MSRP fluctuations and market trends, this has the potential to solely encourage the addition and removal of new parts while discouraging vendors from presenting best pricing and base discounts.
A: Please see response to Question 27.
68

If the information is not supplied with the Quote, the State may still require the Bidder to submit it. If the Bidder fails to comply with the request within seven (7) business days, the State may deem the Quote non-responsive.”
72
N/A
Q: Can the due date be extended to give bidders time to review the answers to the questions and incorporate them into their bids?

Q: If a manufacturer does not pursue its own T0109 contract with the state, how will the state decide on which authorized reseller's contract that manufacturer will appear?
A: If a manufacturer does not pursue its own T0109 contract, one or more authorized Dealers/Distributors may be awarded the contract as long as their Quote(s) is/are deemed responsive. Per Bid Solicitation Section 1.1, “It is the intent of the State to award Contracts to those responsible Bidders whose Quotes, conforming to this Bid Solicitation are most advantageous to the State of New Jersey (State), price and other factors considered. | Q: Presently a vendor is selling our product on the NJ Contract. We would like to have them as a Subcontractor going forward. What is your recommendation on how to address the reseller authorization? We do not want the vendor to include [secondary Vendor] as a subcontractor. This is tricky. |
A: The State declines to provide advice on individual Contractor, Subcontractor, or Dealer/Distributor arrangements. However, it is noted that pursuant to Bid Solicitation Section 4.3.9(3), the Contractor must be an OEM or a direct authorized Dealer/Distributor of the manufacturer of the products which it proposes to furnish. The State reserves the right to request the Contractor’s status at any time. Failure to provide the required certification may result in bid rejection or contract cancellation. Further, as stated in section 4.21.2, if the Contractor is the OEM/manufacturer, it must provide a list of the Dealer(s)/Distributor(s) that will service the Contract, if applicable. The addition or deletion of an authorized Dealer/Distributor will require written approval from the State.
