About this file
This Bid Amendment 2 document, issued by the State of New Jersey Department of the Treasury, Division of Purchase and Property, provides clarifications and revisions to Bid Solicitation 26DPP01297 for food service items including disposable paper and plastic products. The solicitation consists of 26 price lines organized into Group 1 (8-ounce paper coffee cups and lids), Group 2 (8-ounce soup bowls and lids), and 21 individual line items ranging from aluminum carry-out trays to steel wool soap pads, with estimated four-year order quantities varying from 480 cases to 73,469 cases depending on the item. Quote submissions are due August 25, 2026 at 2:00 p.m. Eastern Time, with the revised quote opening date set for September 2, 2026 at 2:00 p.m. Eastern Time. No mandatory bidders conference or site visit is required. Bidders may bid on Groups 1 and 2 (requiring all lines within a group for responsiveness) or on any combination of individual price lines 5 through 26; the resulting contract will be awarded for a four-year base term with three one-year extension options available at mutual consent. Deliveries must be made to Distribution and Support Services in West Trenton, New Jersey within 30 calendar days of order receipt, Monday through Friday between 8:00 a.m. and 2:00 p.m.
All pricing must be firm and fixed for the initial four-year contract term, quoted on a per-case basis with unit prices including freight, shipping, and handling; price adjustments may be considered only in exceptional circumstances with proper justification and documentation pursuant to the State Standard Terms and Conditions Section 6.1. This is a reprocurement consolidating previous T0012 and T0012S contracts, with 15 items appearing for the first time in this solicitation. Bidders must complete the State-Supplied Price Sheet with unit prices per case, items per case, brand or manufacturer name, product number or description, and conformance certification for each line, along with all required standard procurement forms including Ownership Disclosure, Iran Investment Disclosure, MacBride Principles compliance, subcontractor utilization, and affirmative action documentation. Bidders may offer approved products as specified or equivalent products meeting all technical, nutritional, and packaging specifications; product samples are not required. A mandatory 1% Procurement Efficiency Program Fee applies to all bids. No set-asides for small businesses or disabled veteran-owned businesses are designated, though Central Nonprofit Agency bidders may be evaluated considering additional administrative fees under the New Jersey Rehabilitation Facilities Set-Aside Act. Financial capability information may be requested by the State, which reserves the right to award to any or all bidders, award individual price lines separately, reject any or all quotes, and invoke Best and Final Offer notwithstanding current intent not to do so.

Question: Should I check that I have properly completed and attached all of the required documents with my submitted Quote?
Answer: Yes. Prior to the Quote Opening Deadline, a Bidder should review the documents comprising the submitted Quote to ensure that all of the required documents have been completed and attached. Oftentimes a Quote is deemed non-responsive because a Bidder fails to attach a required form or attaches a blank form. To review a submitted Quote, a Bidder should log into NJSTART and review each document attached to the Quote submission. Instructions on how to review a submitted Quote can be found in the Quick Reference Guide entitled How to Review a Submitted Quote, which is available on the NJSTART Vendor Support Page under Vendor Reference Guides.

4
Exceptions
Question: Will the State allow Bidders to take exception to any of the Standard Terms and Conditions?
Answer: As stated in Bid Solicitation Section 2.2, Exceptions to the State of NJ Standard Terms and Conditions (SSTC): “Questions regarding the State of New Jersey Standard Terms and Conditions and exceptions to mandatory requirements MUST be posed during the Electronic Question and Answer period and shall contain the Bidder’s suggested changes and the reason(s) for the suggested change(s).” Moreover, as stated in Bid Solicitation Section 3.11, Bidder proposed terms or conditions that conflict with those contained in the State of New Jersey Standard Terms and Conditions may render a Quote non-responsive.”

Answer: Yes.
7
Price Adjustment Review
Question: Will price adjustments be considered during the term of the contract?

Group Awards
Question: If I bid on Groups 1 or 2, do I have to bid on all price lines within the group to be considered for an award?
Answer: Yes, as stated in Bid Solicitation Section 1.1, Groups 1 and 2 are designated as "all or none" groups, meaning the Bidder must bid on all lines within the group in order to be considered for award of that specific group. If a Bidder fails to bid on all lines within the group, their Quote shall be considered non-responsive for that group. If a brand/product bid on a price line within the group is deemed non-responsive, the entire group that price line item is part of will be deemed non-responsive, as these price lines were grouped to create a single award, with the intent that all price lines in the group will be awarded.

Section 1.2 Background
Section 5.2 Contract Transition Question: Pont A states, "A. No Award Made --In the event that a new contract has not been awarded prior to the expiration date for this Contract, including any extensions exercised, then by written notice to the Contractor, the State may exercise its right to transition this Contract for a period of up to 270 Calendar Days (the "Initial Transition Period"). All information pertaining to these Bid Solicitation’s contract transition language can be found in NJSTART by following the instructions in Bid Solicitation Section 1.2 of the subject Bid Solicitation.

3.21 Specification Conformance, 4.1 Product Specifications, and 9.2 Definitions
Question: Regarding Price Lines 1 & 3 - We have a confusion between the product specifications and "approved bid items" as specifications require recyclability and/or being biodegradable, however the items that are approved are not recyclable or biodegradable and are manufactured with recycled content. We would like to know whether we should be bidding to the product specifications or the specifications of the approved items given the variation?
Note: This question has been paraphrased in the interest of readability and clarity.
Answer: The Approved Products listed in Bid Solicitation Section 4.1 have been determined to be recyclable and/or biodegradable. These products are manufactured with recycled content. Bidders must submit quotes for products that meet the specifications within the Bid Solicitation.
Section 3.21 of the Bid Solicitation states:
“The Bidder shall certify on the State-Supplied Price Sheet that the item(s) offered in response to this Bid Solicitation conform to the significant factors and subfactors that establish the requirements and specifications set forth in the Bid Solicitation. This includes all USDA, EPA and FDA requirements outlined in this Bid Solicitation.”
Additionally, Section 4.1 of the Bid Solicitation states, in pertinent part:
“The Approved Products identified herein have been deemed by the State to meet all specifications however, any products that meet the specifications will be considered as Equivalent Products.”
Section 9.2 of the Bid Solicitation defines Approved Products as:
“Those products that have been identified in Bid Solicitation as meeting Using Agency needs and confirmed as meeting product specifications.”

3.36 State Supplied Price Sheet Instructions,
4.1 Product Specifications, and 9.2 Definitions
Question: Each of the twenty six (26) Price Lines that constitute the entirety of "Group 1", "Group 2", and the "Individual Price Lines" references one or more "Approved Products". In a number of cases, the "approved products" are products exclusive to one and only one seller, the item being a private label item of that seller. Examples include Price Line 6, Chef's Supply # CSIPLATE6UC, and Price Line 7, Victoria Bay- Mfg. ID # 307006. With that, a precedent by the State has been set of establishing private brand products as acceptable to the State. With that in mind, if we had private brand products that met the physical specs of the item listed by the State that aren't specifically called out as approved, if we sampled those items for the State prior to the bid opening, could we get those items added as approved?
Answer: Bidders can offer equivalent products as long as they meet the specifications of the Bid Solicitation. A product sample is not required.
Section 3.36, Step 5 of the Bid Solicitation states, “Step 5 – The Bidder shall enter the initials of the Authorized Representative as confirmation that the offered product meets the significant factors and subfactors of the Bid Solicitation's requirements for the subject Price Line. These initials are required regardless of whether or not the product bid is an Approved Product or an Equivalent Product.”
Section 4.1 of the Bid Solicitation states, in pertinent part, “The Approved Products identified herein have been deemed by the State to meet all specifications however, any products that meet the specifications will be considered as Equivalent Products.”
Section 9.2 of the Bid Solicitation defines Equivalent Products as:
“Equivalent Products – Products offered other than those identified as an Approved Product in this Bid Solicitation that meet the specifications herein. Equivalent Products will be evaluated to ensure that they meet all technical, nutritional, and packaging specifications herein as part of the Quote evaluation process.”

3.36 State Supplied Price Sheet Instructions and 8.9.2 Price Evaluation
Question: For Price Lines 5 through 26, are bidders required to bid all lines in this section, or can they bid some but not all items within that section?
Note: This question has been paraphrased in the interest of readability and clarity.
Answer: Bidders are not required to bid on all individual price lines, price lines 5 through 26, on the State-Supplied Price Sheet in order to be considered responsive. A Bidder may bid on one, some or all individual price lines.
Sections 3.36 and 8.9.2 of the Bid Solicitation states, in pertinent part:
“For Individual Price Lines 5 through 26:
For the Individual Price Lines, the Division intends to make one (1) Contract award for each Price Line, in accordance with Bid Solicitation Sections 8.9 and 8.16.
A Bidder may bid on one, some or all Individual Price Lines. A Bidder is not required to bid on all Individual Price Lines on the State-Supplied Price Sheet in order for its Quote to be considered responsive.”

State of New Jersey Combined Standard Terms and Conditions,
Section 6.1 Price Fluctuation During Contract, Question: Clarification is requested regarding pricing for this Bid Solicitation. Since the contract term is four (4) years, are the unit prices submitted on the State-Supplied Price Sheet required to remain fixed for the entire contract term, or does the State allow price adjustments during the contract period under any circumstances?
Note: This question has been paraphrased in the interest of readability and clarity
Answer: Please refer to answer in Question Number 7 above.
