About this file
State Form 96 is the standardized bidding document prescribed by the Indiana State Board of Accounts for public works projects submitted to governmental units throughout Indiana. The form serves as the official contractor's bid for public work and is designed to be completed by bidders responding to invitations for sealed bids. Part I of the form requires all bidders to provide essential project information including the governmental unit name, county, bidder firm information, contact details, project description, plans and specifications reference, bid amount, and confirmation of bond or certified check submission as specified in the notice of letting. The form includes certification requirements for the use of United States steel products on applicable projects and contains anti-discrimination covenants regarding employment practices. Part II, mandatory for projects valued at $150,000 or more per Indiana Code 36-1-12-4, requires extensive documentation including an experience questionnaire detailing completed and current public works projects, explanation of work plans and equipment, list of subcontractors used during the past five years, and identification of any proposed subcontractors for the current project.
The form mandates submission of a contractor's financial statement, a non-collusion affidavit, and an oath and affirmation regarding the truthfulness of all bid information, with notarization required. Bidders must certify under oath that they have not engaged in any combination, collusion, or agreement regarding bid pricing and that no rebates, fees, gifts, or commissions will be provided in connection with the bid. The document explicitly requires that all information be accurate and truthful under penalty of perjury, and the signature of an authorized representative and notary acknowledgement must accompany the submission. Any bid submitted without the required financial statement shall be rendered invalid. The form includes space for the contracting authority to document acceptance of the bid with specified conditions and provides space for filing and action tracking of the bid submission.
