About this file
The document is an email communication from Elizabeth Burgard, Procurement Supervisor at the Arizona Game and Fish Department, regarding a solicitation (BPM003384) for Hydrological Engineering Services. The communication is specifically addressed to Rudolf Ing of Dowl HKM, a consulting engineering firm, and involves price negotiations for a state contract.
The email outlines a negotiation process for fee schedules, with the state seeking to establish competitive and fair compensation rates for engineering services. The department is requesting Dowl HKM to review and potentially revise their submitted fee schedules, which were deemed to be over established benchmarks. The firm is instructed to provide a firm fixed fee for services described in an attached Excel spreadsheet, with specific guidance on in-house versus subcontractor pricing. The revised fee schedule is due by 4:30 p.m. on Wednesday, August 18th, and the department reserves the right to terminate negotiations and move to the next qualified firm if satisfactory terms cannot be reached.

Dear Mr. Rudolph;
The Department wishes to obtain fee schedules close to industry standards to have a contract that is both fair to the State and your organization.
We ask that you consider the competitive nature of this process and recalculate both the self-performed and subcontracted work.
Some of your organization’s submitted fee schedules were over the benchmarks set. The positions of concern are highlighted on the attached spreadsheet.
Please look at your submitted fee schedules and see what you can do to make this a good deal for both the State and your organization.
Please be advised that the Department is not able to negotiate a satisfactory contract with your firm, on compensation and on other contract terms the Department determines to be fair and reasonable to the state, the negotiations shall be formally terminated. The Department shall then undertake negotiations with the next most qualified person or firm on the list in sequence until a determination is reached. Once negotiations are formally terminated and negotiations commence with another person or firm on the list, the Department is not allowed to recommence negotiations with your firm.
Attached is an Excel spreadsheet with Department descriptions for services normally provided by engineering firms. Note these descriptions may not match those you provided in your original fee schedule submitted in June. Please review them carefully and provide a firm fixed fee for the services described. There were a few categories added that may not have been on your original fee schedule. If you perform these services in-house please provide a fee rate for these added categories.
If you listed specific subcontractor fees then you will not be allowed to charge a markup. All submitted fees should be for in-house services and for set subcontractor fees.
You may choose at this time to remove subcontractor pricing from your submission and subcontractor fees would then be charged at their rates plus the listed markup.
Please email the fee schedule completed and signed to Elizabeth Burgard at: eburgard@azgfd.gov
Please include the solicitation number BPM003384 and your organization’s name on the subject line of your email. The revised fee schedule is due to me by 4:30 p.m. Wednesday August 18th.
If you are not changing any fees please submit the new spreadsheet with your previously proposed fees.
Please contact me if you have any questions.
Sincerely;
ELIZABETH
