H-900 ITEMS SUPPORTED
The intent of this contract is to provide flexibility to support items defined as low-dollar requirements supported by the Defense Logistics Agency. Defense Logistics Agency Aviation has responsibility to support the Federal Stock Classes (FSCs) listed below. A list of the applicable FSCs is identified in this clause. The individual NSNs, identified as Attachments A and B to the solicitation included with this solicitation, represent currently known items with recent procurement history (FY08 through FY10) and the items for which there is forecast data (FY11 through FY13). These lists (Attachments A and B) are not intended to be all-inclusive. They do not necessarily identify all National Stock Numbers (NSNs) for items supported. It is expected for the period of performance of this contract, items that are included in this Indefinite Delivery/Indefinite Quantity (ID/IQ) contract will remain applicable for support under this contract. The Aircraft Structural Component Prime Vendor (ASCPV) Team may exclude items from this contract during the contract period upon notification to the ASCPV contractors. However, as defined within this contract, items that meet the specified criteria may be added to this contract IAW Section H-902, Addition and/or Deletion of Items.
The following Federal Stock Classes (FSC) may be supported via this contract:
FSC
FSC DESCRIPTION
1560
Aircraft Structural Components
1610
Aircraft Propellers and Components
1615

H-901 PRICE COMPETITION AND PROCEDURES FOR PRICING ITEMS ON THIS CONTRACT AFTER INITIAL AWARD
This ASCPV contract is in accordance with FAR 16.504(c)(ii)(C). This will be a multiple-award ID/IQ contract. Individual NSNs will be competed among the successful awardees based on price competition following the issuance, evaluation, and award of RFP SPRWA1-11-R-ASCPV. The selected ASCPV contractors will remain as a viable part of the active contract competition as long as the requirements of participation and satisfactory performance, as described in Section H-907- ADDITIONAL PERIODS OF PERFORMANCE EVALUATION AND AWARD, are met. Competition between the contractors will be conducted on each item identified as a requirement by the Government. All contractors must provide proposals for each item as required herein and award of each item will be made based on lowest price of that item. The items will be assigned to each individual contract based on the individual price proposed by each contractor and based on the low price per item. Award will not be made on an aggregate low price as an “all or none” award. Award of each item will be solely based on low price after confirmation of meeting the Government’s required stated delivery. An item awarded to an ASCPV contractor will not be re-competed during the same defined contract period. The contractor’s price will remain valid for a specific contractual period and any recurring requirement for that item will go back to the contractor to whom the item was awarded for that period. If, based on competition as defined herein, equal low bids are received for item(s) meeting the USG required delivery, procedures as defined in FAR 14.408-6(b) will be utilized for the purpose of awarding the item(s).
The ASCPV Contracting Officer (CO) will evaluate all prices submitted by each ASCPV contractor to determine that adequate competition exists. Requirements of FAR 16.505(b) shall be used to solicit, evaluate, and award items based on price for this contract. Requests for pricing of performance periods and adding of items will be provided by the ASCPV CO via e-mail to the ASCPV contractor points of contact. Responses to the requests shall be provided to the ASCPV CO via e-mail or as directed for a specific requirement. The price proposed by each ASCPV contractor shall be a total price to be paid by the Government for the item, including all cost required by the terms of this RFP. No additional cost for the item will be paid by the Government (including, but not limited to, such costs as; transportation, UID marking, or Government inspection costs) as these should be included, as applicable, in the amounts proposed. Evaluation of the prices submitted will be evaluated and award of each item will be made based on lowest price per item. Each ASCPV contract will be modified to include a list of NSNs and associated prices and delivery requirements for the applicable contractual period.
Once solicited, each ASCPV contractor must submit their proposed price list to the ASCPV CO within sixty (60) days of the performance period solicitation by the ASCPV CO of the list for pricing action. All available Government technical data will be made available to support the items included on the fiscal year list. The CO will determine the lowest price for each item and each ASCPV contractor will be notified of the items on the list which will be his responsibility for that contractual period. As funded requirements generate for each item, no additional competition will be conducted for those priced items and orders will be issued directly to the appropriate ASCPV contractor. For each contractual performance period, all items for which there is a valid forecast will again become available for competition. The possibility exists that items priced during any contractual period may not be purchased during that period. If requirements change and items priced during a contractual period are subsequently not required/funded, the Government has no requirement to take action to purchase the items or provide any compensation for the items or actions taken by the contractor.
Items that were not previously priced during the initial pricing effort will be offered to the ASCPV contractors for pricing in accordance with the NSN list included with the PWS that identifies the items associated with this contract. Items (and all available Government data) will be identified to each ASCPV contractor. Each contractor will be required to provide a firm fixed price for each item to the ASCPV CO within 30 days of the request.
The number of days for response may be adjusted by the CO for specific circumstances. If the number of response days is not in accordance with this clause, the CO shall notify the contractor in writing and define the specific response times. The CO will determine the lowest price for each item and those items will be awarded the ASCPV contractor. Once awarded an item, the ASCPV contractor will be responsible for supplying those items on a recurring basis for the remainder of that contractual period.
H-902 ADDITION AND/OR DELETION OF ITEMS
In accordance with Clause H-900 hereof, items (NSNs) may be added to the ASCPV contracts that are not specifically identified at time of contract award. All items must meet the same compliance criteria as established by the ASCPV baseline contract (similar type items within specified FSCs, 1G/2G items with complete data packages). Items which require GFM/GFP, tooling, or are CSI will not be added. Any NSNs not previously identified in the contract will require coordination and approval IAW approved USG Small Business coordination process prior to being added to the ASCPV contracts. Such additions in their entirety are anticipated to be minimal in relationship to the original estimated contract value.
A request for proposal to determine the price and delivery of an item shall be in accordance with this clause. The requirement may not remain with the specific contractor awarded the initial requirement for the item as the item will be recompeted for subsequent ordering periods, As subsequent requirements for the item(s) generate, the competition requirements for the item(s) as defined herein shall be utilized.
H-903 CLIN X005 DATA AND CLIN X006 OVER AND ABOVE DEFINITION AND USAGE
The Contract Line Item Number (CLIN) X006 has been established for use by the ASCPV IPT to address items that may require actions such as; vendor qualification, additional first article testing, data revisions/updates, or reverse engineering effort. Use of CLIN X006 will be based on an individual requirement and may be completed as a defined competition between the ASCPV contractors. No costs may be collected or billed against CLIN X006 without specific written direction and authorization from the ASCPV CO and a modification to the order/contract that provides established funding. All actions established for the CLIN will be firm fixed priced. If applicable, an individual PWS may be included for a CLIN X006 action. If applicable for a specific CLIN X006 action, data may be required and defined as CLIN X005. Data will be generated and defined on a case-by-case basis. No costs may be collected or billed against CLIN X005 without specific written direction and authorization from the ASCPV CO and a modification to the order that provided funding. X005 also includes data applicable to the FA test plan and FA test report as specified in that CLIN. DD1423s for the data requirements will be included on each individual order.
Utilizing X006, a contractor can choose to change suppliers and/or seek to qualify a new source on a NSN which has a FA requirement. However, if the USG has already paid for FA unit(s) during that contractual period, the contractor shall bear the cost of the FA unit submitted and no charges may be collected or billed against CLIN X006. The qualification process shall be the same as for previously qualified sources.
H-904 CONTRACTOR “NO BID” ACTIONS
The requirement of this ASCPV effort and the competition of the items for which support will be provided, each of the multiple-award contractors must provide a bid for every item identified. During the initial award evaluation, the contractor shall not provide a “No bid” for any item on the list to be priced. If a “No bid” is provided during the initial source selection process, the offeror may be deemed non-responsive and not be considered for award. All prices will be evaluated prior to making an award decision. This evaluation will include a price reasonableness determination to be made against the list of NSNs and is explained in M-900. Therefore, contractors are cautioned about providing unreasonable prices. Use of “No bids” and/or unrealistic prices during the initial award evaluation may result in the contractor being deemed non-responsive and ineligible for award. If, on the follow-on actions after the initial evaluation, an ASPVC contractor is unable to price an item and deems it necessary to provide a “No bid”, they shall provide a technical reason to support their “No bid”. This technical reason shall be complete and contain back-up data as necessary to show due diligence was taken by the ASPVC contractor to price the item. This shall be submitted to the CO as soon as the information is complete but not later than the due date for that entire pricing action.
No bid items will be unavailable to that contractor until such time as all items are competed during a follow-on action. “No bids” on follow-on actions should not exceed 5% of the number of individual NSNs being bid upon.
H-905 SMALL BUSINESS VENDOR PARTICIPATION AND REPORTING
Each ASCPV contractor shall be required to support the small business vendor community. This ID/IQ contract is the result of a Service Disabled, Veteran Owned set-aside action, and it shall be incumbent upon each ASCPV contractor to ensure that the items that meet the requirements of the Government are obtained from small business sources IAW FAR 19.502-2(c). The information provided by the Government relative to the available procurement history for each item identifies the last known source of supply. The companies identified as the source of supply include the company size indicator. Additional information regarding potential sources of supply may also be available in the Government technical information (drawings/specs/etc.). Upon request of the USG, each ASCPV contractor shall be required to identify the source of supply for each item procured under this contract. For each item proposed, the contractor shall identify the vendor name, business size, and CAGE. The contractor shall maintain this information provide the complete list to the USG at the end of each performance period.
H-906 FIRST ARTICLE REQUIREMENTS
Certain NSNs may require First Article (FA) submission. These items are identified in Attachment A along with the quantity, the type of testing and other pertinent information. The first article may require Government testing or contractor testing. The specifics for each NSN requiring a first article will be included in the individual order along with any data/reports required. The general information concerning First Articles is located in the basic contract clauses E-37 and I-75. The ASCPV contractor shall comply with the First Article requirements for individual NSNs. The conditions for First Article waiver will also be set forth the individual order. First Article waiver requests generally require 30 calendar days for review and response. First Article quantities are in addition to the production quantities required per the spreadsheet. Items submitted for Government testing will not be returned and will not count toward the production quantity. The ASCPV contractor shall be responsible for maintaining and updating the list of proven sources for the NSNs they are responsible for during the contract period and provide it to the USG at the end of the contractual period.
H-907 ADDITIONAL PERIODS OF PERFORMANCE EVALUATION AND AWARD
This contract includes periods of performance which may be used for a 5-year total contract performance period. The initial period of performance for this contract is a total of 2 years from date of contract award. The second period of performance are the 2 years immediately following the initial period of performance and the final 1 year period follows the previous period. Using delivery data available from DLA/DSCR, the ASCPV CO will make a determination 6 months prior to the end of the current performance period concerning eligibility of a contractor to compete in the next period of performance. If the contractor has not maintained an overall on-time delivery rate of 90% per NSN, it is up to the discretion of the ASCPV CO as to allowing the contractor to compete in the next period of performance. If the overall on-time delivery rate meets or exceeds 90%, the contractor will be allowed to compete. Working through the ASCPV CO, the contractor will have the right to review the data used in making this determination and provide input if they disagree with the outcome.
If the ASCPV contractor does not meet the requirements as established in this section, the contractor may be disqualified from further performance within this multiple award ID/IQ contract. The contractor shall be measured against performance requirements within the contractual performance periods and will be notified by the ASCPV IPT of performance in accordance with the standards. If performance is not in accordance with established standards, the contractor will be provided an opportunity to offer a proposal for improvement. The ASCPV IPT will periodically evaluate performance of the contractor, to include the contractor’s proposal for improvement.
In the event that based on the performance assessments one contractor is disqualified from further participation (or if the Government is notified by one of the participating contractors that he will no longer participate in the overall contract), the Government shall assess the viability of the continued performance of this contract with the remaining participating contractors.
