SUMMARY OF CHANGES
SECTION SF 1449 - CONTINUATION SHEET
SOLICITATION/CONTRACT FORM
The required response date/time has changed from 11-Mar-2021 10:00 AM to 12-Mar-2021 05:00 PM.
The following have been modified:
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JUN 2020)
**Please see the addendum to FAR 52.212-1 at the end of this provision**
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.
Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.
(ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a single copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained free of charge by submitting a request to the addressee in paragraph (i)(1)(i) of this provision.
Additional copies will be issued for a fee.
(2) Most unclassified Defense specifications and standards may be downloaded from the following ASSIST websites:
(i) ASSIST (https://assist.dla.mil/online/start/).
(ii) Quick Search (http://quicksearch.dla.mil/).
(iii) ASSISTdocs.com (http://assistdocs.com).
(3) Documents not available from ASSIST may be ordered from the Department of Defense Single Stock Point (DoDSSP) by--
(i) Using the ASSIST Shopping Wizard (https://assist.dla.mil/wizard/index.cfm);
(ii) Phoning the DoDSSP Customer Service Desk (215) 697-2179, Mon-Fri, 0730 to 1600 EST; or

(215) 697-2667/2179, Facsimile (215) 697-1462.
(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.
(j) Unique entity identifier. (Applies to all offers that exceed the micro-purchase threshold, and offers at or below the micro-purchase threshold if the solicitation requires the Contractor to be registered in the System for Award Management (SAM).) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "Unique Entity Identifier" followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see FAR subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
(k) Reserved.
(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(1) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.
(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.

(End of provision)
FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS (ADDENDA)
1.1 Addendum to FAR 52.212-1:
1.1.2 The NAICS Code applicable to this acquisition is identified in Block 10 on Page 1 of the SF 1449 form. Specific to this acquisition, the NAICS Code assigned to this procurement is 325510, Paint and Coating Manufacturing and the corresponding small business size standard is 1,000.
1.1.3 Quotes shall be submitted as follows:
Email quotations to: Amanda.Spenn@dla.mil - A single email cannot exceed 15 MB.
Quotations greater than 15 MB must be divided into multiple emails. Multiple emails must be identified in the subject line or in the context of the email with a format such as, or similar to, Email # of #.
For questions- please contact the Contract Specialist, Amanda Spenn, via email at
Amanda.Spenn@dla.mil.
1.1.4 Period for acceptance of quotations: The offeror agrees to hold prices in its quotation firm for 60 calendar days from the solicitation due date unless a different period is specified.
1.1.5 Split Award Determination:
1.1.5.1 Multiple awards will not be used in this initiative. Awarding multiple awards would not be in the best interests of the Government. Multiple contract awards would cause additional contract administration and potentially prevent contractors from meeting the 72-hour delivery requirement. Awarding a given CLIN to one contractor enables them to receive forecasted quantities from each Shipyard, which allows for efficient inventory management.
1.1.5.2 The Government reserves the right to issue more than one contract resulting from the solicitation. A determination to make split awards will be based on the prices proposed and technical acceptability non-price factors for the 144 line items in the solicitation if determined to be in the best interest of the Government. In the interest of facilitating efficient contract administration, offerors shall select, at a minimum, four (4) CLIN series to include in their offer submission. Additionally, offerors must quote on ALL individual SubCLINs within a CLIN for which they have chosen to submit an offer. Any resulting award(s) will be made on a CLIN by CLIN basis. The Government may reject the quotation based on non-responsiveness if a minimum of four (4) CLINs are not included in the quotation and/or if a quoted CLIN is not completed in its entirety.
1.2 Instructions to Offers Regarding Evaluation Criteria
1.2.1 Offerors should thoroughly read and understand the terms and conditions contained in the solicitation. Failure to provide any information requested in the solicitation may render the Offeror's quote technically unacceptable and preclude it from any further consideration for contract award. Offerors should ensure that the information contained in their quote is factual, accurate and complete. If the Government accepts the offer, it will contractually bind the successful offeror to the terms and conditions of the solicitation.
1.2.2 The Government is conducting a Lowest Price Technically Acceptable (LPTA) source selection in accordance with (IAW) FAR 15.101-2. All offers will be evaluated to determine technical acceptability. In addition to price, the Government will evaluate technical acceptability factors in accordance with the evaluation criteria contained in this solicitation. These factors are deemed essential in order to determine the offer that best meets the government's needs.
1.2.3 The following conditions shall be met in order to be eligible for award:
1.2.3.1 The offeror must be affirmatively determined responsible according to the standards in
FAR Subpart 9.1.
1.2.3.2 The offeror's quotation must comply with the requirements of law, regulation and all conditions set forth in the solicitation.
1.2.3.3 The offeror's quotation must demonstrate a clear understanding of the nature and scope of work required. Failure to provide a descriptive, reasonable and complete quote may reflect a lack of understanding of the work requirements and may result in a determination that the offeror's quote is unacceptable. The Government does not assume a duty to search for clarification data to cure problems or inconsistencies with an offeror's quote. The offeror's quotation must demonstrate how each of the minimum requirements set forth in the solicitation have been met.
1.3 Instructions to Offerors
1.3.1 Price
1.3.1.1 The offeror’s price quotation shall include the unit price and extended unit prices for each CLIN/SubCLIN selected. Pricing shall include the base period and the proposed escalation rate for the option with any supporting information. Offerors shall include the completed “PRICING INFORMATION” and “ESCALATION RATE” portion of the solicitation. The Government prefers and desires CLIN/SubCLIN pricing submission in an Excel spreadsheet format. Vendors may utilize the attached spreadsheet “SPMYM121Q002_Requirement List_2 MAR 2021” or a similar format for the price quotation submission. If the attached spreadsheet or similar format is utilized, completion of the individual and extended line item pricing on the SF1449 is not required. If a vendor elects to utilize an alternate format than provided, the spreadsheet shall be unlocked and all calculations and methods/formulas used to arrive at pricing figures must be apparent and accessible to the Government. The Government has not pre-populated formulas and/or calculations in the attached referenced spreadsheet, “SPMYM121Q002_Requirement List_2 MAR 2021.” The spreadsheet is provided as a template/suggested format for vendors to use for pricing quotation submission. Vendors are responsible for inputting any and all elected calculations, methods, and/or formulas. If a vendor elects to utilize the provided format, the spreadsheet submission shall be unlocked and all calculations and methods/formulas used to arrive at pricing figures must be apparent and accessible to the Government. Should a vendor elect to utilize the SF1449 form in lieu of an alternate format, this is an acceptable format and must be completed in its entirety.
1.3.1.2 Offerors must propose on all individual SubCLINs within a CLIN for which they have chosen to submit a quotation. In order for an offer to be determined acceptable and considered for award, offerors are required to submit pricing for ALL SubCLINs within a CLIN. To further clarify and explain this requirement, an example is provided as follows.
CLIN 0001 consists of two (2) SubCLINs, 0001AA and 0001AB. Offerors must submit pricing and extended pricing on SubCLINs 0001AA AND 0001AB in order to be determined acceptable and considered for an award. Specific to this example; if an offeror elects to quote on SubCLIN 0001AA only, the offer would be determined unacceptable and no longer considered for award of CLIN 0001.
1.3.1.3 Offerors shall select, at a minimum, four (4) CLIN series to include in their offer submission. Offerors must propose on all individual SubCLINs within the CLIN(s) series for which they have chosen to submit an offer. The Government may reject the offer submission as non-responsive if a minimum of four (4) CLINs are not included in the quotation and/or a proposed CLIN is not completed in its entirety. (Note: The minimum CLIN requirement does not include the two (2) reserved fee CLINs reflective of a “0” quantity).
NOTE: The Contracting Officer will not evaluate the quotations of those offerors whose non-price evaluation factors (Product Conformance, Technical/Quality Plan, Past Performance, and Small Business Subcontracting Plan Factors) are found to be unacceptable. For the purpose of preparing a response to this solicitation, the offeror shall assume the base period will be for 12-months/1-year beginning after contract award, with two 12-month/1-year option periods. The Government anticipates award on or around 1 April 2021, however, this date is subject to change.
1.3.2 Product Conformance: The offeror shall submit documentation clearly demonstrating and/or identifying how the proposed product(s) meet the requirements of the product conformance evaluation criteria and specifications set forth in the solicitation, or provide(s) an acceptable product exemption to include required supporting documentation.
1.3.3 Technical/Quality Plan: The offeror shall submit documentation to establish the offeror's ability and capability to address each element of Quality Assurance, Delivery Plan, Management Support, and Warehousing/Distribution, and provides assurance that the offeror will satisfy all related requirements.
1.3.4 Past Performance: The offeror shall submit documentation showing relevant corporate experience gained under specific contracts/orders within the past five (5) years. Relevant corporate experience is experience on a per-contract or per-task order basis exceeding $250,000, which, (within the past five years) is directly related to or similar to scope and complexity to that which is described in the solicitation. (See addendum to FAR 52.212-2, Evaluation – Commercial Items, Section 2.3 all associated sub-sections). Offerors who present similar contracts/orders shall provide a detailed explanation demonstrating the relevance of the contracts/orders to the requirements of the solicitation. If the offeror possesses no relevant corporate experience, the offeror shall affirmatively state that it possesses no relevant references.
1.3.5 Small Business Subcontracting Plan: Large businesses must submit a subcontracting plan in accordance with FAR 52.219-9.
1.4 A technically acceptable quote will be determined by an evaluation by the Government of each offeror's quote in accordance with the evaluation criteria identified the addendum to FAR 52.212-2, Evaluation – Commercial Items.
1.4.1 Offerors shall submit supporting documentation with their quotes as detailed above. Supporting documentation shall be clearly marked with an explanation of how the documentation demonstrates that the offeror meets the government's criteria. The Government may eliminate quotes which are not clearly marked or which do not clearly indicate how the offeror meets Government criteria. The Government may obtain and use information from sources other than those identified by the contractor. Accordingly, contractors are advised to report all sources of work experience that will demonstrate the required minimum levels of work or schedule experience.
1.4.2 Quotes are subject to the following page limits for each factor:
Price: Limited to completed solicitation documents and offered pricing submission format (provided spreadsheet or similar format)
Product Conformance: No page limitations Technical/Quality Plan: Maximum 50 pages total Past Performance: Maximum 5 references/10 pages total Small Business Subcontracting Plan: None
1.4.2.1 Each offeror shall submit a quotation that clearly and concisely describes and defines the contractor’s response to the requirements contained in the solicitation. Page format, font, and text size shall be legible. Unnecessary elaboration or other presentations beyond that sufficient to present a complete and effective proposal are not desired and may be construed as an indication of the offeror’s lack of understanding of cost consciousness.
Elaborate art-work, visualizations, or other presentation aids are neither necessary nor desired.
1.4.3 If the offeror is a wholly-owned subsidiary of another company, supporting documentation pertaining to the parent company shall be submitted. Similarly, if the offeror is a successor entity (i.e. the offeror purchased another company with the requisite experience), the offeror shall submit documentation pertaining to the predecessor company. In all cases in which documentation is under a name other than that of the offeror, the offeror shall submit documentation of its relationship with the named organization.
1.4.3.1 Evaluation of Quotes Relying on Subcontractor Experience: If the offeror is relying upon the experience of a subcontractor, the offeror shall submit documentation supporting the relationship between the offeror and the subcontractor in addition to documentation demonstrating the subcontractor's technical acceptability for that evaluation factor or sub-factor. The offeror is advised that the Government will evaluate the offeror and the subcontractor together, and make a subjective evaluation of whether the offeror's quote, when viewed in its entirety, is technically acceptable.
1.4.4 By submitting a quote, the offeror grants the Government permission to validate and investigate the quote and supporting documentation. The Government reserves the right to consider additional information discovered during the course of its efforts to validate and investigate an offeror's supporting documentation.
