Unauthorized conditions, limitations and provisions attached to the Proposal, except as provided herein, will render it informal and cause its rejection. If so determined by the Engineer, unbalanced bids will be rejected. Any Bidder may withdraw his bid, either personally or by telegraphic or written request, at any time prior to the Bid opening time.

23. SUBCONTRACTS - The Bidder's attention is directed to the General Conditions concerning subcontracts. The Bidder is specifically advised that any person, firm or other party to whom it is proposed to award a subcontract under this Contract:

Approval of the proposed subcontract award cannot be given by the Owner unless and until the proposed Subcontractor has submitted the Certification and/or other evidence showing that it has fully complied with any reporting requirements to which is or was subject.

Although the Bidder is not required to attach such Certifications by proposed Subcontractors to his Bid, the Bidder is hereby advised of this requirement so that appropriate action can be taken to prevent subsequent delay in subcontract awards.

24. COORDINATION WITH OTHER CONTRACTORS - Cooperation and adjustment with other contractors is essential to properly coordinate the construction efforts of all contractors, utility owners, and subcontractors engaged in the work within and adjacent to the project site. In case of interference between the operations of the different contractors, utility owners, and subcontractors, the Owner will be the sole judge of the rights of each and the sequence of work necessary to expedite the completion of the project; and in all cases, his decision will be accepted as final.

00100-6 of 8

25. ALLOWABLE TIME FOR COMPLETION - The time allowed for completion for all work to be done under this contract shall begin after notification by the Engineer to proceed with the work.

The funds generated by the liquidated damages will be utilized by the Owner to reimburse the Engineer for additional cost incurred by the Engineer for the additional professional services required to complete the project beyond the contract completion date. The Engineer has no authority to issue a time extension for this project.

The Engineer will not attempt to negotiate any extension with the Owner; this is the sole responsibility of the Contractor.

(1) and the provisions of paragraphs (1) through (7) in every subcontract or purchase order unless exempted by rules, regulations or orders of the Secretary of Labor issued pursuant to Section 204 of Executive Order 11246 of September 24, 1965, so that such provisions will be binding upon each subcontractor or vendor. The Contractor will take such action with respect to any subcontract or purchase order as the administering agency may direct as a means of enforcing such provisions, including sanctions for noncompliance. Provided, however, that in the event a Contractor becomes involved in, or is threatened with litigation with a subcontractor or vendor as a result of such direction by the administering agency the contractor may request the United States to enter into such litigation to protect the interests of the United States.
