About this file

This document is an Amendment of Solicitation/Modification of Contract (Standard Form 30) issued by DLA Energy for Post, Camps, and Stations fuel requirements. Amendment 0002 addresses several key issues: correcting Attachments A and B to align small business set-asides, clarifying certification requirements, and responding to multiple vendor questions. The solicitation is set aside for Small Business Concerns, with size standards of 500 employees for non-manufacturers and 1,500 for manufacturers.

Key updates include removing technical report requirements, clarifying that Women-Owned and Service-Disabled Veteran-Owned Small Business set-aside offerors must be certified on SBA.gov, and specifying that a valid BQ 9000 certification is required for Biodiesel requirements. The amendment addresses various technical questions about pricing platforms, escalators, delivery addresses, and tax responsibilities. OET (Offer Entry Tool) system issues were also addressed, with deleted line items being removed from the system and Attachment A and B documents updated to ensure consistency.

A. Amendment 0002 is hereby issued to address set aside concerns, correct Attachment A and Attachment B, provide answers to the question and answer period, clarify language in Attachment B - Line Item Price Offer Sheet, and remove the requirement for technical reports as it relates to BDI

1. The Attachment B Schedule has been updated to mirror the Small Business set asides on the Attachment A – Line Item Price Offer Sheet.

2. All offerors on Women Owned and Service-Disabled Veteran Owned Small Business set asides must be certified on SBA.gov under those Social Economic Categories to be eligible for awards of those requirements.

3. Certificate of Analysis (COA) is not needed for Biodiesel requirements, but a valid, unexpired BQ 9000 certification is required with proposal.

4. Size determination – The solicitation is set aside for Small Business Concerns that are 500 employees or small for non-manufacturer and 1,500 for Small Businesses that are manufacturers.

5. Attachment A – Line Item Price Offer Sheet and Attachment B – Schedule have been updated to correct errors in numbers and set aside. Attachment A and B should reflect the same information.

6. In Attachment A – Line Item Price Offer Sheet for groups showing UNG in column A for grouping, UNG stands for UNGROUPED and these line items should be priced individually and will be awarded individually.

7. Questions and Answers submitted during the Question and Answer period:

1. What fuels require a Certificate of Analysis? Certificate of Analysis/Quality are only required if bidding on CLINs for MGO and JAA. A valid, unexpired BQ 9000 certification is needed for BDI.

2. This solicitation requires submission of truck license numbers, VINs, and photos, which may involve hundr4eds of vehicles. Please consider requesting this information only from the awarded vendor and only for locations where it is required, to streamline proposal submission. Vendors are to submit a sample size of the vehicles that will be used for each group the vendor is bidding on.

3. What is a "Fuel Source Data Sheet"? Fuel Source Data Sheets are not required and have been removed as needed documentation for the proposals.

4. MA CLIN 0304 has the incorrect Escalator listed. Based on the BRP provided, that should match OPIS instead of Axxis. Can you please correct this? The escalator on MA CLIN 0304 shows OPIS ODSPMA1KU, which is OPIS DAILY SPRINGFIELD MA NO 1 KU. Escalator does not reference Axxis.

5. MA CLINs 0163, 0304, & 0614 have no tank information provided. Can you please update the line item narrative for these items? The tank information has been updated in Attachment B – Schedule and has been posted to

SAM.GOV.

6. NY CLIN 0339 for the address states "see schedule" but there is nothing listed in the schedule? Can you please provide the delivery address for this site? The address information has been updated in Attachment B – Schedule and has been posted to SAM.GOV.

7. NY CLIN 0522 lists the escalator as pricing on New York which is not close geographically. Should this be updated to Syracuse to match the other CLINs in the same group 6? BRP will also need corrected. CLIN 0522 is being removed from the solicitation.

8. NY CLIN 0522 lists a note that 60/40 blend is needed Nov-Mar. The Product Code though is only DS2 for #2 diesel. Should there be another CLIN added for the DS1 portion for #1 diesel? If not, how are we supposed to bid two very different products on the same CLIN? CLIN 0522 is being removed from the solicitation.

9. Can you tell me exactly what pricing platform you are using? For example OPIS Daily Harrisburg PA Heating Oil on your sheet is 2.1959, however the closest price I can find is on our evening OPIS report at 2.1927. Can you tell me exactly what pricing platform you are using? DLA Energy utilized the base reference date of August 06, 2025

10. Item numbers in VT Group 1 do not align between Attachments A and B. Item numbers in VT Group 1 have been confirmed matching on Attachment A - Line Item Price Offer Sheet and Attachment B - Schedule.

11. Some delivery notes contain quality requirements that differ from the QAPs provided. Delivery Notes that add additional requirements to what is requested in the QAPs will be adhered to.

12. Amendment 1 clarifies that COQs are not required for specific grades; however, some delivery notes request COQs for those same grades. If a line item’s delivery note requests a COQ or COA to accompany delivery, vendor will adhere to the request.

13. Will DLA accept alternative escalators? Please let us know if you have any questions or concerns. We look forward to the Q&A. DLA Energy will not be accepting alternate escalators for this solicitation.

14. Do you have an example to use for conforming statements? An example of a conforming statement is provided in the solicitation on page 30 within Subfactor a. Statement of Compliance.

15. What is the email address for OET Help? If you need assistance with OET please contact descdirectdeliverytechteam@dla.mil, or the contracting Officer, Orlando Merritt at Orlando.Merritt@dla.mil.

16. Does the Offer price includes both Federal and State taxes? All offering vendor are responsible of knowing

CONTINUATION SHEET REFERENCE NO. OF DOCUMENT BEING CONTINUED: PAGE 3 OF 3 PAGES

SPE60525R0222 - 0002

what taxes should be included for each state.

17. Do I need to include taxes within my differential? All vendor should include any necessary costs with their differential.

18. Does HUBZone offerors get the 10% price preference during evaluation? There will not be a discount applied for HUBZone offerors because the solicitation is set aside 100% for small business socioeconomic concerns.

19. Will there be an option to include taxes within OET? No, OET will not have a section for taxes.

20. Is there a tax contact DLA Energy can provide to assist with what taxes should be included? No, DLA Energy is not an expert on taxes. The vendor bears full responsibility with determining what all expenses are to be included within their total price.

21. Critical Ambiguity: Non-Refiner Size Standard

- We request an amendment to explicitly clarify the size standard for non-refiners.

- The Issue: Block 10 of the SF1449 lists the size standard as 1,500 employees (NAICS 324110). However, the solicitation incorporates FAR 52.219-33 (Nonmanufacturer Rule).

- The Regulation: Under 13 CFR § 121.406(b), a non-manufacturer (reseller) is statutorily capped at 500 employees (including affiliates) to qualify as small, regardless of the NAICS code limit for refiners.

- The Risk: Without explicit clarification, the solicitation invites ineligible offers from resellers with 501–1,500 employees, leading to potential False Claims Act violations and protests. Please confirm that non-refiners must meet the 500-employee standard.

The solicitation is set aside for Small Business Concerns that are 500 employees for Non-Manufacturer and 1,500 for Small Businesses that are manufacturers.

22. Discrepancy: Attachment A (Offer Sheet) vs. Attachment B (Schedule)

- There are significant inconsistencies between the Line Item Price Offer Sheet (Attachment A) and the Schedule(Attachment B).

- The Issue: We have identified conflicting information regarding Set-Asides and Grouping structures between these two posted documents. Specific line items listed in the Offer Sheet do not align with the details provided for those same items in the Schedule.

- Request: Please confirm which file governs in the event of a conflict. If Attachment A is the primary document for pricing, please confirm that the Set-Aside/Group designations therein supersede Attachment B.

Response: Attachment A (Offer Sheet) and Attachment B (Schedule) have been updated to reflect the same information.

OET is the primary source of pricing, which should match Attachment A - Line Item Price Offer Sheet. Updated Attachment A - Line Item Price Offer Sheet and Attachment B – Schedule have been updated on SAM.gov.

23. OET System Error: Deleted Line Items Still Active

- The Offer Entry Tool (OET) has not been updated to reflect Amendment 0001.

- The Issue: Amendment 0001 explicitly deleted 16 line items (e.g., CT Group 1: Items 0046, 0227, 0298).

However, these items still appear as active requirements in the OET.

- Impact: Because CT Group 1 is an "All-or-None" evaluation group, the OET currently forces offerors to enter pricing for these deleted items to validate the group bid. We cannot submit a compliant offer while the system requires pricing for deleted requirements.

- Request: Please update the OET immediately to remove the line items deleted by Amendment 0001.

Requirements in OET no longer showing items that have been removed and cannot be offered on.

24. Can previous contract awards or bid history be provided to assist with c rafting proposal pricing? Please utilize the CIS Energy - Contract Information System (CIS) for DLA Energy to access prior posts, camps and stations contract awards. https://www.dla.mil/Energy/Business/Contract-Information-System/

25. Can we get Attachment B – Schedule in an excel file or spreadsheet format? We do not have Attachment B - Schedule in a spreadsheet. Attachment A - Line Item Price Offer Sheet is formatted to ensure only pricing can be entered in column “P”. You’ll need to create a separate spreadsheet to manipulate further for your own internal use.
