144 To ensure all offerors to meet file-size limitations, may the offeror submit a separate emails, one for each submission document: Technical, Past Performance, and Price?
RESPONSE: Yes. Since the file size may be large, Offeror(s) may submit multiple emails (i.e. File 1 of 3; File 2 of 3; File 3 of 3)
All prime contractors and all subcontractors are required to register in the Joint Contingency Contracting System (JCCS), and are required to maintain current, accurate, and complete registration for the life of the contract. A complete vendor submission (for both the prime contractor and all subcontractors) in JCCS includes, but may not be limited to, the following: Host Nation Business License, Host Nation Specialty License
3 As many companies are registered with the KRG and not with the Baghdad Ministry of Trade, how does the Government define "Host Nation business license"?
RESPONSE: The Contracting Office expects vendors to understand the business environment they intend to operate in and the licenses required to operate in that environment.

A complete vendor submission (for both the prime contractor and all subcontractors) in JCCS includes, but may not be limited to, the following: Host Nation Business License, Host Nation Specialty License
3 Are offerors and subcontractors at all tiers required to be registered in KRG and Baghdad (Federal Iraq)?
RESPONSE: The Contracting Office expects vendors to understand the business environment they intend to operate in and the licenses required to operate in that environment.
The supplies to be furnished during the period specified in the REQUIREMENTS clause, the delivery points, methods of delivery, and estimated quantities are shown below. The quantities shown are best estimates of required quantities only. The total quantity ordered and required to be delivered may be greater than or less than such quantities.
6 Would the Government please provide times and distances for each of the Syria delivery sites so the offeror can accurately price trucking costs?
RESPONSE: No. It is incumbent upon the vendors to determine their routes and the distances between locations.
The supplies to be furnished during the period specified in the REQUIREMENTS clause, the delivery points, methods of delivery, and estimated quantities are shown below. The quantities shown are best estimates of required quantities only. The total quantity ordered and required to be delivered may be greater than or less than such quantities.
6 For all Syria delivery sites, will the movement be by military convoy, KRG convoy, or some other method?
RESPONSE: The GLOC convoy will be either military or host nation escort per the solicitation. Please see d. Special Notes, line #5. of the solicitation.
The supplies to be furnished during the period specified in the REQUIREMENTS clause, the delivery points, methods of delivery, and estimated quantities are shown below. The quantities shown are best estimates of required quantities only. The total quantity ordered and required to be delivered may be greater than or less than such quantities.
6 Where will the offeror's trucks be staged prior to movement, and how much time prior to movement must the trucks be in position?
RESPONSE: Trucks will be required to stage for GLOC. All movement SHALL be coordinated with DLA Middle East (ME) Customer Ops Office as stated in d. Special Notes, line #5. of the solicitation.
Special Notes: Contractor SHALL provide the tank batch certificate of quality (COQs) represented for all fuel deliveries under the resultant contract/order to the DLA Energy Middle East Office at DLAEnergyCustomerOps@dla.mil for approval prior to any deliveries. In addition, provide certificate of quality (COQs) to the customer at the time of delivery.
13 Much of the product in KRG is stored commercially inside Iraq, as well as outside Iraq. Its origin may be from multiple sources. The vendor provides COQs at the purchase site / loading site and delivers to either DLA or repositions to additional storage inside Iraq. Will the Government please define "tank batch certificate"?
RESPONSE: It is the COQ from the specific fuel source which the vendor intends to use to deliver fuel.
Any violation of the Iran Sanctions Act is strictly forbidden. Contractor SHALL not source nor blend any portion of the fuel destined for DLA Energy with refined fuel products sourced from Iran. In accordance with FAR 52.212-3 -- OFFEROR REPRESENTATIONS AND CERTIFICATIONS -- COMMERCIAL ITEMS (JAN 2021), by submission of its offer, the offeror certifies that the offeror, or any person owned or controlled by the offeror, does not engage in any activities for which sanctions may be imposed under section 5 of the Iran Sanctions Act.
14 Many commercial storage facilities in northern Iraq receive and maintain fuel from a variety of origin sources, including Iran. How will the Government assess price reasonableness of a lower price, which may be utilizing a cheaper blended product from questionable sources?
RESPONSE: COQs/COAs are required from where the fuel is being sourced in accordance with the Solictation. Price reasonableness will be evaluated in accordance with FAR Subpart 15.404-1.
The offeror is required to submit a listing of all proposed subcontractors, at all tiers, to the contracting officer with the submission of the proposal, and provide updates during the life of the contract when subcontractors are added or removed. If no subcontractors are expected to perform during the life of the contract, the offeror must submit a negative response to the Contracting Officer with its proposal. After award, the prime contractor must submit a negative response to the contracting officer at the beginning of each performance period.
119 Offerors will purchase product and services to stage fuel in Iraq to then deliver to the DLA. Would the Government please define the difference between a "subcontractor" and a "commercial vendor" as it applies to the requirement for
JCCS?
RESPONSE: Vendors proposing on this contract are required to register in JCCS. If the vendor intends to use a subcontractror (i.e. a fuel transporter/trucking company) other than the vendor (Prime), the subcontractor is also required to register in JCCS per the solicitation.
L117 NOTIFICATION OF TRANSPORTATION COMPANY TO BE UTILIZED IN THE DELIVERY OF PRODUCT 140 Would the Government please provide a list of US Embassy, LMC-approved fuel transport companies?
RESPONSE: No. The vendor must coordinate for this with the proper authorities on their own.
L117 NOTIFICATION OF TRANSPORTATION COMPANY TO BE UTILIZED IN THE DELIVERY OF PRODUCT 140 Would the Government provide a list of Asayesh-approved Erbil International Airport fuel-delivery access-authorized companies?
RESPONSE: No. The vendor must coordinate for this with the proper authorities on their own.
L117 NOTIFICATION OF TRANSPORTATION COMPANY TO BE UTILIZED IN THE DELIVERY OF PRODUCT 140 Would the Government please provide a list from the Autonomous Administration in Northeast Syria for fuel transport-approved companies?
RESPONSE: No. The vendor must coordinate for this with the proper authorities on their own.
Demonstrate and provide evidence of ability to gain access into Erbil Air Base (EAB) with proposal Part I – Technical by proposal due date (May 28, 2023). Demonstrate and provide evidence of ability to gain access into Syrian border with proposal Part I – Technical by proposal due date (May 28, 2023).
145 EIAB issues different types of permits depending on the work to be performed. There are permits for construction material, water, fuel, etc. If an offeror proposes a transport solution of which the permit is for construction materials, then they would not be authorized to deliver fuel at EIAB or Syria. How will the Government distinguish between general construction and fuel permits in EIAB access authorization?
RESPONSE: It is incumbent upon the vendor to understand the working environment and the proper permits required to operate in Iraq/Syria or to gain access into EAB or across the Syrian border.
145 Will the Government clarify and validate offerors have access authorization to deliver fuel?
RESPONSE: Yes. Examples of acceptable evidence include but are not limited to: 1. An updated Asayish List with Offeror’s name on it for Fuel Supply/Transportation, etc.; 2. A letter from the Asayish Defense Forces showing Offeror has access to get into EAB.
When evaluating Price, the Government will also look at Price Realism to determine if a low price reflects the contractor’s ability to understand the inherent risk in the requirement.
146 How will the Government evaluate price realism when the current incumbent contract was issued as a sole source? The differential in that awarded price above the fuel reference price exceeds general transport costs. How will the Government properly evaluate the costs of operating fuel transport authorization to EIAP and Syria?
RESPONSE: This solicitation is being competed full and open. Price realism will be performed by understanding the market place and the requirement. Prices proposed should be competitive. If proposed prices appear extremely low, then the offeror either doesn't understand the requirement/environment or is low-balling the price.
When evaluating Price, the Government will also look at Price Realism to determine if a low price reflects the contractor’s ability to understand the inherent risk in the requirement.
146 Should offerors assume that the incumbent contract is the basis for this price realism assessment?
RESPONSE: No. The incumbent contract was awarded under different coonditions. See response above.
Sub Factor 1 - Supply: The Government will evaluate the Offeror’s supply plan to assess the Offeror’s ability to supply all of the products listed and in the estimated quantities stated in the schedule (Solicitation Provision B1.05/DLA Fuel specifications in Section C). The following items are required to be submitted for consideration:
149 How will the Government manage the transition from an incumbent contractor to new offeror should one be awarded?
RESPONSE: Delivery Orders can be made until the end of the Period of Performance of the contract, which means incumbent will be delivering fuel into the next month. This is the transition period for the new contractor to obtain fuel and prepare to deliver fuel.
149 There is no requirement for a transition plan in the solicitation nor is there any indication of how the Government will manage a transition. How should non-incumbent offerors plan to partner with DLA for transition in and transition out with the incumbent?
RESPONSE: See response above.
Are Ground Lines of Communication (GLOC) military/host nation escorts required for performance CLIN’s 1‐13?
RESPONSE: Yes. You have to stage at EAB.
Will Ground Lines of Communication (GLOC) military/host nation escorts be provided for the entire contract period of performance?
RESPONSE: The Contracting Office does not know. The environment changes in Iraq daily. GLOC escorts are available on a mission‐to‐mission basis, and are contingent on other requirements in the region. Per the solictation, ALL movement SHALL be coordinated through the DLA Middle East Office first. They will provide direction/guidance for all movement to delivery sites. If awarded the contract, Vendors will later need to coordinate with CJTF‐OIR personnel prior to GLOC movements, as
CJTF‐OIR determines whether military escorts/host nation escorts will be provided. Additionally, vendors will receive information on staging requirements, GLOC process, and related information from CJTF‐OIR, as they are responsible for the
GLOC movement.
In what event will Ground Lines of Communication (GLOC) military/host nation escorts be “not required or unavailable”?
RESPONSE: The Contracting Office does not know when escort will not be available or not required. GLOC escorts are available on a mission‐to‐mission basis, and are contingent on other requirements in the region. Per the solictation, ALL movement
SHALL be coordinated through the DLA Middle East Office first. They will provide direction/guidance for all movement to delivery sites. If awarded the contract, Vendors will later need to coordinate with CJTF‐OIR personnel prior to GLOC movements, as CJTF‐OIR determines whether military escorts/host nation escorts will be provided. Additionally, vendors will receive information on staging requirements, GLOC process, and related information from CJTF‐OIR, as they are responsible for the GLOC movement.
In the event Ground Lines of Communication (GLOC) military/host nation escorts are not provided, will vendors still require to stage at Erbil Air Base (EAB)? Doing so will exceed the minimum needs to DLA‐E because there is not GLOC escort/convoy to “stage” with.
RESPONSE: Staging at EAB will be required when there is a GLOC scheduled for delivery of fuel at locations identified in the solicitation. The DLA Middle East Office will inform vendors of quantities, locations, and GLOC dates we want them to be on based on the Delivery Orders made. Per the solictation, ALL movement SHALL be coordinated through the DLA Middle East
Office first. They will provide direction/guidance for all movement to delivery sites.
Please define “military” and “host nation” escort.
RESPONSE: Military escort = US Military Forces // Host Nation escort = Host nation forces
Will USG allow private security in the event no military/host nation escort is provided?
RESPONSE: Security is the responsibility of the vendor and if vendor chooses to use private security it should be factored in price.
Can offerors provide two prices? 1 price includes military/host nation escort; 1 price includes private security.
RESPONSE: No. Security is the responsibility of the vendor and if vendor chooses to use private security it should be factored in price. If no security is provided for the GLOC, vendors will need to provide their own means of security.
Upon information and belief, the USG plans a draw‐down of US Military forces in Syria. It is evident based on the solicitation that US Military/host nation escorts will likely not be provided at some point during the contract PoP. It is impossible to create a “detailed description of the offeror’s plan and movement of product(s) to the locations listed in the solicitation schedule” without knowing if Ground Lines of Communication (GLOC) military/host nation escorts are provided.
RESPONSE: Government reserves the right to Terminate for Convenience at any time.
How will the Govt evaluate price realism if vendors do not know if military/host nation escorts are provided?
RESPONSE: GLOC escorts are available on a mission‐to‐mission basis, and are contingent on other requirements in the region.
Vendors should calculate security into their price. Through coordination with the DLA ME Office, as required by the solicitation, they will let the awardee know if there will be a GLOC movement or not, and if there isn't going to be a GLOC, they may authorize vendor the ability to free wheel to locations. Offeror price should include security in case allowed to free wheel.
Historically, GLOCs with escorts have been provided, however, the environment in Syria is changing/unpredicatble.
Will the JCCS deadline be extended if the solicitation is extended?
RESPONSE: No. A presolicitation Notice was posted November 30, 2022 about this requirement providing sufficient time for all vendors to register in JCCS. Please notify the Contracting Office when your documents have been provided and you have registered in the system prior to the deadline date.
Why is the DLA proposing a mix of different PLATTS references, some CLINS have an Arab Gulf escalator and other MED?
Upon information and belief FOB Arab gulf does not accurately track local market conditions for Jet Fuel as all the products under this contract will be sourced from the Mediterranean.
RESPONSE: Diesel and MOGAS requires EN 590 and EN 228 specifications which cannot be sourced locally, however, JP8 can be sourced locally, thus the use of different escalators.
Can alternative escalators be proposed?
RESPONSE: No. Not for this requirement.
Committee List
RESPONSE: The Contracting Office does not have an example letter. The vendor must coordinate for this with the proper authorities on their own.
Please provide a copy of an example letter from the Asayish Defense Forces.
RESPONSE: The Contracting Office does not have an example letter. The vendor must coordinate for this with the proper authorities on their own.
What is the Asayish List?
RESPONSE: The Asayish List is the authorized list of contractors maintained by the Asayish Defense Forces that have authorized access into Erbil Air Base. If you're not on the list you will not be able to enter/access/ or stage with the GLOC.
Who are the Asayish Defense Forces?
RESPONSE: The Asayish Defense Forces control access into Erbil Air Base, the staging location for the GLOC convoys.
Will contractors performing under this contract be given “CAAF” status under DFARS 252.225‐7995?
RESPONSE: No. Contractor personnel will not be collocated with the U.S. Armed Forces.
Is the offeror required to have a host nation business license to be approved in JCCS?
RESPONSE: To be registered in JCCS you have to provide the Host Nation Business License
Are fuel convoys escorted by security forces all the way from leaving Erbil International airport and all the way back to Erbil?
RESPONSE: No.
HS Codes. For the various types of fuel in this opportunity. Do you have HS Codes that you can provide that tie to each required commodity? Our 3PL delivery company is asking as it pertains to custom clearance documents required for the deliveries.
RESPONSE: The Contracting Office does not know what HS codes are. The NSNs for the fuel type are provided in the solicitation.
Military Security. Will FLA help arrange government security on shipments coming from the Ibraham Khalil Cross Border check point then into IRAQ to the drop points in Erbil?
RESPONSE: No.
Custom Clearance declarations and Diplomat permissions. Will DLA Contracting officials provide the Diplomat permissions documentation for cross border approvals that will go along with the customs declarations?
RESPONSE: No.
Are there any DLA Duty Exemptions for these destinations?
RESPONSE: No.
Fuel swap. If we can provide fuel in any parts of the region, is there any fuel swap opportunities as apart of this Solicitation?
RESPONSE: No.
If we pull fuel from ADNOC in UAE for this opportunity, is there a loading inspection requirements?
RESPONSE: It is incumbent upon the vendor to identify their business requirement.
With our current access we can pull fuel from ADNOC at Jebel Ali Port in UAE. Then ship to Mersin Turkey and transport to
Ibrahim Khalil through Cross border Check and into Erbil over the road. From historical perspective, how many monthly shipments are we talking into Erbil?
RESPONSE: Fuel requirement is based upon monthly orders that vary based on the customer's needs. Vendor needs to execute delivery plan based on where the fuel is being sourced from and transported to the delivery locations.
Based on historical deliveries, Are they shipping iso containers or just larger sized (8‐10k) or smaller sized tanker (4‐
6k)deliveries?
RESPONSE: It's the vendor's responsibility to determine the most appropriate delivery methods to meet the terms and conditions of this requirement.
Will a bobtail be required in case of a breakdown during the GLOC?
RESPONSE: A bobtail will be required for all GLOC movement in case of breakdown and should be calculated into Offeror's cost/Price Proposal. GLOC will not wait until one arrives if you don't have one. They will move on.
