Question Answer

1. In reference to Appendix M, Page 8: “Contractor provided Special Purpose refueling/defueling vehicles will be in place NLT 24 months after contract start date…”, we did not see the refueling/defueling vehicles specifications (i.e.

nozzles, hoses, etc.) in the PWS or Appendices.

Please provide the specifications so we can obtain price quotes from our vendors.

As this is a performance-based contract, it is the offerors responsibility to ultimately determine the assets and capabilities provided and demonstrate such in their proposal; the government has provided additional guidance via revised PWS Appendix H.

13. In reference to the Attachment V WD and CBA on page 28.

Question: Is the Fuel Specialist listed in the CBA the same as the Fuel Distribution Operations Specialist?

The PWS does not list Fuel Specialist as a position.

14. The subject RFP has "X'd" all FAR Service Contract Labor Standards 52-222-41 thru 52.222- 43 but not 52.222-44 which specifically discusses Collective Bargaining Agreements.

The USG included a CBA between Fuel Services DL Joint Venture and Teamsters Local Union No.

957 General Truck Drivers, Warehousemen, Helpers, Sales and Service, and Casino Employees for which new option year hourly rates start October 1, 2024 and October 1, 2025.

Question: Why didn't the Government include FAR 52.222-44?

FAR 52.222-44 does not apply IAW the prescription at FAR 22.1006 (c)(2).

957 General Truck Drivers, Warehousemen, Offerors will be able to submit an annual wage determination under FAR 52.222-43.

Wright Patterson Questions and Answers Helpers, Sales and Service, and Casino Employees for which new option year hourly rates start October 1, 2024 and October 1, 2025.

Question: Will the government clarify if offerors be afforded the ability to submit CBA-wage and fringe benefit related Wage Determination wage increases if and when new agreements are reached in the future?

16. The subject RFP has "X'd" all FAR Service Contract Labor Standards 52-222-41 thru 52.222- 43 but not 52.222-44 which specifically discusses Collective Bargaining Agreements.

-The USG included a CBA between Fuel Services DL Joint Venture and Teamsters Local Union No.

957 General Truck Drivers, Warehousemen, Helpers, Sales and Service, and Casino Employees for which new option year hourly rates start October 1, 2024 and October 1, 2025.

-The Volume III pricing instructions on page 78 state "Wage Determination (See Section J, Attachment V) CBA 2022-0116 Rev No.: 1 dated 05/20/2022 -Wage Determination Number 2015- 4731 (Rev 23) dated 04/19/2024. Pursuant to FAR 52.222-41 Service Contract Labor Standards (Aug 2018), all pricing must be reflective of current and prospective wage rates and fringe benefits which are effective or will be effective during any period in which the contract is being performed."

Question: Will the Government, because FAR 52.222-41 and FAR 52.222-43 conflict with each other, indicate whether offerors are to use SCA wages unescalated and then (by dint of FAR 52.222-43), be able to submit wage determination increases for any obligatory increases in wages and/or benefits in the out years OR use escalated SCA wages in the out years?

Please refer to FAR 22.1006.

17. The RFP's Volume III Price instructions as well as "Atth V WD-CBA 2022-1161 Revised.pdf" refer to Wage Determination Number 2015-4731 (Rev 23) dated 04/19/2024; The Section L-Instructions, Conditions, and Notices to Offerors Addendum to FAR 52.212-1 at Paragraph L-0001 L82 includes reference to Wage Determination number 2022- 0116 Rev No.:1, dated 05/20/22.

Revised WD & CBA 2024-375 Rev. 0 is incorporated in Amendment 0004.

Wright Patterson Questions and Answers Question: Will the Government clarify which wage determination is correct and correct the applicable documents, as appropriate?

18. Question: Will the Government consider modifying Section B by separating each year into its own

CLIN 0001, 0002, 0003, 0004, 0005, 0006, 0007,

0008 and 0009 and adding subtotals for CLINs 0001 thru 0004 and 0005 thru 0009 or otherwise, clarify how it will determine the value of CLIN 0009's price?

The total of CLINs 0001-0004 will be evaluated for the base period and the total of CLINs 0005- 0009 will be evaluated for the option period. The price of the option period (Sum of CLINs 0005- 0009) will be multiplied by 6 to obtain the 6-month extension price.

19. Question: The instructions with regard to the Department of Labor's Regulations, the FAR and the RFP instructions conflict as to whether offerors are to escalate Non-FLSA exempt wages and will be afforded the opportunity to turn in wage increases in accordance with FAR 52.222-43.

Will the Government clarify whether Contractors are to escalate SCA/CBA wage rates in the out years and amend the pertinent sections as may be necessary?

The Government does not dictate the terms of price escalation. Contract will be awarded LPTA.

20. Attachment II PPQ- There appears to be a technology error in the PPQ form and the instructions on the form list only one person to whom the form should be sent. It lists Ralph Dayougar as the point of contact. to whom the completed questionnaire should be sent, but the hyperlink embedded in the form is for Alex Cano. Also, RFP page 78, paragraph ii specifies that the questionnaires be sent to the CO and the CS for this solicitation. The form only contains one name and email address. This could be confusing for the persons filling out and submitting the form to the CO and CS.

Question: Will the Government please issue a corrected PPQ form with both contracts and the email addresses?

Amendment 0003 revised the PPQ and corrected the hyperlink error.

21. There are two job classifications listed in the CBA;

Full-Time Fuels Specialist and Part-Time Fuels Specialist as well AWD 2015-4731, rev#23 dated 19Apr24. There are, however, no Job Descriptions provided in the PWS or the CBA to help differentiate between them and the SCA Occupation Codes 23311 - Fuel Distribution System Mechanic and 23312 - Fuel Distribution

Please refer to CBA and SCA WD.

Wright Patterson Questions and Answers System Operator, as well as other SCA Occupation Codes. While the incumbent has an advantage with regard to the utilization of the CBA labor classifications, it is proper to level the information to allow for a fair and reasonable consideration.

Question: In order to ensure all offerors understand the correct labor classifications to use, estimate the correct skills/experience, hourly wage rates, fringe benefits (including Paid Time Off) and are afforded the same understanding regarding the work skills and experiences as the incumbent, will the Government please provide a job description for both CBA positions.

22. The amount of PTO increases with tenure - as delineated in the CBA. As a result, productive hours are reduced as CBA employees become more senior. While the incumbent has an advantage with regard to the utilization of the CBA labor classifications, it is imperative that all offerors are informed about the number of productive hours available as opposed to the number of work hours required to perform in accordance with the PWS.

Question: Will the Government please provide the average seniority of each position employed in the subject opportunity?

The Government does not possess this information.

23. Will the US Government consider including 52.216-4 - Economic Price Adjustment - Labor and Material be added due to the up to nine-and-a-half-year PoP?

The KO has made the determination to utilize a firm fixed price contract. Any price fluctuations can be addressed by utilizing the Wage Determination or by submitting a Request for Equitable Adjustment.
