Inland/East/Gulf Coast/Offshore (IEG) SPE60222R0712 Preproposal Conference
July 7, 2022, 0900-1100
Question and Answer Session
1) Q: Will this recording be sent to all vendors?
A: Yes, here is Preproposal Conference Zoom Recording link:
Click here to watch the Zoom recording.
Passcode: Kx7?Th05
2) Q: Will there be a list of all interested vendors online today?
A: Yes. Please see page 6.
3) Q: Was a source sought issued?
A: Yes.
4) Q: Is there enough time to sign up for Sam.gov and get approved in enough time to submit for this bid?
A: Due to the time anticipated to fully enroll for a SAM account, it is highly unlikely for this bid.
5) Q: When is the latest you can request an alternate escalator?
A: At interims. The Request for Proposal (RFP), section M details the entire procurement process. Additionally, please be advised that the later anything deviating from the solicitation is submitted, the higher the risk to the contractor because it is NOT guaranteed to be approved. Please allow for the evaluation of the request. A best practice is to submit anything that deviates from the solicitation as early as possible, and escalators are no different.
6) Q: Are there any considerations on waiver to NMR given in our current climate?
A: The NMR will not be waived for this procurement.
7) Q: Are there any updates coming to OET to clearly identify the OSP sections in the entry tool areas so we can communicate more clearly during negotiations?
A: The crosswalk covered in the PowerPoint slides is attached to the RFP on SAM.gov as a J attachment. Please utilize this tool to communicate during negotiations.

8) Q: How do I determine when there’s enough competition for F76?
A: The Government determines adequate competition to mean two or more offerors for the required supply.
9) Q: Can we expect an announcement for a F76 small business set aside?
A: At this time, DLA Energy has not identified enough competition for small business F76 manufacturers to consider a set-aside for this product.
10) Q: What are the reasons for not permitting an F76 set-aside for small business?
A: Please see the response to question 7.
11) Q: Can a small business do a SBA MPA with a large business in order to assist in fulfilling the task on the 41%?
A: There is nothing that precludes a small business from offering in this manner.
Please be advised this SBA program has very specific and detailed requirements that the entity MUST adhere to for the offer to be evaluated accordingly.
12) Q: What can a SB do to get the attention of the Large Business and how is the best way to go about this task?
A: Supplier outreach is a function of the small business entity. However, there are resources on the SBA website to assist in these market research efforts for small business concerns. Also please refer to the SBA's to DLA local SB office and their local PTAC office (see website).
13) Q: On page 241 of the Solicitation, paragraph (b) Options is confusing and vague, please explain if possible?
A: This is in reference to the possibility that the Government is required to envoke the following clause: 1209.09 EXTENSION PROVISIONS (DLA ENERGY JAN 2012) (a)The Government shall have the right to extend this contract on the same terms and conditions one or more times for a total of no more than six months.
Notice of contract extension will be furnished to the Contractor not later than 30 days prior to expiration of the contract ordering period or any extension thereof.
Nothing in this contract provision precludes the Contractor from agreeing to an extension of the contract if the DLA Energy Contracting Officer fails to issue the notice prior to 30 days before the end of the ordering period.
14) Q: Is there any thought of offering a 2-year deal vs yearly? It seems like you go from an award, couple month break, then start all over again.
A: This issue has been routinely sent to suppliers for feedback in the form of proposal debriefs, surveys, and Requests for Information (RFI) and the consensus is that a yearly procurement is the most appropriate length of time for this effort.
However, we encourage feedback at any point of the procurement and invite vendors to provide rationale for consideration of alternate arrangements in the future.
15) Q: How does the Syncada Program come into play with this contract working through the USBank, of which by the way is only bank approved for this Program?
A: The carriers must be registered with US Bank who provides the Third-Party Payment System (TPPS) SYNCADA. Payment of freight services within the United States, to include small packages and sealift intermodal container services, shall be paid through the currently authorized TPPS.
Once a trailer is loaded, the vendor will create an “ORDER” in SYNCADA; the carrier will input their corresponding “INVOICE” once each load is complete. The vendor will review in SYNCADA and approve for payment once validated.
16) Q: Due to price volatility will DLA offer a price adjustment on FOB Destination offers similar to the fuel surcharge offered to transportation companies?
A: DLA does not anticipate the need or necessity to consider or offer a price adjustment due to the nature of the Economic Price Adjustment (EPA) contract terms. The EPA calculations adequately and sufficiently address any differentials in the prices paid according to the current market conditions.
17) Q: Is there a 200-mile rule in this solicitation? Where a supply point must be within 200 miles of its destination?
Follow up on the 200-mile radius question: Doesn’t the 200-mile radius (origin to destination) severely limit the possible suppliers to single or a small handful of suppliers/refineries in the immediate area of the largest consuming military installations?
As mentioned on the 200-mile rule being the general rule currently. If the bid is on the cusp of the 200-mile rule but still competitive, will it be evaluated or eliminated based on the 200-mile rule?
A: Currently it’s not but I believe language will be added with an upcoming amendment. DLA Energy will only consider FOB Origin locations that are within the eight hour round trip to delivery destination and back to origin to be available to load the next day. DLA Energy will evaluate based upon coverage.
18) Q: For Colonial Pipeline supply at USGC origins, the product is generally traded in the market without identifying the injection location (typically Houston, Pasadena, Port Arthur, Lake Charles, Baton Rouge, Krotz Springs, Collins). Can we participate in your tender to commit to supply from any refinery that supplies jet into Colonial Pipeline at these locations and provide a generically traded jet fuel? Could you evaluate the offers on the basis of the first injection location, so all offers are normalized against this and supply is actually adjusted against where the oil was injected.
A: If an Offeror is trading on Colonial Pipeline, depending on where DLA Energy takes acceptance of the fuel and the lowest laid down cost are factors taken into consideration.
19) Q: For fungible Colonial Pipeline jet deliveries, it isn't always possible to provide quality certificates (if buying from others, the quality certificate is only provided to Colonial Pipeline from the refinery injecting jet into the pipeline). Can you please comment specifically how to address quality documentation around Colonial Pipeline deliveries where quality certificates cannot be secured?
A: Request Offeror submit an exception request, and this will be addressed at that time.
20) Q: What are service compensation calculations acceptable to the contract? Is there other fuel service contract that is supposed to cover compensation prior to submission of quote for laid down cost? If so and not already contracted, what is the small business inclusion plan? What if large producer fails or delays services already or pending contracting letter of intent? Based on awards, are there incentives to subcontract non awarded vendors who participate in the bid and on what quantity, compensation and service plan with DLA and awarded vendors?
A: No service compensation calculations are acceptable in the RFP or resulting contract. DLA does not refer or encourage an awardee to subcontract to anyone, it is a business decision for the awardee. There are no incentives in the RFP/ or resulting contracts regarding subcontracting.
With regard to the inclusion plan:
FAR 19.705-4 Reviewing the subcontracting plan.
(c) In negotiated acquisitions, the contracting officer shall determine whether the plan is acceptable based on the negotiation of each of the 15 elements of the plan (see 19.704).
My interpretation of FAR 19.705-7 (a) Compliance with the subcontracting plan is as follows.
The incentive to subcontract is to provide Maximum practicable utilization of small business, veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small, disadvantaged business, and women-owned small business concerns as subcontractors in Government contracts is a matter of national interest with both social and economic benefits.
Disincentive: When a contractor fails to make a good faith effort to comply with a subcontracting plan, these objectives are not achieved, and 15 U.S.C.637(d)(4)(F) directs those liquidated damages shall be paid by the contractor.
