Solicitation SPE602-20-R-0720
QUESTIONS AND ANSWERS – SET 1
Section A:
1. QUESTION: Per solicitation note 21, since a QCP is not currently on file, a two page outline of a proposed QCP describing the offeror’s current inspection system and quality assurance procedures, with references to provisions E1 and/or E1.12 is required. Final QCP is required prior to first delivery to DLA Energy Americas East Quality Assurance Representative but no mention of whom to provide two-page outline. Please provide POC for outline to be delivered.
DLA ENERGY RESPONSE: Offerors are required to submit one of the following with its proposal to demonstrate its ability to develop and implement a QCP:
a) Statement certifying that it has an approved QCP on file with DLA Energy within the past 24 months; or
b) Provide an outline not to exceed two pages in length of a proposed QCP describing the offeror’s current inspection system and quality assurance procedures, with references to corresponding requirements in provisions E1 and/or E1.12.
If the offeror is selected for award, the final QCP will be coordinated with the applicable DLA Energy Americas East Quality Assurance Representative at that time.
2. QUESTION: Per solicitation note 12, please provide contact information for DFSP – Texas City and Beale AFB so we can ask questions regarding delivery location access procedures and processing times
DLA ENERGY RESPONSE: Provided via email. Offerors may request the contact information via email to stephanie.koessel@dla.mil and paul.johnson@dla.mil.
3. QUESTION: Per solicitation note 18, offer may be required to begin sealing all applicable conveyances within 24 hours during elevated security requirements. Please provide THREATCON level documentation and which level coincides with sealing requirement.
DLA ENERGY RESPONSE: Individual THREATCON level and requirement to seal conveyances will be determined by the product delivery location as needed. There is no standardized chart to state when seals would be required. The ordering activity should note the requirement when is needed on the order when placed.
Section B:
4. QUESTION: Per FOB Restrictions, Mode delivery offers should be at destination not origin except for Barge at DFSP. This is counter to M27 Evaluation of Offers (Domestic Bulk) (DLA Energy Jan 2012) which states “…offers covering delivery on an origin basis at Contractor’s refinery, terminal, and/or bulk plant are requested…” Please confirm offer should include both origin and destination pricing for railcar and truck even though schedule lists only destination.
DLA ENERGY RESPONSE: Please refer to FAR 52.212-4(s) in Section I of the solicitation. Any inconsistencies in the solicitation or contract are resolved by giving precedence to the schedule of supplies/services (Section B) first. M27 is a solicitation provision used across all DLA Energy Domestic Bulk procurements and is not specific to this procurement.

5. QUESTION: B19.33 Economic Price Adjustment, Column V shows 2 different market price indicators (PLWCJET and PLTSGCJET). Please confirm EPA selection is based upon a single indicator selected by the offeror.
DLA ENERGY RESPONSE: The two market price indicators in the table are provided as approved escalators for offeror’s to choose from; however, offerors may submit an exception and propose a different market price indicator that conforms with B19.33’s requirements.
Section C:
6. QUESTION: C16.08-13 (a) refers to FSII and CI additives included in schedule of delivery but zero mention is made of JFA-5 additivity normally supplied free of charge. Please confirm access, delivery, and procedures for procurement of JFA-5 in support of JPTS refining.
DLA ENERGY RESPONSE: DLA Energy provide JFA5 to the vendor as Government Furnished Product (GFP) but the vendor is responsible for other additives (FSII and CI).
Section D:
7. QUESTION: Page left intentionally blank?
DLA ENERGY RESPONSE: Yes, page left intentionally blank.
Section F:
8. QUESTION: Per section B, acceptable modes are Barge, Railcar, Tanker, and Truck; however, Section F refers to Tank Cars, Boxcars, Trucks, Transport Trucks, Truck and Trailers, Tank Wagons, Pipeline, and Lighters without any definition/description on the difference between acceptable modes and the mismatch delivery conditions.
Please provide information on the delivery conditions and how they relate to acceptable modes.
DLA ENERGY RESPONSE: Please refer to FAR 52.212-4(s) in Section I of the solicitation. Any inconsistencies in the solicitation or contract are resolved by giving precedence to the schedule of supplies/services (Section B) first. Section F provisions are used broadly across DLA Energy and DLA Energy Bulk Petroleum procurements are not specific to this procurement.
9. QUESTION: Section F1(b)(2) states delivery by railcar is required within 24 hours of date specified by order when a minimum of at least 120 hours (5 days) is given. Given production and storage is being accomplished in TX, this requirement is not achievable for CA location. It takes minimum of 1 day to load railcar, minimum of 1 day to spot (pick-up) railcar, 3-5 days transient time, and then additional days for unloading/spotting at destination.
Can the lead time be waived, changed, or an exception within OSP?
DLA ENERGY RESPONSE: Please refer to M72.10 Evaluation of Offers (Exceptions/Deviations) for instructions for submitting deviations/exceptions to the requirements of the solicitation.
10. QUESTION: Section F1(b)(2) states delivery by Truck is required on date specified by order when a minimum of at least 48 hours (2 days) is given. Given production and storage is being accomplished in TX, this requirement is not achievable for CA location. It takes minimum of 3-4 days traveling via truck to arrive based upon Department of Transportation Federal Regulations on driver times and distances. Can the lead time be waived, changed, or an exception within OSP?
DLA ENERGY RESPONSE: Please refer to M72.10 Evaluation of Offers (Exceptions/Deviations) for instructions for submitting deviations/exceptions to the requirements of the solicitation.
11. QUESTION: Sections F1 and F1.01-5 seem to have duplicative information as it relates to JPTS. If given relief on delivery times based on lead time (see questions 13 and 14), do we also need to request relief from F1.01- 5(b)(2)?
DLA ENERGY RESPONSE: Section F1 will be removed in a future amendment. Section F1.01-5 is specific to JPTS.
Section I:
12. I28.03-1 states contractors shall forward requests for tax exemption certificates. COMPANY is requesting the tax exemption certificates for both taxes under paragraph (a) and (b).
DLA ENERGY RESPONSE: Noted. Pursuant to the provision cited, all requests for tax exemption certificates should be submitted to the Contracting Officer.
