PART I – SF 1449 IMPORTANT NOTICES TO OFFERORS
1. This solicitation is for the delivery of Gaseous Helium, Type 1, Grade A and Grade N, both Bureau of Land Management (BLM) and Non-BLM, on an F.O.B. Origin basis into Government-provided compressed gas tube-bank trailers, and International Organization for Standardization (ISO) containers. The government contemplates the award of a Fixed Price with Economic Adjustment Requirements contract type. All quantities in the schedule are estimated quantities.
2. The period of performance is five (5) years which begins 1 April 2018 and ends 31 Mar 2023. However, should the Federal Helium Reserves close prior to the end of the performance period, the Government reserves the right IAW FAR 52.212-4(l) to Terminate for Convenience the remaining portion of the contract.
3. Helium purchases under product CLINs 0001 through 0010 of this solicitation are subject to the Helium Act and as such, FAR Clause 52.208-8 Required Sources for Helium and Helium Usage Data (April 2014) applies. Only Federal Helium Suppliers as designated by the Bureau of Land Management will be eligible for a contract award for CLINs 0001-0010.
4. The resultant contract(s) will contain an Economic Price Adjustment (EPA) clause. For BLM Requirements, the EPA escalator is mandated by the BLM pursuant to the helium privatization act. All BLM Gaseous Helium product CLINs (0001 through 0010) will be adjusted using the BLM “In-Kind” rate.
For all Non-BLM Gaseous Helium product CLINs (0011 through 0020), the BLM “Conservation Helium” rate will be utilized.
The EPA mechanism is NOT applicable to any CLINs for services CLINs (0021 through 0024).
5. Except for the annual BLM adjustments, the awarded prices for product will remain firm for the duration of the contract. Any recovery costs associated with moving crude helium to the refining plant and moving the refined helium to the transfill locations for filling or any other production costs must be included in the unit price. All prices proposed for the BLM product CLINs (0001 through 0010) shall be based on the BLM FY 2018 (Oct 2017 – Sept 2018) crude helium price of $86.00 per mcf (in-kind) and the non-BLM product CLINs (0011 through 0020) shall be based on the crude helium price of $119.00 per mcf (conservation helium) for FY 2018 (Oct 2017 – Sep 2018). Both are considered to be the base reference prices for this procurement. When constructing the yearly pricing proposal, Offerors should begin with the base reference prices and add to it any other variable and fixed costs, including profit. If either the in-kind helium price for FY 2019 or the Conservation helium price for FY 2019 become available before final price revisions (FPRs) are due, an amendment will be issued to this solicitation in order to incorporate the new index prior to submission of FPRs.
6. Offerors may submit price proposals for as many transfill locations per product CLIN as desired, as shown in Section B – Supplies/Services. As such, Offerors will provide the quantity and proposed price for all BLM and/or non- BLM helium to be provided out of that transfill location. Offerors may propose the entire yearly estimate from each proposed transfill location, if it is available from that transfill location. Each customer location will be supported from the proposed contractor transfill location that represents the lowest laid down price for that location. However, only Federal Helium Suppliers as designated by BLM will be eligible for award of any quantities under CLINs 0001 through 0010.
7. The use of the terms “containers” throughout the solicitation applies to Government-provided compressed gas tube-bank trailers and government-provided ISOs.
8. All Offerors must comply with the requirements listed in DLA Energy Aerospace provision L-0003 L2.35 Proposal Format and Content (Aerospace Energy) (DLA Energy Jan 2012) and all offers will be evaluated in accordance with DLA Energy Aerospace provision M-0001 M2.14 Evaluation - Commercial Items (Aerospace Energy) (DLA Energy AUG 2009).
9. For questions regarding small business or small disadvantaged business affairs, Offerors are directed to Mr. Greg Thevenin of the DLA Energy Small Business office at 703-624-5495.
10. The Contracting Officer may request that the DLA Energy region Quality Assurance Representative (QAR) perform a pre-award survey (PAS) in accordance with FAR Part 9.106-1. If requested, the Offeror and its employees, including those at the fill point and/or production facility, shall be required to participate fully in the PAS process. The DLA Energy Contracting Officer will discuss any recommendation by the QAR as a result of the PAS that is other than "full award," with the Offeror during negotiations. This will allow the Offeror an opportunity to respond or otherwise provide information in its final proposal revision as to how the Offeror intends to correct the issue(s) and/or QAR concern(s) that led to an other than "full award" recommendation.
11. The solicitation provisions shown throughout this solicitation are identified by their FAR, DFARS or DLAD numbers, title and date. Some provisions are incorporated in full text and some are incorporated by reference in accordance with FAR 52.252-1, Solicitation Provisions Incorporated by Reference. At time of contract(s) award(s), provisions become clauses and solicitation Sections K, L and M will be retained in the pre award file. Any resultant contract(s) will contain clauses that will be identified by their FAR, DFARS, and DLAD numbers, title, and date. Some clauses are incorporated in full text and some are incorporated by Reference in accordance with FAR 52.252-2, Clauses Incorporated by Reference. The provisions contained in the attachment DLA Energy Aerospace Provisions are identified with alpha and numeric characters such as B-0001 B1.09-2 Supplies to be Furnished (Indefinite Quantity)(Aerospace Energy)(DLA Energy Jan 2012) or G-0002 252.232-7006 Wide Area Workflow Payment Instructions (May 2013).
