IMPORTANT NOTICE TO OFFERS:

1. The Government plans to award one or more two-year Fixed-Price with Economic Price Adjustment Contract(s) as explained in note 5 below. The Period of Performance is 1 April 2015 to 31 March 2017 and is for Pressurizing Agent, Helium Type 1, IAW MIL-PRF-274047D dated 1 August 2014, delivered f.o.b origin into Government-furnished and Customer-furnished High Pressure Cylinder Assemblies (HPCA). This requirement is for BLM and Non-BLM locations as listed on the Attachment entitled –Estimated Quantity by Location.

2. All offerors shall comply with the requirements listed in Instructions L-0003 L2.35 PROPOSALS FORMAT AND CONTENT (AEROSPACE ENERGY)(DLA ENERGY AUG 2009) and all offerors will be evaluated in accordance with Instructions in M-0001 M2.14 EVALUATIONS – COMMERCIAL ITEMS (AEROSPACE ENERGY)(DLA ENERGY AUG 2009). As a result, a single contract is intended to be awarded for product and accompanying services.

3. System for Award Management (SAM) is required and is available at www.sam.gov.

4. Questions regarding Small Business or Small Disadvantage Business affairs should be addressed to Mr. Greg Thevenin of the DLA Energy Small Business Office at 1-800-526-2601 or 703-767-9465.

5. The resultant contract will contain an Economic Price Adjustment (EPA) clause. For BLM requirements, the EPA escalator is mandated by the BLM pursuant to the Helium Privatization Act. All BLM Gaseous Helium product CLINs (0001 and 0002) will be adjusted using the BLM index (In-Kind rate). For non-BLM CLINs (0003 and 0004), the BLM “Conservation Helium” rate will be utilized. The EPA mechanism will not be applicable to any CLINS for services.

Except for the annual BLM adjustments, the awarded prices for product will remain firm for the length of the contract, two years. Any recovery costs associated with moving crude helium to the refining plant and moving the refined helium to the transfill locations for filling or any other production costs must be included in the unit price.

All prices proposed for the BLM product CLINs (0001 and 0002) shall begin with the BLM FY2014 (Oct 2014 – Sep 2015) Crude Helium Price of $76.00 (in kind) and the Non-BLM product CLINS (0003 and 0004) shall begin with Crude Helium Price of $95.00 (Conversation Helium, Jan 2104 – May 2014). Both are considered to be the base reference prices for this procurement. When constructing the yearly pricing proposal, offerors should begin with the base reference prices and add to it any other variable and fixed costs, including profit.

6. Helium purchases under product CLINs 0001 through 0002 of this solicitation are subject to the Helium Act and as such, FAR Clause 52.208-8 REQUIRED SOURCES FOR HELIUM AND HELIUM USAGE DATA (APR 2002) applies. Only Federal helium suppliers as designated by the Bureau of Land Management (BLM) will be eligible for a contract award for CLINs 0001-0002. See Federal Acquisition Regulation (FAR) Part 8.5.

7. The address for overnight delivery or proposals resulting from this solicitation is as follows: Defense Logistics Agency – Energy DLA Energy – MK, Attn: Janell Davila 1014 Billy Mitchell Blvd. San Antonio, TX 78226-1859
