A. Amendment 0001 provides answers to industry questions that have been received to date. It corrects the nomenclature of CLINs 0020 and 0040, then adds two new CLINs.
Question 1)
The RFP states on page 3, paragraph 4, “Except for the annual BLM adjustment, the awarded prices for product will remain firm for the length of the contract – two years.” However, the Schedule of Supplies/Services indicates that offerors may bid a price for year 1 and another price for year 2, for each Transfill Location.
Answer 1)
That portion of the cost of the Product CLINs for the Helium product itself will be coverd by the EPA adjustment. The Government assumes that there are "other costs" besides the actual Helium product escalated by the EPA. As such, offerors are allowed to bid differing prices for each year based on anticipated increases in cost other than helium.
Question 2)
Can offerors bid less than the estimated “Not-to-exceed” volume in a particular section?
Answer 2)
Yes, due to the current conditions in the Helium marketplace, the Government is willing to consider offers of any quantity a contractor is able to provide even if it is less than the total for that year. If contractors do choose to offer less than the maximum yearly quantity, they should provide the total amount proposed for that year as well as a maximum per month estimate of the amount of product they can provide monthly. The Government will continue award to the most advantageous offerors until the maximum yearly quantity is met.
Question 3)
If an offeror bids the “Not-to-exceed” volume and actual volume subsequently exceeds that estimated volume, is the offeror contractually required to fulfill that volume? If not, how will DLA procure helium for that requirement if only four contracts are awarded?
Answer 3)
The request for proposal will result in the award of one or more Indefinite Delivery/Indefinite Quantity type contracts. Since the maximum amounts are stated in the contract, a contractor would not be legally bound to fill quantities above those stated by-month maximums. DLA will have to "manage" orders to fit within the monthly estimates.
Question 4)
DLA Energy included CLINs on the current contracts for marking and labeling; evacuating, purging and charging; and valve replacement. Will DLA accept pricing for each of these 3 requirements?
Answer 4)
As stated in the Statement of Objectives (SOO) paragraph 5.2 evacuating, purging and charging, as well as marking and labeling will be considered as part of the product price in accordance with industry standards.
The specific guidance regarding the performance of these specific tasks can be found in the paragraphs 5.2.1 and 5.2.2.
Valve replacement is covered by CLINs 0020 and 0040; however, the nomenclature of the CLIN appears to be incorrect. CLINs 0020 and 0040 should read as shown in letter paragraph B, below. In addition, it appears that there are no CLINs for Standard Valve Replacement. See below for the corrections and the addition of the
Standard Valve Replacement CLINs.
B. As a result of Answer 4 in A above, the nomenclature of CLINs 0020 and 0040 is hereby corrected to read as follows:
