Attachment 1 (Questions and Answers)

1. If we have already started the process of registering in JCCS, and are awaiting approval, will we still be eligible for contract award?

Answer: No. All interested Offerors shall conform to the required submission in accordance to page 4 of 87 and Offeror must be approved before a contract may be potential issued. Approval is dependent on the information provided. To confirm the Offeror’s status it is highly encouraged that they coordinate with the JCCS (the listed email and or phone number provided when registering) about their submission status. Please note that having a JCCS number DOES NOT mean the Offeror is qualified; that number is provided as a point of reference. Offeror’s who are not approved, prior to award, shall not be considered for award and will be deemed not responsible.

2. In regards to the mentioned solicitation for Direct Fuel supply to US Embassy in Kabul, Are UK based companies requires to have a JCCS registration to be eligible for award?

Answer: Yes. All Offerors shall register regardless of country of origin.

3. Per pg 47 of the solicitation, Afghanistan is not listed as a Qualifying Country. Based on this information, can an Afghanistan Country bid on this requirement?

Answer: Yes. No business is restricted from submitting an offer due to their country of origin.

“Qualifying Country”, as it is referenced under DFARS 252.225-7021, is specific, ONLY to, the product being provided and that products origin.

4. Do the Turkish companies need to be registered in JCCS and have Installation Access eligibility to be eligible for Contract Award?

Answer: Please reference number 2 above

5. Are there any restrictions on the supply sources (countries)?

Answer: It is the Offeror’s responsibility to understand DFARS 252.225-7021 and address FAR 52.212-3 accordingly. The US U.S. Government will evaluate offers in accordance to DFARS 252.225-7021 and FAR 52.212-3 and if the Offeror has addressed an unqualified country and/or designated country they may not be considered for award.

6. Can the prime contractor utilize a partnering company´s past performance references for this tender?

Answer: No. Prime contractors/Offerors carry the burden of representing their contract/company as its own entity and should not depend on the actions of a potential partner/sub-contractor to define the Offerors capability. Offer can incorporate a potential partner/sub-contractor capabilities as part of how the Offeror intends to meet the requirements of the solicitation.

7. Are there restricted sources for this tender?

Answer: Please reference number 5

8. Are the volumes stated are for the base period only?

Answer: The volumes are an estimated quantity based on the period of performance listed on page 11 of the solicitation.

9. Are there cloud and pour point restrictions on the diesel for winter and summer?

Answer: Product delivered shall conform to, in this case diesel, clause C16.18-2. Offeror can submit an exception for alternate testing with their proposal.

10. Is Octane level of 92 is acceptable on this contract?

Answer: Product delivered shall conform to, in this case Gasoline Automotive, Unleaded, Regular, clause C16.69.1. Offeror can submit an exception for alternate testing with their proposal.

11. If the PPQ is not returned by the previous contracting office of a prime contractor to DLA E, it is out of the control of the contractor who submitted the PPQ. For example the contractor submits the PPQ to a previous contract office of a prime contractor for works completed in the past and that prime contractor is now bidding this same tender. The prime contractor will usually not respond to the contractor´s PPQ request and this creates an unfair advantage of blocking the PPQ submission.

Therefore, is it acceptable to submit the PPQ (unsigned) within our past performance volume to DLA E of this proposal so that DLA E can verify the past performance completed? Or maybe if we submit a copy of the contract to prove the past performance.

Answer: All Offerors shall be evaluated against FAR 52.212-2. Concerning this question, please see the “Note” under the Performance evaluation.

12. Are there any page limit restrictions on this proposal?

Answer: There is no page restriction. However, under FAR 52.212-1, it is the Offerors responsibility to confirm that an offer has been received by the US U.S. Government. As a suggestion, as there maybe file size restrictions through electronic means, that the offer is broken up and email subject line reflecting, for example, “Email Offer 1 of 4” and so on.

It is also encouraged to ensure that the offer is relevant to the solicitation, which on occasion, will significantly reduce file sizes.

13. Can we bid with just two delivery orders as past performance?

Answer: Please see number 11

14. Are there are any restrictions on the source country for the supply of these products

Answer: Please reference number 5

Answer: Please refer to F1.01-1 DELIVERY CONDITIONS FOR TRANSPORT TRUCKS, TRUCKS AND TRAILERS, AND TANK WAGONS (DLA ENERGY JAN 2012) of the solicitation and F3 TRANSPORT TRUCK AND/OR TRUCK AND TRAILER FREE TIME AND DETENTION RATES (PC&S) (DLA ENERGY AUG 2005) incorporated per Amendment 0001.

25. INCO terms FOB Origin/FOB destination are clearly understood, Please post your valuable comments on FOB TT in the Schedule (Part-1) for the delivery locations

Answer: FOB Destination and FOB TT (Tank Truck) is the same thing.

26. Most of the Successful Offeror's firms to commence the contract will get the supply sources from the countries in accordance with GPA (Global Procurement Rules) However at the Contract closeout, they deviate and build a supply pipeline bringing Fuel from Iran at Hairatan- It is a nightmare and herculean for the U.S Contractors like [Company name redacted] to match the prices and compete with these unqualified Contractors- We would like to bring this up to your attentive notice to counteract a procedure to eliminate such restrictive operations.

Answer: Question Unclear

27. Could a contractor use other than PlattsOilgram, publication as a reference price indicator for price adjustment? If Yes? What is the criteria for other acceptable publications? From which countries?
