A. This amendment is issued for the following reasons:

1. FAR 52.212-2 – EVALUATION -- COMMERCIAL ITEMS (Oct 2014) under subject solicitation is hereby revised in its entirety as follows

The Government will evaluate the offeror’s past performance. This may include any aspect of past performance related to the solicitation, including the following:

a. SCHEDULE. Assessment of the offeror’s ability to meet delivery schedules, to respond to administrative issues in a timely manner, and to complete a contract.

b. Offerors shall be afforded an opportunity to address unfavorable reports of past performance, and the offeror’s response, or lack thereof, will be taken into consideration. Recent contracts may be examined to ensure that corrective actions measures have been put in place to prevent the recurrence of past performance problems. Prompt actions taken to correct performance problems may be considered a reflection of management concern for customer satisfaction; however, such action may not mitigate all negative performance trends.

Additionally, a record of satisfactory or exceptional past performance will not result in favorable assessment of an otherwise unacceptable proposal. Offerors lacking relevant past performance history for which past performance information is not available will not be evaluated favorably or unfavorably past performance.

c. The Government reserves the right to consider any information available to it in evaluating an offeror’s past performance. This includes information obtained from the offeror’s references, past and presents customers, subcontractors, and any other that may have useful information. Useful information may include reports from the Past Performance Information Retrieval System. However, the government reserves the right to not contact all of the references listed by the offeror.

d. QUALITY OF PRODUCT AND SERVICE. Assessment of the offeror’s ability to conform to contract requirements and specifications.

e. EQUIPMENT. The equipment factor evaluates whether the contractor has the necessary equipment which is required to deliver such as special hoses, nozzles, required type of trucks, safety equipment, communications equipment, etc.

2. To assist in determining Past Performance and Technical Acceptability, please provide the following information:

a. Past Performance Information: at least three references (company, contract number, type of product, duration of service, etc.), past and present customers, subcontractors and any other useful past performance information. This information is to reflect any support provided within the past three years.

b. Please explicitly confirm that your offers will conform to the requirements and product specifications as stipulated under the terms and conditions of the subject solicitation. Please also explicitly confirm the offered products will conform to DLA Energy contract texts C16.69-1 and C16.69-2.

c. Provide a list of equipment which is required to deliver product under this requirement such as special hoses, nozzles, number and type of trucks available, safety equipment, etc.

d. Supply the attached revised price offer sheet to include location, quantity and mode of transport as part of your best and final offer to assist in determining Technical Acceptability.

B. All other terms and conditions of the solicitation remain unchanged.
