This amendment is hereby issued to answer offerors questions, provide an updated PWS, extend the closing date for receipt of offerors and replace local clause B-0001-B34.01 -- SERVICES TO BE FURNISHED AND PRICES (DLA ENERGY FEB 1991) in its entirety.

1. The closing date for receipt of offers is hereby extended from August 10, 2015 to August 26, 2015 at 9:00 AM Local Time, Fort Belvoir, VA.

2. INCORPORATING QUESTIONS AND ANSWERS:

a. Korean employees must enroll in mandatory social benefits such as medical insurance, public pension, unemployment insurance and workmen’s compensation insurance and employer and employee share contribution (premium) payment together in ROK. Foreign-based contractor without business registration in Korea is not able to enroll Korean employees in such benefits and employee’s earned income is not reported to Korean Tax Service (equivalent of U.S. IRS) and results in non- compliance with Korean laws and regulations. There are reports that current Korean employees supporting Army GOCO contract are not enrolled in such Korean mandatory social benefit programs. If true, incumbent is in better position of pricing because they don’t make employer contributions while Korean companies are obligated to make contribution at company’s expense. This shall give cost advantage to such company and Korean employees could be punished for having avoided income tax payment to Korean government. Does non-Korean offeror/contractor require business registration to perform contract in Korea?

Answer: Offerors are required to comply with all requirements listed in the Solicitation, including those listed in Appendix N, Applicable Directives. Offerors should consult with their business counsel for additional information on compliance with the Solicitation requirements and all Applicable Directives.

b. IAW Appendix K for Holiday Schedule, Koreans observe three (3) days for Sollal (Lunar New Year Days) and Chusok (Harvest Moon Festival) each. Can one (1) day be extended to three (3) days each to follow Korean practicality in place?

Answer: Contractor will comply with USFK Korean civilian employee holiday schedule located in Appendix K of the PWS.

c. IAW “Proposal Package” of Addendum To FAR 52.212-01 – Instructions To Offerors – Commercial Items

OSP Submission Requirement – An original and one copy Technical Proposal Submission Requirement – An original and three (3) copies Does this submission requirement apply to electronic proposal submission by email too or only to hard copies?

Answer: This submission requirement applies to hard copies only.

d. For the purpose of required manning, what will the workload for the new bulk storage facility and new gas station be? What type of maintenance and other services will be required to be performed by contractor? We know that manning will have to be increased, but we cannot determine that increase, until we know the extent of the requirements for the new facilities at Camp Humphreys.

Answer: Please reference C-3.1.1 Bulk Fuel Operations, and C-3.1.2 Ground Fuel Operations in the revised PWS dated: August 04, 2015. Additional information has been provided to support these requirements.

e. Can the past performance requirement be changed to read “The offeror shall have three (3) contracts relevant defense logistics to USFL and on year similar fuel service experience for USFK to the solicitation.”

Answer: Past performance requirement will remained unchanged; offerors will not be penalized for not having a record of relevant past performance as referenced in Addendum to FAR 52.212-02 – Evaluation – Commercial items (OCT 2014).

f. IAW the PWS, section C-5.1 requires three (3) Terminal Managers at Camp Casey, K-16 and permanently Camp Humphreys. Currently there are 2 TMs. Will 3 TMs be mandated under the solicitation?

Answer: The PWS has been revised to reflect the following requirements: C-5.1 Manning Facilities Operations.

At a minimum, the contractor will provide One (1) Terminal Manager (TM). The TM shall be located permanently at Camp Humphreys (Area 3). The TM will be responsible for supervising the following sites on Camp Humphreys:

New Bulk Storage Fuel Terminal, two (2) Automated Bulk/Retail Fuel Service Stations and one (1) Flight Line/Hot Refuel Point Facility. At a minimum, the Contractor will appoint two (2) Assistant Terminal Managers (ATM) to support activities in the following areas: One (1) ATM shall be positioned in (Areas 1 or 2) to provide area support in both locations and the other shall be positioned in (Area 4).

g. IAW the PWS, section C-5.1 also requires to appoint minimum two (2) Assistant Terminal Managers (ATM) at North and South of Yongsan respectively. There is only one gas station at USAG Yongsan. Will there be a mandate for additional station requiring one more ATM?

Answer: See item f. related to the PWS Revision

h. IAW the PWS, section C-5.1.1.1 Hours of Operation, will retail sites of Camp Red Cloud and Camp Walker performing retail services NOT require any operator(s) at all?

Answer: This is an unmanned Automated Facility (24/7). However, it’s the contractor’s decision as to where they position their operators.

i. Can the Original Offeror Submission Package and Technical/Management Proposals be submitted in the same binder as long as they are clearly labelled and delineated by tabs?

Answer: Yes

j. Section L – Instruction, Conditions and Notices to Offerors and the OSP Instructions differ in that Section L states one original copy of the Offeror Submission Package and an original and three copies of the Technical/Management proposal must be submitted. The OSP Instructions state that the “original” and three (3) “copies” of the proposal and the “original” and one (1) “copy” of this Offeror Submission Package must be returned. Please clarify the submission requirements!

Answer: One (1) “original” and a “copy” of the Offeror Submission Package and one (1) “original” and three

(3) “copies” of the Technical/Management proposal.

k. Is there a specific need to have a TM at K-16 as there are only limited hours of operations for cash sales at the retail station? Is it possible to have a TM from another location cover this site?

Answer: See item f. related to the PWS Revision.

l. Since CLIN 004 was removed from the PWS, how is after hour support reimbursed?

Answer: All costs for fulfilling contract requirements will be covered under CLIN 0001 to include after hour support.

m. What are the correct operating hours for Camp Carroll? Operating hours for Camp Carroll in Appendix B and C do not match; Appendix B states operating hours are 0730 – 1630 and Appendix C states operating hours are 0730 – 1600.

Answer: The PWS has been revised to reflect the following change: 0730-1630.

PAGE 3 OF 7 PAGESCONTINUATION SHEET REFERENCE NO. OF DOCUMENT BEING CONTINUED:

n. Since the requirement for recurring maintenance is now the responsibility of the Government, is there still a need to have FDSMs on this contract?

Answer: Yes, because of the complexity and span of these sites, mechanics will be required to facility immediate response.

o. Do the requirements for wartime utilization of contract vehicles apply to this contract? The Government’s information and requirements seem not to apply to this procurement.

Answer: Yes, please refer to PWS paragraph C5.1.1.7 titled Wartime Utilization of Contract Vehicles

(CONTINGENCY CONTRACT) (REPUBLIC OF KOREA)

p. Table of Contents Section, C-3.1.1 references facility closure; however; if you go to the paragraph, the actual title is “Bulk Fuel Operations.” Please clarify!

Answer: The PWS will be revised to reflect the following change

C-3.1.1 Bulk Fuel Operations C-3.1.2 Ground Fuel Operations C-3-1.3 Aviation Fuel Operations

q. Reference: PWS paragraph C-5.6.1.3 – “The Contractor's designated Terminal Manager shall serve as the Facility Spill Coordinator (FSC) and shall act as the On Scene Commander (OSC) during oil spill emergencies until or unless relieved by the Facility Incident Commander. The Contractor shall train the terminal manager in order to qualify him as the FSC and the OSC. The training requirements may be set aside providing that the terminal manager attended an approved course within three years prior to the contract start and can provide proof thereof (i.e., certification of completion). The training shall be accomplished within the first 30 days of the contract period.”

Question: We cannot find a specific “Facility Spill Coordinator” Training. Does the “On Scene Commander” Training suffice, as the content of the training is very heavy on Facility Spill Coordination? Can the Government please clarify?

Answer: Yes, with a combination of FEMA On-Scene Coordinator training and the DLA Energy Spill Response Training suffices for the requirement to have training for FSC and OSC.

r. C.5.1 (a,b) Manning Facilities Operations states that resumes will be required for the Terminal Manager and Assistant Terminal Manager. In the past DLA has lifted this requirement. Does DLA intend to lift the requirement for this solicitation?

Answer: Yes, however, the PWS will be revised to reflect the following statement: After Award, a copy of the candidate’s resume for this position must be submitted within 30-days for review by DLA Energy.

s. Appendix K: Holidays- Chusok is typically a very important Korean holiday that is celebrated over a three day period. Does DLA intend to make any changes to the holiday schedule?

Answer: No, Appendix K will remain unchanged.

t. C-5.1.1.2 Cash Sales - The link listed in the PWS to acquire DLA Energy Policy P-19 Retail Cash Sales Standard does not work.

Answer: An updated copy is attached.

u. Camp K-16 and Camp Red Cloud both have top loading headers. Are these Top loaders still in use and expected to remain operational?

PAGE 4 OF 7 PAGESCONTINUATION SHEET REFERENCE NO. OF DOCUMENT BEING CONTINUED:

Answer: Yes; top loading is still used in certain situations at Camp Casey and K-19. However, there is no top loading conducted at Camp Red Cloud; the facility only has a service station.

v. Are all Camps equipped with ATG and who is responsible for maintenance?

Answer: Yes, all camps are equipped with ATG; the Reoccurring Maintenance/ SPAWARS contractor will be responsible for ATG maintenance.

3. Local Clause B-0001-B34.01 -- SERVICES TO BE FURNISHED AND PRICES (DLA ENERGY FEB 1991) provided below is being replaced in its entirety. A new retail facility (Automated Fuels Service Station) is currently under construction, as outlined in section C-2.1 of the PWS and has a tentative completion date of May 01, 2016. Upon completion of the facility, the offered price for the Retail location will be incorporated into the monthly use charge for CLIN 0001. This detailed breakout is required to account for any possible overlap in the commission of the new service station and decommission of the current service station.
