SECTION C-1.0 INTRODUCTION
C-1.1 General DLA Energy Description of Services: Under this solicitation, the Defense Logistics Agency –Energy (DLA Energy) is procuring receipt, storage and issue services for bulk and retail Turbine Fuel, Aviation, JP8 (MIL-DTL-83133F); Retail Gasoline, Automotive (EN 228); Retail Diesel (EN 590) or any additional product designated by the Contracting Officer (CO). This includes services for the operation, maintenance, security, safety, environmental protection of Government aviation and ground fuel facilities at Army installations in Europe.
C-1.2 Contractor Manpower Reporting: The contractor shall report all contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Defense Logistics Agency via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecrnra.rnil
Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2015. SECTION C-2.0 BACKGROUND
C-2.1 General: Within the United States Army Europe (USAREUR) Area of Operations (AOR) capitalized fuel operations exist at a combination of facility sites that can be categorized accordingly; 1) retail service stations, 2) bulk fuel storage sites, and 3) airfields operating mobile and/or hot refueling operations. Each of the US Army Garrisons (USAGs) is roughly comparable to a CONUS Army installation in terms of enterprise management control of petroleum functions. The USAGs are categorized as either “direct reporting” or “reporting” garrisons for installation management purposes.
SECTION C-3.0 SCOPE
C-3.1 General scope of work: The capitalized U. S. Army Europe fuel facilities in Germany listed in (Appendix E) are being outsourced to Government-Owned/Contractor-Operated (GOCO) facilities. The Contractor will be responsible for operating and performing the operator/organizational maintenance on the facilities to ensure safe and accurate receipt, storage, transfer, issue, quality control, and accounting for Defense Working Capital Fund (DWCF) - owned petroleum products under their control. In addition, the Contractor will ensure all personnel are adequately trained to secure government furnished equipment and comply with environmental protection and safety directives. All Contractor personnel must be able to speak, read, and write in English. All contractor personnel must possess language proficiency Level-II IAW AEP 690-70.
C-3.2 Ground Fuel Operations: The Contractor will perform all fuel operations, inventory management, quality surveillance, organizational level maintenance, training, safety and environmental protection functions at the ground fuel sites listed in Appendix E. The service stations will provide fuel support to authorized reimbursable Defense Working Capital Fund (DWCF) customers that have http://www.ecrnra.rnil/ http://www.ecrnra.mil/ approved DLA –Energy purchase devices or have an assigned DODAAC, FEDAAC or "2A"
DODAAC.
C-3.3 Bulk Fuel Operations: The Contractor will perform all fuel operations, inventory management, quality surveillance, organizational level maintenance, training, safety, and environmental protection functions at bulk storage sites listed in Appendix E.
C-3.4 Aviation Fuel Operations:
1. Contractor shall support Clay Kaserne (AAF) home station and transient aircraft with refueling and defueling operations. The Contractor shall post a list of contact numbers for emergencies and after hour's bulk top-offs. Contractor will issue fuel to US Aircraft using the aircrafts AIR Card. Non-US aircraft will be issued fuel using the organizations 2A-DoDAAC. Upon notification of the Contractor Officer Representative (COR), non-US organizations that do not have a 2A-DoDAAC can be issued fuel IAW DLA Energy Interim Policy P-6.
The Contractor will provide sufficient numbers of mobile aircraft refueler/defuelers to support each AAF/AHP listed in Appendix D.
a. Vehicles must be serviceable and of such a condition as to be expected to perform successfully for the life of the contract, additionally vehicles will be in serviceable condition and capable of meeting host country and US operating procedures.
b. The contractor will be responsible for all Contractor Furnished Equipment (CFE) vehicle maintenance for the life of the contract.
The Contractor shall provide/maintain three portable handheld two-way radios for refueling personnel on each airfield. The contractor is required to have radio communication between themselves and the Air traffic Control Tower at all times during operational hours. If the tower is not available at the time of operations then the contractor will establish communications with Base Operations. Radios will be in compliance and conform to the following guidelines and regulations:
a. Meet guidelines IAW Manual of Regulations & Procedures for Federal Radio Frequency
Management.
b. Must adhere to paragraph 7.5.8 of the Federal Government use of the Family Radio System
(FRS).
c. Meet Host Nation EMC Directive 2004/108/EC.
d. Radio frequency must support and be approved for use in Germany under the Host Nation Spectrum Worldwide Database (HNSWD).
e. Radios must be a “rugged” version to ensure radio will operate under adverse conditions.
f. Radios must interface with the airfield/heliport operations administrative frequency.
g. USAREUR G6 and Air Field Managers provide the information on the specific make and model of radios in use.
2. The contractor shall comply with the most current version of the USAREUR Aviation Safety and Standardization Detachment (UASSD) checklist for Aircraft refueling provided by the COR. In addition, the checklist will be used by UASSD members to conduct annual formal inspections of contractor airfield operations. Results of the inspection will be furnished to the COR and the contractor.
Contractor will provide USAREUR Airfield managers and UASSD member’s unlimited access to airfields during operational hours. The names of UASSD members and airfield managers will be provided to the COR upon contract award. If temporary closure of an airfield is mandated by either a USAREUR Airfield Manager/UASSD member for an identified safety condition/violation that risk lives/equipment, contractor will cease operations until compliance is met and immediately notify the COR of the situation. The implementation of the UASSD is mandated IAW AR 95-1 and AE 95-1 to plan, coordinate, monitor, and implement the Army Aviation Standardization Program for the European Theater.
3. The contractor shall comply with aircraft refueling procedures and requirements outlined in this document and applicable references listed in Appendix C. The contractor shall ensure that the operational portion of their Airfield Operations Plan details instructions to complete aircraft fuel servicing. This includes the contractor completing all necessary (grounding, bonding, fueling equipment, nozzle, etc.) connections for aircraft servicing. The only exception for the fueling equipment nozzle connection is when an authorized/trained crew member/customer requests only that the crew member make the nozzle connection. If there is a discrepancy between any references listed in Appendix C, the most stringent standard will apply and any noted discrepancies will be brought to the attention of the COR and/or the CO immediately for resolution.
4. Truck refueling shall have the capabilities to meet a 20 minute response time in support of all aircraft outlined in Appendix D. Refueling vehicles shall be capable of both over-wing and under-wing refueling. Refueling and defueling shall not be conducted with the same vehicle as the contractor must have a dedicated defueling capability. Contractor will conduct Aqua-Glo testing daily as part of pre-operational checks for refuelers used in the execution of along-side aircraft refueling. Each airfield will require on average 10 non-aircraft fuel servicing sales of JP8 (50-300 gallons each) monthly for supporting operations (i.e. - test engine, AGPU, etc.) that are only to be conducted on improved surfaces within the airfield boundary and within DLA Energy Policies and Procedures.
(5) The contractor's proposal and follow-on aviation refueling plan shall address which publication within Appendix C is to be followed for aircraft refueling procedures. For example, when detailing number of personnel required for cold aircraft refueling, FM 10-67-1 details that two personnel are required for each refuel operation; one to tend the pump and one to tend the nozzle. However, NFPA 407 only requires one person (contractor) to be present from a tank vehicle when an operational dead man control is in use. Regardless of publication chosen, contractor will apply grounding procedures as stated in FM 10-67-1 for parking of all tank vehicles and for all aviation refueling operations. Refueling operations are not permitted without an aircrew member who is familiar with refueling procedures for the aircraft being serviced present.
C-3.5 Contract Turnover The Contractor will receive, during the thirty days prior to the start of contract performance, assistance from current military/government personnel, representatives from DLA ENERGY and the COR to accomplish a joint facilities turnover inspection, product testing and inventory. During the last ten working days of this contract, the incoming government/Contractor personnel shall be permitted access to the bulk storage facility to observe its operation. The outgoing operators shall assist DLA Energy, the COR, and the incoming contractor to accomplish the facility turnover inspection, product testing, and inventory accounting as well as provide all relevant information concerning the facility and its operation including maintenance records and engineering documentation.
SECTION C-4.0 APPLICABLE DIRECTIVES
C-4.1 General: The contractor shall comply with all current applicable Environmental Governing Standards, pertinent Department of Army and Department of Defense directives, policies, and procedures, as well as applicable federal statutes, judicial interpretations, international agreements, (e.g.
Status of Forces) and policies applicable to U.S. Armed Forces or U.S. Citizens including, but not limited to, the directives listed in Appendix C as applicable to the facilities and operations in the performance of the contract effort. In the event of conflicting guidance, the most stringent requirements shall be followed.
SECTION C-5.0 PERFORMANCE REQUIREMENTS
C-5.1 Fuel Operations: The Contractor shall operate and perform maintenance on the existing capitalized U. S. Army facilities in Germany listed in (Appendix E) to support normal base operations, deployments, exercises, and contingencies as well as during periods of heightened security. Contractor performance will be evaluated and payment based on the standards identified in Appendix G Fuel operations and maintenance at the fuel facilities must be safely and efficiently conducted to requisition, receive, store, and issue petroleum products with appropriate controls to ensure adequate fuel quality and inventory accuracy.
C-5.1.1 Hours of Operation: See Appendix E for base specific requirements. The Contractor shall conduct fuel operations during the stated hours of operation at the fuel facilities. If directed by the COR to conduct operations outside normal hours, Contractor shall respond and provide required support within 2 hours’ notice.
It is the contractor's responsibility to ensure that customers continue to receive uninterrupted service/support during all U.S., German National, and Religious Holidays. At no time during the performance of this contract will there be a lapse in customer service.
The contractor will provide the COR with a listing of individuals on call, contact information (telephone numbers) and base locations of employees identified to work the holiday schedule no later than 1700 hours on the day prior to a holiday. If support is required during any holiday period, it should be communicated to the contractor 24 hours in advance in order to ensure that adequate coverage can be scheduled.
C-5.1.2 Product Receipt: The Contractor shall receive fuel without causing operational delays or incurring demurrage. The contractor will be required to escort fuel tankers while on the installation. The contractor is responsible for self-induced demurrage charges. The Contractor shall immediately notify the COR/designated office of any fuel quantity or quality discrepancy. The COR will notify DLA Energy Europe and Africa Customer Support Branch. The Contractor shall not offload off specification fuel or customer returned fuel unless a waiver/approval has been granted by DLA ENERGY-Q (Quality/Tech Support Office). The Contractor shall prepare all documents required for product receipt.
C-5.1.3 Product Storage: The Contractor shall be responsible for product quantity and quality while in Contractor custody as specified in Clause E1.11 QUALITY CONTROL PLAN (DLA ENERGY MAR 2000). Product will be maintained to preclude degradation, contamination, commingling, or other occurrences which render the product unsuitable for its intended use. The Contractor shall immediately notify the COR/designated office of any issues which impact the integrity, quantity, or availability of fuel in storage.
C-5.1.4 Product Issues: The Contractor shall issue and transfer fuel IAW hours of operation. The Contractor shall issue fuel without causing operational delays. When product does not meet specification limits, the Contractor shall request disposition instructions from DLA ENERGY-Q via the COR/CO as required by DOD 4140.25M and MIL-STD-3004 latest version. The request for disposition instructions shall contain the minimum reporting requirements mandated by MIL-STD-3004 latest version. This will be accomplished through the COR. The Contractor shall prepare all documents required for product issue. In case of automated fuel service station failure, manual fuel issues may be required on an emergency basis.
C-5.2 Inventory Management: The management of fuel inventories involves a full range of actions associated with ordering/requisitioning, receipt, storage, transfer, issue, physical inventory, and use of Business System Management - Energy (FMD 8.0). The contractor shall provide a Terminal Manager (TM) and a Base Level Support Application (BLSA) operator (accountant) at the following locations;
Baumholder and Wiesbaden. Terminal Managers identified by terms of the contract are contractually obligated to account diligently for and safeguard government property including DWCF energy stocks and government furnished equipment/facilities at contractor operated DFSPs. Terminal Managers are additionally responsible to comply with contract terms and DLA ENERGY published guidance.
Detailed information regarding TM and BLSA roles and responsibilities may be reviewed at DoD 4140.1, DoD Supply Chain Material Management Regulation and DoD Instruction 4161.02, Accountability and Management of Government Contract Property. Terminal Managers shall ensure daily, accurate recording and processing of all DWCF energy inventory transactions including receipts, shipments, sales/credits, and physical inventories into the Business Systems Modernization – Energy (FMD 8.0) in compliance with DoD 4140.25-M, pertinent DLA Energy Interim Policy and Procedural Instructions, and BLSA guidance.
C-5.2.1 Physical Inventory Management: The Contractor shall follow the physical inventory management procedures specified in applicable directives and contract clauses. Contractor personnel that need access to DoD Information Systems to conduct inventory management duties must meet DoD/USAREUR requirements to receive a CAC Card. Contractor will immediately contact the COR upon contract award to apply for CAC access. A successful background check of each contractor requiring computer access must be completed to receive a CAC Card. Additional physical inventory management duties include:
• Ensure that all orders, receipts, transfers, issues, losses, gains and adjustments are properly documented.
• Ensure that adequate stocks are on-hand to fully support mission requirements at all facilities and maintain the required inventory levels.
• Maintain auditable document control files and data files for accountable records on all fuel products for the period specified in the contract.
• Maintain control over the physical environment to ensure proper product storage can take place with minimal losses.
• Ensure inventory variations are within allowable limits. Document, investigate, report, and take corrective action if necessary on excessive variations.
C-5.2.2 FMD 8.0 Computer Software and Hardware: The Government will provide the appropriate hardware and software for FMD 8.0 at the fuel facilities. The exact number of computers will be coordinated out at the time of contract award.
C-5.2.3 FMD 8.0 Automated Dispensing System Key/Card Management: The Contractor shall be authorized to send/receive Vehicle Identification Link Keys (VIL Keys) through Official Government Mail during the performance period of this contract and adhere to the following guidelines;
1. The contractor shall process and distribute Vehicle Identification Link Keys (VIL Keys) IAW with USAREUR TASKORD 11-0375, Interim Policy Guidance for VIL Fuel Key Processing or until the Army in Europe (AE Regulation) 710-2 has been revised. VIL Key request must be routed through USAREUR G4 for coordination and approval.
2. The Contractor shall maintain databases as necessary to provide all reports required by the contract, including but not limited to, customer account numbers, responsible office for key holders, key/card serial numbers, and other key data. On a quarterly basis, the Contractor shall provide the VIL database to DLA Energy to allow the database to be appended with the IFMS VIL database. Upon return of the updated VIL database from DLA Energy, the contractor shall load and push the updated lockout list to all appropriate FMUs within two (2) business days.
3. VIL Keys will be provided to the contractor by DLA Energy.
C-5.3 Quality Control: The Contractor shall establish a written Fuel Product Quality Control Plan (QCP) specific to each location and facility, to ensure all products handled by the Contractor remain on-specification. The Contractors written QCP plan shall ensure product quality in accordance with the most current version of MIL-STD-3004 and include (but not limited to) requirements for sampling, testing methods, equipment, documentation of tests, and record keeping. No petroleum product shall be received or issued until product quality determinations have confirmed conformance with specifications.
Sampling and testing of all grades of fuel will be accomplished IAW the requirements of MIL-STD- 3004 latest version. Testing will be performed at either a commercial or military laboratory approved by a Quality Assurance Representative. Table I (Fuel Samples) lists periodic receipt and bulk storage samples required by Army Policy. Additional sampling/testing may be required as determined by the
COR.

C-5.4 Facility Maintenance: The Contractor shall establish and maintain automated maintenance and supply records for all equipment and components at the fuel facilities. The Contractor shall provide a detailed maintenance plan for all facilities, equipment, and system components. The plan shall address the frequencies, methods, and procedures for accomplishing the maintenance objectives. The maintenance records and maintenance plan shall be updated as changes occur and be made available for review by the government (COR/DPW) upon request and turned over to the government (COR/DPW) at the end of the contract. The Contractor shall ensure maintenance activities are scheduled to prevent or minimize impact to operations. The Contractor shall immediately notify the COR and local USAG LRC/DPW of any maintenance downtime that could affect operational use of the system and the estimated time the system will be back in operation.
C-5.4.1 Operator/Organizational Maintenance: The Contractor will perform operator/organizational maintenance to inspect, service, and maintain all fuel distribution systems and equipment in accordance with applicable directives, Facility Operations and Maintenance Manuals, manufacturer’s specifications, and best commercial practices. The Contractor shall provide all manpower, material, tools, and equipment to perform operator/organizational maintenance during routine inspections and system use/operation. Operator/organizational maintenance would include personnel cost, housekeeping (grease valves, replace gaskets, clean/maintain equipment, tightening of bolts/nuts on equipment, general housekeeping, etc.) and related supplies.
All deficiencies that exceed the capabilities of the contractor or discovered during preventive and operator maintenance or mission operations will require the telephonic/electronic submission of a work order (DA 4283) through the local DPW help desk and the Facilities Management Control System (FMCS). The Contractor will not perform maintenance and repairs beyond operator maintenance unless directed by the COR as reimbursable work.
C-5.4.2 Recurring Maintenance (RM): RM required is the Government's responsibility in accordance with UFC3-460-03, Chapter 10, other applicable directives, and manufacturer's specifications. The Government shall coordinate RM actions with the Contractor to minimize disrupting operations. RM is funded and executed through a separate contract.
C-5.4.3 Sustainment, Restoration, and Modernization (SRM)/ Military Construction (MILCON):
SRM or MILCON required is the Government’s responsibility in accordance with DoD 4140.25M and DLA Energy Interim Policy P-12.
C-5.4.4 Building and Grounds Maintenance: The Contractor shall maintain buildings and grounds in accordance with IMCOM-Europe guidelines. The Contractor will ensure buildings are clean, free of debris, and pest free to include weeding and trimming around walkway and dispensing area within the fuel facility. The Contractor will not permit or allow fire hazards to accumulate in buildings or on grounds. The Contractor shall not perform major repairs or make any alterations to the buildings or grounds without prior approval from the COR. Contractor shall clear snow from sidewalks and fuel dispensing areas.
C-5.5 Safety: The Contractor will ensure that personnel at the fuel facilities are provided with a safe and healthy work environment. It is essential that Contractor personnel handling fuel products and related equipment at the fuel facilities are thoroughly knowledgeable of the principal hazards to be encountered and how to prevent or reduce these hazards in accordance with applicable DoD, Final Governing Standards (FGS) or host nation laws and regulations. This includes maintaining an updated and signed Explosive Protective Document for Local National workers.
The Contractor’s safety program shall include both classroom and hands-on instruction to ensure all personnel are able to recognize and handle potential hazards to avoid dangerous exposure and to develop safe working habits, practices, and skills. This includes annual training on the explosive protective document. Contractor shall comply with all safety requirements and base fire regulations at all times and shall maintain documentation showing compliance which shall be available to the government or designated representative at any time. Contractor shall provide 24 hour contact information to the base fire department dispatch center.
C-5.6 Security: The Contractor shall incorporate necessary physical security, personnel security and information system security to ensure the integrity and safety of the fuel facilities and government furnished equipment. The Contractor shall incorporate physical, personnel, and information system security measures in the Contract Compliance Plan. These security measures shall include controlled access by authorized personnel only to fuel facilities and equipment under Contractor control, security of all gates, buildings and facilities when not in use; ensure that system valves and refueling equipment are secured when not in use; and information systems security measures appropriate to the level of computer use. The Contractor shall establish liaison with appropriate base law enforcement agencies in development of security measures. Refer to clause I119.04 for requirements for access to FMD 8.0/FES.
C-5.6.1 Base Access Requirements: All Contractor personnel must meet prescribed policy and procedure requirements in accordance with Army in Europe Regulation (AER) 190-16 for access to applicable installations. This access shall be obtained within 60 days of contract award or 60 days of new personnel being hired. Contracted personnel must be able to achieve access to their respective installations up to/through Force Protection Condition (FPCON) Delta.
“Contracted personnel are considered essential personnel/ First Responder to ensure uninterrupted fuel support to the US Army Europe aviation operations during Force Protection Condition Delta in accordance with AER 190-16”.
C-5.7 Environmental Protection: The Contractor shall actively protect and enhance the quality of the environment by complying with all applicable regulatory requirements and by preventing or controlling pollution at the fuel facilities. If the Contractor receives a notice of violation from a federal or European agency, the Contractor shall immediately notify the COR and/or CO. The Contractor shall support the garrison Environmental Management System. COR shall ensure affected garrison environmental office is advised of violations and courses of action to resolve prior to execution.
Appendix –I entitled FINAL GOVERNING STANDARDS (FGS) for Germany is provided as an attachment to the solicitation. Appendix - I includes environmental documents on Spill Prevention and Response Plan (SPRP), Hazardous Waste Management System, National Pollutant Discharge Elimination System (NPDES) Permits Program, Storm Water Pollution Prevention Plan (SWPPP), and applicable Garrison/Base Red Plan. In the event there is an update to these documents prior to contract award or after award, said updates shall be provided by IMCOM-Europe Environmental Office.
Contractor will develop, maintain, and manage a facility SPRP. Contractor shall assign an Environmental Officer (EO) who is coordinating all environmental issues with the local Environmental Division. The EO shall perform the required EO online Training and attend the USAG refresher training as required.
C-5.7.1 Spill Response:
C-5.7.1 .1 In the event of a reportable fuel spill, leak, or discharge, the Contractor shall make the required notifications in accordance with the applicable Garrison SPRP.
C-5.7.1.2 In the event of a fuel spill, leak, or discharge originating from the covered GOCO facilities and/or equipment, the Contractor shall immediately initiate spill response procedures in accordance with the Spill Prevention and Response Plan (SPRP).
C-5.7.1.3 The Contractor's Terminal Manager shall serve as the Facility Spill Coordinator (FSC) and shall act as the On Scene Commander (OSC) until relieved by the Fire Department on Scene Commander. The Fire Department on Scene Commander cannot commit DLA Energy or Contractor funds for spill clean-up. The Contractor shall train the terminal manager in order to qualify him as the FSC and the OSC. The training requirements may be set aside providing that the terminal superintendent completed an approved training course within three years prior to the contract start and can provide proof thereof (i.e., certification of completion). The training shall be accomplished within the first 30 days of the contract period.
C-5.7.1.4 The Contractor’s designated Terminal Manager shall serve as the Facility Spill Coordinator (FSC) and shall be reimbursed for all reasonable, allocable, and allowable expenses incurred in containing, preventing the spread of, and, if required, cleanup of a fuel spill or hazardous materials spill, leak, or discharge which was not proximately caused by the willful misconduct or negligence of the Contractor or its employees. For this reason, the Contractor should not include the cost of liability insurance in its price charged to the Government for services provided for any of these risks that the
Government is assuming in this paragraph as a self-insured entity.
C-5.7.1.5 Subsequent fuel spill response, assessment, and remediation activities beyond the initial emergency response phase as outlined above will be facilitated by the local Garrison Environmental Office. Fuel spill response, assessment and remediation activities performed by the IMCOM-Europe Environmental Services Contractor must be coordinated with the DLA-DES-DE and/or DLA Energy- Europe Environmental Protection Specialist.
C-5.8 Training: The Contractor shall establish and maintain a training program to ensure that applicable personnel receive training in the areas defined below and in accordance with all federal, state, and local laws and regulations. Contractor shall ensure that personnel assigned to all tasks have the requisite knowledge and skills to meet minimum performance requirements and comply with all applicable laws and regulations.
The Contractor shall maintain documentation of training records with will include, but not limited to employee name, date of training, course information (synopsis), and test results, if applicable. These records will be made available to the COR upon request. This training shall include, but not limited to, OSHA Hazard Communication, Confined Space training, Hazardous Waste Operations and Emergency Response (HAZWOPER), OSHA Lock-out/Tagout, Personnel Protective Equipment, Host Nation ADR Hazardous Material Transportation , fuel operations, drivers training, and environmental compliance, IAW applicable Federal, State and local laws and regulations. Training for FMD 8.0 will be funded by DLA Energy. This includes transportation and lodging only.
Oil Handling Personnel (OHP) Training will be provided by the Government (SPCC/Storage Tank Program) in accordance with applicable Final Governing Standard (FGS), DOD, Army and EUCOM regulations and requirements. IMCOM-Europe shall provide training to Contractor to ensure all training on spill awareness must be consistent with IMCOM-Europe SPCC requirements.
The Contractor will provide familiarization training to the IMCOM-Europe Fire Department on the facilities and procedures when requested. For all airfields/heliports, USAREUR will provide airfield driver’s orientation to the contractor.
C-5.9 Contractor Furnished Items: The Contractor shall provide sufficient and adequate tools, equipment, materials, and vehicles to adequately and safely perform all operational and maintenance tasks required by the contract. The Contractor shall insure compatibility between Contractor-furnished equipment and government-furnished equipment and facilities. Contractor provided mobile refuelers manufacture date will be within five years of age at contract award.
C-5.9.1 Disposition of Contractor Furnished Equipment: Contractor furnished equipment identified herein shall be used solely in the performance of the work defined in Section C-5.0. The Contractor shall not store equipment in excess of the contract requirements on Government property. On termination of the contract, all equipment shall be removed from Government property within 30 days. Thereafter, the Contractor shall be charged the prevailing commercial storage rate for each piece of equipment kept on Government property.
C-5.9.2 Uniforms, Clothing, and Safety Equipment: The Contractor shall provide a distinctive company uniform for personnel to wear in the performance of their duties. Uniforms shall be maintained in a clean, serviceable condition and replaced when excessive wear requires. The Contractor shall provide all personnel safety equipment including safety shoes, safety glasses, reflective vests, sound suppression devices, cranial protection, goggles, gloves and other identifiable special safety equipment for specific operation and maintenance procedures for personnel.
C-5.10 Government Furnished Equipment and Facilities: The Contractor shall submit all data required; maintain all records; and care for, maintain and account for all government-furnished property.
The Contractor shall be responsible for the equipment and be required to conduct an annual inventory and maintain a signed receipt document furnished by the government. Equipment and supply additions to the document may originate from a number of sources. Any defects in or damage to any government furnished equipment regardless of causation shall be immediately reported to the COR. When an item of Government property is no longer required, the Government, at its discretion, is not required to replace the item. Property accountability should be done IAW AR 735-5.
C-5.10.1 Other Government Furnished Equipment: In addition to the facilities listed in Appendix E, the Government will provide the following supplies and equipment.
• FMD 8.0 computer system, i.e., CPU, monitor, keyboard, printer, and modem, to operate under
FMD 8.0.
• Utilities: Electricity, water, sewage, and telephone (One outside commercial line).
• Safety Data Sheets (SDS) (for Government-Owned Products only)
• Dumpster/Recycle Containers, Trash removal and disposal.
C-5.10.2 Inventory of Government Furnished Equipment/Property Inventory: At contract start-up, the Contractor and Government (COR) will conduct a joint inventory of all Government property (Appendix E). The Contractor and the COR shall certify the listing and the general condition of all Government property. Thereafter, the Contractor and COR shall conduct a joint inventory of Government Furnished Equipment annually. This joint inventory shall be conducted not later than 30 days from the anniversary date each year of a multi-year contract.
C-5.10.3 Unauthorized Use of Facilities: The Contractor and its employees shall not use the facilities or premises for any outside commercial activities not specified in this PWS or contract. The Contractor shall not permit or authorize personnel to store or repair any personal property including boats, vehicles, trailers, motorcycles, etc., at fuel facilities. In addition, the Contractor shall not utilize facility property or facilities for storage or repair of Contractor-owned vehicles and equipment not specifically required by the contract provisions. Parking of personal vehicles used for transportation to and from work will be permitted in designated vehicle parking areas during working hours. The Contractor shall not allow employees to cook, smoke, have open flames, or have flammable materials in the work areas or inside any building.
C-5.1.11 Report Fraud, Waste and Abuse: The Service Provider shall promptly report to the CO and fraud counsel any indications of fraud, waste or abuse as well as any investigative contact (investigative/audit agency name, investigator/auditor’s name and phone number) concerning fraud, waste or abuse.
SECTION 6.0 DELIVERABLES
C-6.1 Contractor Detailed Plans: Following contract award, the Contractor shall have 60 days, unless otherwise indicated, to submit the detailed plans listed below to the COR and CO for review and acceptance. The plans are considered dynamic documents and shall be updated, as required, throughout the contract period through the COR.
C-6.1.1 Contract Compliance Plan (CCP): The Contractor is responsible for ensuring compliance with all contract performance requirements. As such, the Contractor shall develop an inspection system acceptable to the Government for monitoring overall contract performance. The inspection system is to include a written Contract Compliance Plan (CCP) developed and used by the Contractor to measure performance on a continuous basis. The CCP shall include performance based plans. General performance criteria shall include the Contractor’s ability to provide continuous support capabilities as specified in this PWS, record keeping and reporting procedures pertaining to administrative requirements, bulk storage operations, facility/equipment maintenance, and upkeep and appearance of grounds and facilities under Contractor control.
The CCP shall include time specific checklists for evaluation of all operational and preventive maintenance requirements. The CCP shall address procedures for corrective actions including the resolution of Corrective Action Report (CAR) and Quality Deficiency Reports (QDR) generated by the COR. The Contractor shall submit an updated CCP to the CO for review and approval within 30 days after contract award. The CCP shall be made available for Government review, upon request, at any time during the contract performance period. The CCP may be used by the COR for monitoring and assessing contract performance
C-6.1.2 Operations Plan: The plan shall provide comprehensive and detailed step-by-step procedures covering all requirements specified in C-5.0 Performance Requirements.
C-6.1.3 Product Inventory Control and Accountability Plan: The plan shall provide comprehensive and detailed procedures to ensure compliance with the requirements of DoD 4140.25M, DLA Energy Interim Guidance, and DLA sponsored applications guidance.
C-6.1.4 Product Quality Control Plan: The Contractor shall provide a comprehensive and detailed QCP specific for each location and facility that will ensure that products handled by the Contractor remain on-specification. The QCP shall include sampling, testing methods, equipment, documentation of tests, records keeping, and actions to be taken in the event of unacceptable test results. The plan shall detail how product quality surveillance data will be documented and reported. The plan shall identify responsible parties for the functions. This plan shall be submitted within 30 days after contract award and shall be effective at the start of the contract performance period.
C-6.1.5 Maintenance Plan: The Contractor shall provide a detailed maintenance plan for all facilities, equipment, and system components. The plan shall identify the frequencies, methods, and procedures for accomplishing the maintenance objectives set forth within and will be developed in accordance with applicable directives.
C-6.1.6 Safety Plan: The Contractor shall outline procedures necessary to maintain safety in accordance with applicable laws and regulations. At a minimum, this plan shall include Confined Space Entry, Disaster Preparedness, Fire Prevention and Protection, Personal Protective Equipment, Hazardous Waste Operations and Emergency Response, Safe Transportation of Hazardous Material, Safety and Health Standards, Hazardous Communications, Lockout/Tagout, FOD awareness/prevention, pre-accident plan, post-accident plan, and Fuel Handling Operations. IAW the German Worker Protection Act, any local national employees must be briefed on any explosion hazards identified in the explosion protection document completed by the government.
C-6.1.7 Environmental Protection Plan: The Contractor shall provide a comprehensive and detailed plan that will ensure compliance with all applicable DoD, Final Governing Standards (FGS) or host nation laws and regulations. Where no FGS is in place use DoD and Overseas Environmental Baseline Guidance Document (OEBGD) requirements as applicable.
C-6.1.8 Training Plan: The plan shall identify length of training, training sources, and a brief description of courses for federally and locally mandated and generally required safety training, environmental protection training, and job qualification training.
C-6.1.9 Security Plan: The plan shall clearly identify staffing and procedures necessary to maintain security and incorporate all elements of the concept plan.
C-6.1.10 Airfield Operations Plan: The plan shall identify operational, staffing, and equipment requirements to successfully meet the requirements (normal and surge) for Clay Kaserne Army Airfield as stated in Appendix-E. The contractor's proposal and follow-on aviation refueling plan shall address which publications within Appendix C is to be followed for aircraft refueling procedures. For example, when detailing number of personnel required for cold aircraft refueling, FM 10-67-1 details that two personnel are required for each refuel operation; one to tend the pump and one to tend the nozzle.
However, NFPA 407 only requires one person (contractor) to be present from a tank vehicle when an operational dead man control is in use. Regardless of publication chosen, contractor will apply grounding procedures as stated in FM 10-67-1 for parking of all tank vehicles and for all aviation refueling operations. The plan shall detail all required/specific refueling procedures for all types of aircraft listed in Appendix E for each airfield. Airfield Operations Plan shall additionally address all necessary training requirements as it pertains to operating procedures, safety, accountability, equipment, facilities and quality surveillance.
APPENDIX A: Definitions
Contractor (The): The individual, person or group of persons, partnership, company or corporation specifically named and contracted by/with the Government to fulfill the terms of this contract document.
The term “Contractor” as used herein refers to the partnership, company or corporation as a whole or any individual, attendant, technician, operator, driver, dispatcher, or laborer who may be acting on behalf of the Contractor.
Contracting Officer (CO): Includes Procurement Contracting Officer (PCO) and Administrative Contracting Officer (ACO) functions.
Contracting Officers Representative (COR): The individual designated in writing by the CO to act as the CO’s authorized representative to monitor specific aspects of the contract and take action as authorized in the letter of appointment.
