SPE300-15-R-0042 Amendment 0006 – Attachment 1 Page 1 of 20

This amendment contains two sections: Section I contains revisions (adds/changes/deletions) to the solicitation requirements. Section II provides answers to questions which were submitted in reference to previous amendments.

NOTE: The answers in Section II are provided for clarification purposes only and do not change the solicitation requirements. In the event of any discrepancy between the answers provided in Section II and the solicitation documents, the solicitation documents will take precedence.

SECTION I – Solicitation Adds/Changes/Deletions

1. On page 24 of the Solicitation, delete and replace 252.216-7006 as follows:

252.216-7006 Ordering (May 2011) DFARS

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the contract schedule.

Such orders may be issued from date of award through contract expiration.

2. On page 100 of Solicitation Attachment 1, paragraph G. Emergency Orders, sub-paragraph 1, delete and replace the second sentence as follows:

The Prime Vendor will provide a maximum of two such “emergency” orders (excluding mobilization actions) per month per customer at no additional charge.

3. On page 94 of Solicitation Attachment 1, A. Kuwait Customers: DoDAAC W91RH2 was removed. Also, reference Amendment 4, question 153 and question 4 of this document the chart was replaced in its entirety.

4. The Solicitation Attachment 2 Market Basket Spreadsheet as amended via amendment 0004 is hereby replaced in its entirety, see attachment 2. The following changes were made to the spreadsheet:

(a). On the Market Basket tab, Column “J” was corrected to read

=IF(K22="CS",IF(H22="Y",G22,G22*F22),IF(H22="N",G22/F22,G22)).

(b). On the Market Basket tab, RPQ was removed from cell AC46.

(c). On the Market Basket tab, for Line Item 20 “JUICE, ORANGE, CHL, CONC, 4/1, 1/5 GL BIB, FOR DISP” the distribution category number in column “N” was revised from 2 “CONUS Dry EA” to 5 “CONUS chilled CS.”

(d). On the Market Basket tab, the formula in cell R68 was revised from “=Q68*11.4” to “=Q68*14.32.

(e). On the Market Basket tab, the font color for the stock number and item description on line item 34 was changed from green to black.

(f). On the Distribution Category Worksheet tab, for category #17, the distribution price category unit of measure in column E was revised from CS to EA.

SPE300-15-R-0042 Amendment 0006 – Attachment 1 Page 2 of 20

(g). On the Totals tab, in cells E16 and E22, “+J9” was removed from the formula.

(h). On the Totals tab, in cells G19 and G22, “+J9” was removed from the formula.

(i). On the Totals tab, in cell E25, the formula was revised from “=SUM(E16:E24)” to

“=SUM(E15:E24).”

(j). On the Totals tab, in cell G25, the formula was revised from “=SUM(G16:E24)” to

“=SUM(G15:E24).”

SECTION II – Questions & Answers

1. The total value estimate is $451 million. Does this include the value of the orders to be filled by the incumbent PV during the 6 month ramp up period? Similarly the quantities stated as annual quantities do they include the quantities of orders to be filled during the ramp up period?

DLA Troop Support Response: The total estimated dollar value of the contract is based on the total dollar value estimated to be expended under the entire performance period of the resulting contract. Offerors are reminded that the estimates provided in the solicitation are only estimates, are provided for informational purposes only, and that the Government is only liable for the guaranteed minimum under any resulting contract.

2. Will commercial warehouse agreements be permitted under this solicitation and, if not, how is that going to be evaluated? Dollars for consolidation can be hidden under different segments of product prices, therefore, skewing the evaluation.

DLA Troop Support Response: Product Price is clearly defined in the solicitation, see DLAD 52.216-9065, paragraph (b)(3). All offerors are required to adhere to this product price definition irrespective of the existence of specific commercial agreements

3. Excluding FFV and bottled water, are all other LMR items required to be procured from approved sources in Kuwait, Iraq & Jordan or may LMR items be procured from approved sources outside those specific countries or even outside the region?

DLA Troop Support Response: See statement of work, page 23: The Prime Vendor must have the ability to procure and perform delivery of the local market ready (“LMR”) items (e.g. FF&V, fresh dairy, fresh juice and beverages, water, olive oil, and fresh baked product from local approved sources within Kuwait, Iraq and Jordan). It is anticipated that all LMR will come from local approved sources, when required, from within Kuwait, Iraq and Jordan. LMR may be procured outside of these specific countries, however, any additional costs associated with sourcing from other countries, including but not limited to inbound transportation, must be covered by the applicable fixed distribution price.

SPE300-15-R-0042 Amendment 0006 – Attachment 1 Page 3 of 20

4. In regard to the delivery sites in Iraq, the provided usage data seems to be conflicting. For instance in the original statement of work the following ten Iraq customers were listed.

Service DODAA Unit Name DoS W98BA2 Basrah DoS W98J01 Chancery DoS W98D53 BDSC

Army W98D08 BDSC Army W98U03 Emmsa Army W98B03 Besemaya Army W98C05 Taji Army W98IRB Erbil Army W98B01 Al Asad Army W98B10 Al Taqaddum

And in the amendment that was published on the 15th of January the following answer was given to question 153: “The solicitation page 94 provides details of 10 places of delivery in Iraq. Please provide estimates of sales of $619.69k (pg. 12) by point of delivery in Iraq and frequency p.a.” Only the following eight sites were included in the answer for question 153 on page 46 & 47 of Amendment 4 leaving two missing but some changes were also made:

W98J01 IRAQ 30.01%

W98BA2 IRAQ 9.30%

W98D53 IRAQ 21.65%

FT9289 IRAQ 21.91%

W98U03 IRAQ 6.53%

W98IRB IRAQ 7.03%

W98B01 IRAQ 3.18%

W98C05 IRAQ 0.40%

Please see the below diagram which indicates which sites are missing (and one new site FT9289).

SPE300-15-R-0042 Amendment 0006 – Attachment 1 Page 4 of 20

DLA Troop Support Response: See Section I, paragraph 3 above.

Customers and percentage data are provided for informational purposes only. Offerors are reminded that actual customers, customer locations within the regions covered by the contract, and percentage of demand can and will vary during the period of performance of the contract. Offerors are further reminded that the Government is only legally obligated to order up to the guaranteed minimum under any resulting contract.

5. Disappearance of routine air freight site. In Amendment 4 the following question was asked:

65. RFP SOW, Page 54, Para 6, “For informational purposes only, based on current conditions on the ground, there are two (2) Iraq customers (Al Asad and Al Taqaddum) that require routine air shipments.” Question: Can DLA provide the current (Average) weekly payload to these two customers as well as the forecasted (Average) weekly payload?

The response clearly includes DODAAC W98B10 Al Taqaddum, yet in DLA’s response to question 153 this DODAAC is absent. Is the offeror expected to deliver to W98B10 Al Taqaddum?

DLA Troop Support Response: Offerors are expected to be able to deliver to W98B10 Al Taqaddum.

6. Sales numbers inconsistent with case values. On page 12 of the SOW, the average annual sales for Iraq are stated as $619,690.05 and this was confirmed in a question asked. This breaks down to $51,640.83 per month in sales. However, when you compare this with the answers in the most recent amendment on page 29, the answer to question # 65, DLA Troop Support states that the average weekly demand for the two routine sites within Iraq are 4,505 and 1,874 cases respectively. Using these numbers to calculate average monthly demands for these two sites comes to 18,020 and 7,496 i.e. a total of 25,516 cases per month. When multiplied by 12 months this results in 306,192 cases a year for the two routine air delivery sites in Iraq. Based on the numbers provided, this would mean that a vendor would be able to expect to have a total unit price for Iraq, product plus distribution fee, of a maximum an approximate $2.02 per case. Even if these were GFM products, for which there is an outstanding question, the provided figures seem improbable.

DLA Troop Support Response: The estimated dollar values provided in this solicitation are projected estimates for future performance under this solicitation. Offerors are reminded that the estimates provided in the solicitation are only estimates, are provided for informational purposes only, and that the Government is only liable for the guaranteed minimum under any resulting contract.

7. Sales numbers inconsistent with volumes. 65. RFP SOW, Page 54, Para 6, as referenced above provides volumes for what are estimated as 4.5% of the volumes delivered to Iraq (loosely, since DODAACs W98B10 and W98B03 are missing, based on the percentages from the answer for question 153 on page 46 & 47 of Amendment 4), the total yearly amount of cases delivered to Iraq can be calculated to an approximate 7.3 million. This produces an average unit cost per case that equates to less than $0.10 a case. To price air freight per lb. and convoy security, a better picture on volume, sales or cases but preferably both, is needed. Airfield handling. Will the offeror be required to unload at airfields and if so what equipment is there locally? Transport from airfield to final customers. Will the offeror be required to provide forward movement?

SPE300-15-R-0042 Amendment 0006 – Attachment 1 Page 6 of 20

DLA Troop Support Response: Sales figures may appear inconsistent with volumes because the estimated sales data is based on projected future performance under this solicitation, while volume figures are based on historical figures. See pages 61-62 of solicitation attachment 1: “The Prime Vendor will need to coordinate all necessary delivery times and destinations, landing permissions, offloading and drayage (including outside the wire deliveries – no military escort) with the customer requiring delivery.

Advance confirmation should be made as to responsibility for offloading.”

8. By DLA's DLAD 52.216-9065 (listed below) Amendment 1, Mandatory source items are FOB origin. The DLA Quote Sheet requires Mandatory source items to be flagged as a product price exception (from b,3,C of definition) with a subcategory "A", (ie 1A) for the Market Basket Distribution Fees. Amendment 3, Response to Question 61 (also below) states to only use a subcategory A in the event that freight is included in the Mandatory Source item. The answer about regarding freight costs being included in the product price (Am3 response), conflicts with the DLAD 52.216-9065 (b)(3)(C) definition and the SOW requirements for the DLA Quote sheet/Market Basket to notate whether the item is mandatory source and not specific to mandatory source item with freight. All current Mandatory Source items published by DLA on the AbilityOne Mandatory Procurement List (MPL) are listed as F.O.B Origin DLA Price. Amendment 4, Response to Question 79 states that the lower priced distribution Category (1a) shall be utilized for mandatory items because some freight costs may be included in the nonprofit agency product price. - this statement implies that ALL mandatory items should be in the lower distribution category. Amendment 1: DLAD 52.216-9065 ECONOMIC PRICE ADJUSTMENT 3i)Exceptions (C)Mandatory source items: The product price shall be limited to the nonprofit agency's price for product as set in accordance with applicable law. The product price shall be based on f.o.b. origin/nonprofit agency. (Prices set in accordance with applicable law (f.o.b.

origin/nonprofit agency). Amendment 3 - pg 42, DLA Response to 61: In accordance with DLAD 52.26-9065 (b)(3)(C), for mandatory source items, "the product price shall be limited to the nonprofit agency's price for product as set in accordance with applicable law. The product price shall be based on f.o.b. origin/nonprofit agency." The lower priced distribution category (category 1A) shall be utilized for mandatory items when freight costs are included in the nonprofit agency product price. Amendment 4 -pg 31, DLA Response to 79: In accordance with DLAD 52.216-9065(b)(3)(C), for Mandatory Source Items, (the product price shall be limited to the nonprofit agency's price for product as set in accordance with applicable law. The product price shall be based on f.o.b. origin/nonprofit agency.) The lower priced distribution Category (1a) shall be utilized for mandatory items because some freight costs may be included in the nonprofit agency product price. QUESTION: Based on the above information, does DLATS expect the current mandatory items (all of which are labeled as FOB Origin/Non Profit Agency) in the regular category (1) and expects any future mandatory items that include freight to be categorized in subcategory (1a)? Do the quote sheets for the mandatory items need to be revised by the suppliers so that the product price exception information is not circled and populated, based on all of the items being FOB origin?

DLA Troop Support Response: The lower priced distribution category 1a shall be utilized for all mandatory items, included the market basket items. The product price exception indicator should be marked yes in column I on the market basket tab. The quote sheets will not be revised.

SPE300-15-R-0042 Amendment 0006 – Attachment 1 Page 7 of 20

9. RFP SOW, Page 39, Para V. Amendment 0001 Question/Answer 58. The USTRANSCOM contracted carrier will be responsible for the transportation of the Prime Vendor’s products from the specified CONUS manufacturer or CONUS distribution facility to the Prime Vendor’s OCONUS distribution facilities. Question: For product that is shipped from a manufacturer to the Prime Vendor CONUS distribution facility, who is responsible for making these arrangements and PAYING FOR THE COST OF TRANSPORTATION?" (Original Question) Response: The Prime Vendor is responsible for making arrangements with the manufacturer? (Amendment 4 Answer) Follow-up Question:

While it is understood that the PV makes the arrangements, is DTS responsible for the cost to move the product to the CONUS distribution facility, or is that a PV contractor cost?

DLA Troop Support Response: The Prime Vendor is responsible for transportation costs to move product from a manufacturer to a CONUS distribution facility. These transportation costs should be included in, and considered by, offerors when proposing standard distribution prices.

SPE300-15-R-0042 Amendment 0006 – Attachment 1 Page 8 of 20

10. The list of delivery locations (DODAACs) for Iraq and Jordan provided in Amendment 4 conflicts with the list of DODAACs for Iraq/Jordan provided in the solicitation. Amendment 4 lists six DODAACs in Jordan, the solicitation lists seven. Amendment 4 lists eight DODAACs in Iraq, the solicitation lists 10. Additionally, one of the eight Iraq DODAACs listed in Amendment 4 (FT9289) is listed as being in Jordan in the solicitation.

11. It is understood volumes will change and offerors are required to plan accordingly, however only the incumbent provider has full information on how many delivery points there are in each country and where they are located in relation to each other. This information is critical to develop reliable cost estimates. Please clarify the solicitation/Amendment 4 discrepancy and provide a revised list of DODAACs by country with DLA’s estimated percentage of sales.

SPE300-15-R-0042 Amendment 0006 – Attachment 1 Page 10 of 20

12. Reference SOW Page 100, paragraph G.1. – the SOW states “The Prime Vendor will provide a minimum of two such “emergency” orders (excluding mobilization actions) per month per customer at no additional charge.” There is no way for bidders to accurately estimate how many emergency orders for each customer to be factored into their pricing. Is the word “minimum” in this sentence intended to be “maximum”?

DLA Troop Support Response: Yes. See Section I, paragraph 2 above.

13. IV. Product Sourcing and Pricing. 19A. Price Definitions and Provisions; (4); (ii) Non-Standard Distribution Price for Ground Movement within Iraq inclusive of Private Convoy Security. Kindly advise if Non-standard Distribution is to include Fuel in Iraq, Driver Allowances in Iraq, and any other expenses incurred in Iraq for the delivery.

DLA Troop Support Response: Non-standard distribution prices (with private security, without private security, and air movement) are to include all unique costs associated with performing contractual obligations within Iraq. Costs for Iraq deliveries from Kuwait to the border of Iraq must be included in the standard distribution price. Offerors are reminded that distribution pricing remains fixed for the life of the contract.

14. V. Transportation, 47. H. Private Convoy Security in Iraq; 2. Arming Authority Documentation.

When are the requirements under this paragraph due to the USG? Proposal submission or after contract award?

DLA Troop Support Response: After contract award.

15. V. Transportation, 62. J. Direct Vendor Deliveries Within Iraq. Kindly clarify the logic of paying 50% of the standard distribution price while Prime Vendor has to manage and pay for transportation within Iraq. It is our opinion that Prime Vendor should be paid the full non-standard fees.

DLA Troop Support Response: The price formula for direct vendor deliveries within Iraq is: Contract Unit Price = Product Price + 50% of the Standard Distribution Price. See logic as stated in amendment 0003, Section II, paragraph 47:

“47. IV. Product Sourcing and Pricing Direct Vendors: Why will Prime Vendor only be allowed 50% of the Standard Distribution fees in the event an item(s) are purchased within Iraq? As Prime Vendor will be organizing all works to procure and manage the process, and delivery still has to take place, and the subcontractor(s) must be paid. A.

Price Definitions and Provisions; (5); For Iraq Customers, one of the following formulas shall apply; (the second formula).

DLA Troop Support Response: When the Prime Vendor purchases product from within Iraq and uses a subcontractor within Iraq to perform the delivery service to the Iraq customer, only 50% of the Standard Distribution Price will be paid because of reduced storage, handling, and overhead costs. For these deliveries, the Prime Vendor is not receipting, storing, or handling this product in a CONUS or OCONUS warehouse.”

SPE300-15-R-0042 Amendment 0006 – Attachment 1 Page 11 of 20

16. XIV. Delivery, Title, Orders, and Order Fill Rates. 97. C. Ordering System - Subsistence Total Order and Receipt Electronic System ("STORES"). Kindly indicate and provide extensive details on what the data source for the EDI files will be. Kindly clarify, confirm and amend accordingly.

Further, an open parentheses sign "(" is used before 60 and a closed brace sign "}" is used after 60, what is the meaning of this? Kindly review all these confusion and clarify and then provide an amended document.

SPE300-15-R-0042 Amendment 0006 – Attachment 1 Page 15 of 20

28. With reference to the Market Basket tab, the formula entered in column J is wrong. The formula in column J is written as: =IF(K22="CS",IF(H22="Y",G22,G22*F22),IF(H22="N",G22,G22/F22)). The true, false results for the third “If” statement are reversed. The correction is:

=IF(K22="CS",IF(H22="Y",G22,G22*F22),IF(H22="N",G22/F22,G22)). The difference is that the first version results in the total product value of column y being over $280 million whereas the correct version reduces that to about $30 million excluding distribution prices.

DLA Troop Support Response: See Section I, paragraph 4 (a) above.

29. With reference to the Market Basket tab, the formula entered in column AB is wrong. The formula in column AB is: =PRODUCT(J18*W18). Column J is stated in CS, Lbs., or EA. Column W is converted and is stated in Lbs. only. Again the formula produces inaccurate results with a total value of product price of over $XX million. Its total product value should be the same as columns Z, and AA.

Suggested correction would be to change the formula in AB to be a product of column J x column AA.

DLA Troop Support Response: Column “J” is the Product Price Adjusted When Category UoM is not case or each, Column “W” is the Annual Quantity – Adjusted for Offered Item Size converted to pounds for commercial air movement in Iraq. If an item is LB or EA that quantity is identified in columns “P, Q & R – U, V & W and calculated in Z, AA & AB.

30. Market Basket. Line item # 44, “890501E607309 - BEEFSTK, SWISS (BRAISING), FZN, MIN US CH GR, 138/5-7 OZ EA, N#1102 “. The column “Brand Name Specific Items” states “RPQ/N'GENUITY - RPQ TO BE DELETED”. Can RPQ be quoted or not?

DLA Troop Support Response: RPQ can be quoted. See Section I, paragraph 4 (b) above.

31. Market Basket. Line 52 of the “CKN, QTR FZN US GRA RAW IQF 48 CT, 1/30 LB CS- AF”, 890501E590053, is poultry and therefore subject to National Contract. Tyson informed us that 890501E590053 has been removed from the National Contract and now offers the below:

890501E130048 CKN QTRS, IF, RAW, WOG, US Gr A, max 10% sol, ice glazed, 4/10 lb bgs, N#P1009 We have received quotes for both but cannot determine what has priority during the bidding process: 100% match on the requested item or compliance with the National Contract.

Can DLA please provide guidance?

DLA Troop Support Response: Submit quotes for the requested items (100% match).

32. Market Basket. Line 20 “JUICE, ORANGE, CHL, CONC, 4/1, 1/5 GL BIB, FOR DISP” Why was the distribution category changed for line item 20 from 5 to 2? The description of this product clearly calls for a Chilled item, while category 2 is for “CONUS DRY EA (UOM for EA = 1 CO)”. This should be in category 5: “CONUS CHILLED CS” as it was originally. Will the DLA correct this in a later stage?

DLA Troop Support Response: See Section I, paragraph 4 (c) above.

SPE300-15-R-0042 Amendment 0006 – Attachment 1 Page 16 of 20

33. Market Basket. Numbers hard-coded in column R (specifying the case weight) don’t match weights stated in the actual item description of the market basket item. Will the DLA correct this in a later stage?

DLA Troop Support Response: Column R converts the UOM in the description to LBS for commercial air movement into Iraq

34. Market Basket. Line 34 “BEEF CHUCK, ROLL, TIED, FZN, US CH GR, 10-14 LB EA, 4-5 CT/CS, N#116A/114A/B”. According to column AC this should be brand specific. However for this line it reads the NAMP# (“116A/114A/B”). Who is the mandatory supplier of this item?

DLA Troop Support Response: Market Basket Line Item 34 BEEF CHUCK, ROLL, TIED, FZN, US CH GR, 10-14 LB EA, 4-5 CT/CS, N#116A/114A/B” is not a mandatory sourced item, and cell AC36 is blank per Amendment 0004, Section I, paragraph 22 (c).

35. Market Basket. When, for a specific item, column K states “LB”, and we quote a per-pound price, then column T should be independent from case weight, while it isn’t. Will the DLA correct this in a later stage?

DLA Troop Support Response: Column T accounts for the Annual Quantity – Adjusted for Offered Item Size whether it is identified as case, pound or each. The formula looks for case (CS) in column K and then performs a function based on case. If (CS) is not in column K then the formula captures the annual quantity based on offered items in relationships to LB or EA.

36. Market Basket. Formulas in column AB look incorrect. It multiplies a quantity in pounds by a price, which is not always per-pound (can be per-case or per-each price too). Will the DLA correct this in a later stage?

DLA Troop Support Response: For all commercial air movement into Iraq Column AB converts the UOM to LBS.

37. Distribution Category Worksheet. Category 9 is expressed in LB, while the category 9 item on the “currently cataloged items” sheet is listed with UOM= CS. Will the DLA correct this in a later stage?

DLA Troop Support Response: Offer the item OCONUS CHILL LB.

38. Distribution Category Worksheet. Category 17 is expressed in CS, while the category 17 item on the “currently cataloged items” sheet is listed with UOM= EA. Will the DLA correct this in a later stage or can one consider in CS=EA in this case?

DLA Troop Support Response: See Section I, paragraph 4 (f) above.

39. Totals. What’s the purpose of adding cells E16 to E22 together in cell E25? Each of them already comprises the standard distribution price, cell J9, so cell J9 contributes twice to CELL E 2 5 .

DLA Troop Support Response: See Section I, paragraph 4 (g) above.

SPE300-15-R-0042 Amendment 0006 – Attachment 1 Page 17 of 20

40. Totals. What’s the purpose of adding cells G16 to G22 together in cell G25? Each of them already comprises the standard distribution price, cell J9, so cell J9 contributes twice to CELL G25.

DLA Troop Support Response: See Section I, paragraph 4 (h) above.

41. Totals. Why does cell E25 not take into consideration cell E15?

DLA Troop Support Response: See Section I, paragraph 4 (i) above.

42. Totals. Why does cell G25 not take into consideration cell G15?

DLA Troop Support Response: See Section I, paragraph 4 (j) above.

43. On the Currently Cataloged Items and the Market Basket tab, item 891001E395566 - CHEESE, COTTAGE, FZN, 1.5% SMALL CURD, 4/1 LB CO is tied to Category 9 (OCONUS CHILLED LB).

This item is a frozen item. The Market Basket Tab has the item listed with a UOM of LB, while the Currently Cataloged Items Tab has the item listed with a UOM of CS. The annual volumes listed are the same despite the UOM differences. Can you please confirm if this item is supposed to be bid as a OCONUS CHILL LB item, or an OCONUS FZN CS item?

DLA Troop Support Response: Offer the item OCONUS CHILL LB.

44. Reference Market Basket Worksheet – cells R78, R67 & R68: The conversion factors from UoM to LB are wrong. They should be 5.3, 18.75 & 20 and not 49.5. 120 & 80 respectively. You may also want to review those conversion from metric system to pounds. We use the same conversion factors to estimate transport costs and required assets.

DLA Troop Support Response: See Section I, paragraph 3 (d) above. Cells R67 and R78 remain unchanged with the following formulas: “=Q67*18.75” and “=Q78*5.29,” respectively.

45. The conversion factor from UoM for category 4 for items 29 thru 54 in the market basket to Lbs for air transport should be 1 and not as used for each item. The one used is converting CS for each item to pound. CS is not the UoM; lb is. The basic question is: are the quantities given in columns O, P & Q for each item CS or LB? If LB, the conversion factor would be 1; if CS, change the UOM to CS.

DLA Troop Support Response: The quantities given in columns O, P, and Q for items 29- 54 is LB and the conversion factor in column R for items 29-54 is 1.

46. UoM for distribution category #1 includes 12 items in the market basket. The actual conversion factors from case to LB for these items range from 5 to 40 pounds. This is saying that there are CS that weigh 5 pound and others that weigh 40 pound. Offerors should charge the same fee for distributing the small and the large CS. Offerors base the distribution fees mostly on weight. Therefore such a wide range exposes offerors to high risk when requiring them to charge the same fees for a case of 40 lbs. vs a case of only 5 lbs. Similarly, Category 3 range 12 – 30 lb; Category 4 should be 1, currently it is 2.65 to 40; Category 5 range: 6.25 to 20; Category 6 range 12.5 to 24; Category 7 range 5.29 to 25; Category 8 range 3 to 9; and Category 11 range 13 to 41.7. This wide range would not be fair to the contractor or the Government. Competition is making it a requirement to offer razor sharp prices and not something

SPE300-15-R-0042 Amendment 0006 – Attachment 1 Page 18 of 20 based on such wide variations. Rectifying this would require complete re-work of the distribution categories. The predecessor solicitation contained 237 categories; reducing them to 23 exposed the offerors and the Government to major risks.

DLA Troop Support Response: This solicitation contains 23 distribution categories (categories 1-18 and subcategories 1A-5A). No substitutions, deletions, or additions to the categories or units of measure have been authorized.

47. Having reviewed and studied the attachment we suggest for the inclusion into this attachment a TAB - Matched/Non-matched items, and a TAB - Alternate ITEMS To allow for the best possible submission to be made to the USG in support of this opportunity. If not, kindly clarify/advice where to include the items falling into these very specific categories noted, in the attachment as provided.

DLA Troop Support Response: See solicitation attachment 1, page 140, Element 3, paragraph 1, which reads as follows: “For each item on the market basket tab, the offeror shall confirm in a separate word document if the item quoted is or is not an exact match to the market basket item description. For items offered as an exact match, “Exact Match” must be stated. For items that are not offered as an exact match, “Alternate Item” must be stated to include a full description of the quoted item. Also, the specific difference(s) between the requested item description and the quoted item description must be clearly explained.”

48. TAB - Currently Cataloged Items Column I - Brand Name. Kindly advise if brand names mentioned are mandatory, i.e. potential offerors must get quotation from the mentioned suppliers or for the mentioned brands only, or are potential offerors allowed to provide quotations from different suppliers or for other brands, in place of those noted.

DLA Troop Support Response: See Amendment 4, Section II, paragraph 129:

“129. SOW Page 24, E. Brand Names. For the purposes of pricing the Market Basket Brand Name items in the solicitation, may the bidder offer substitute items that have identical specifications?

DLA Troop Support Response: Contractors are required to submit pricing on the specific Brand Name items listed in the Market Basket.”

49. TAB - Market Basket. A. Line Item 28 through 53. With the Item description UoM in LB ( Column D); and in the Distribution Price Category in LB ( Column K); The sheet does not allow us to enter yes for case pricing in Column H despite the fact that the manufacturer might have quoted this item in Case price. If we enter YES, it gives us an ERROR message in Column J. If we enter NO, in Column H despite the price entered in Column G is case price, then formula will work. Kindly confirm, clarify and amend - that despite the fact that some quotes will be per case and yet in the market sheet we are mentioning NO in the case pricing column.

DLA Troop Support Response: The referenced error was corrected via Amendment 0003, Section I, paragraph 15(i), which reads as follows:

“(i). On the Market Basket tab, the formula in Column “J” was corrected to account for the Distribution Price Category UoM in column “K”. Note: for items identified in column “K” as EA or LB column “J” will show “#DIV/O!” until columns F – I are filled in.”

In reference to Column J, see Section I, paragraph 3 (a) above.

50. TAB - Market Basket. A. Line Item 41. Evaluated unit per UOM is 18, meanwhile item description states that 8 packages, and each package is 7 LB which makes it total 56 LB. Clarify and Amend.

DLA Troop Support Response: The item description being referring to is actually line item 42 (Beef for Stewing, FZN, Diced, 8/7 LB BG) and it shows the correct UoM of 56 LB.

51. TAB - Market Basket. Line Item 49 Evaluated Unit Per UOM does not match up with Item description , 60 Ct * average 8.5 oz =31.875 LB. Meanwhile description states 3-15 LB per Cs. Clarify and Amend.

54. TAB - Market Basket. A. Line Item 53. Evaluated Units per UOM is 30 meanwhile description is 20 LB. Clarify and Amend.

DLA Troop Support Response: The item description being referring to is actually line item 52, (VEAL STEAK, FLAKED AND FORMED, BRD PRECKS, FZN 80/4 OZ), and the correct UOM in cell E56 is 20.

55. TAB - Market Basket. A. Line item 34 NSN 890501E607950, shows a formula for brand specific, please advise if this one is brand specific or not.

DLA Troop Support Response: Line item 34, NSN 890501E607950, BEEF CHUCK, ROLL, TIED, FZN, US CH GR, 10-14 LB EA, 4-5 CT/CS, N#116A/114A/B is not a Brand Specific item. See Section I, paragraph 3 (e) above.

56. For Solicitation # SPE300-15-R-0042, the checklist in the SF1449 continuation sheet states that a Subcontracting Plan is required from large and foreign businesses in accordance with FAR 52.219-9;

however, the prescription for that clause, FAR 19.708 (b) states: 19.708 Contract clauses. (a) Insert the clause at 52.219-8, Utilization of Small Business Concerns, in solicitations and contracts when the contract amount is expected to exceed the simplified acquisition threshold unless—(1) A personal services contract is contemplated (see 37.104); or (2) The contract, together with all of its subcontracts, will be performed entirely outside of the United States and its outlying areas. (b)(1) Insert the clause at 52.219-9, Small Business Subcontracting Plan, in solicitations and contracts that offer subcontracting possibilities, are expected to exceed $700,000 ($1.5 million for construction of any public facility), and are required to include the clause at 52.219-8 , Utilization of Small Business Concerns. Since FAR 52.219-8 is not required because this contract will be performed entirely outside of the United States, please confirm that a subcontracting plan is required.
