AUTHORITY TO ISSUE ORDERS, is hereby deleted and replaced with the following (areas updated are in bold red text):

The Electronic Catalog (ECAT) system, or any government-utilized successor system, will serve as the primary ordering method. As such, the Defense Logistics Agency (DLA) Troop Support is the single order entry point under this contract, as the DLA ECAT ordering application program resides at DLA Troop Support.

Additionally, the DLA Troop Support reserves the right to place manual orders under this contract. The DLA Troop Support Medical Supply Chain is the only activity authorized to place manual delivery orders under any resultant IDIQ contracts.

Orders may be issued under this program in support of requirements from the Department of Defense (DoD) and other Federal Agencies/Organizations. During the term of the resultant contract(s), the Government reserves the right to add other customer groups located within the established regions but not specifically identified in the solicitation minimum requirements to be supported by the resultant IDIQ contract(s), if the contracted vendor has the additional support capability/capacity. Any new facilities added to a specific state within a particular region shall be supported in accordance with the terms and conditions set forth in this solicitation and at the same established contract pricing as the other locations within that state/territory. In situations where a new location does not already have established state pricing, state pricing must be established and ultimately determined fair and reasonable prior to any work being performed at that new location.

VI. Solicitation pgs. 48-49, Section IV. STATEMENT OF WORK, sub-section J.

DELIVERY REQUIREMENTS, paragraph (4.), sub-paragraph (I.), is hereby deleted and replaced with the following:

(4.) PROPERTY OWNERSHIP AND DISPOSAL

(I.) Contractor Owned Property

All contractor-owned equipment, products and materials shall be installed, inspected, maintained, and repaired by the contractor in accordance with Food and Drug Administration (FDA) Current Good Manufacturing Practice (cGMP) regulations and shall be kept in good operating condition, clean, and rust free.

In accordance with FAR 52.247-66, for each cylinder lost or damaged beyond repair while in the Government’s possession, the Government shall pay to the vendor the replacement value (i.e., the established loss of use value), less the allocable rental paid for that cylinder. These cylinders shall become Government property. The replacement value/loss of use for each medical gas cylinder the vendor offers will be priced within its Attachment B – Medical Gas Program Vendor Submission Form submission.

Returnable cylinders shall remain the Contractor’s property and shall be loaned/rented to the Government for the period established at the delivery order level (hereafter referred to as the rental period). Any cylinder not returned within the rental period shall be charged a daily rental beginning with the first day after the loan period expires, to and including the day the cylinders are made available for delivery to the Contractor’s designated carrier. Any rental period extension shall be at the same rental charge rate of the initial delivery order, unless the vendor opts to waive the rental extension charge. If the Contractor does not waive the rental extension charge, the Government shall pay the Contractor the rental price established in the contract, per cylinder/per day.

In order to avoid situations where the ordering facility is using a cylinder past its rental period due date, particularly for an extended period of time, it is the responsibility of the ordering facility to ensure that the rental period purchased at time of original order is expected to be sufficient. No cylinder shall accrue rental charges in excess of the replacement value established in the contract. If the ordering facility allows rental charges to accrue in excess of the cylinder replacement value established in the contract, any outstanding rental charges accumulated over an extended period of time may not be eligible for payment under this program and would need to be settled directly between the ordering facility and the Contractor for reimbursement via other payment methods.

VII. Solicitation pg. 63, Section V. SOLICITATION PROVISIONS, sub-section D.

BUSINESS PROPOSAL SUBMISSION INSTRUCTIONS, paragraph (1.), hereby adds a NOTE 3 that states the following:

NOTE 3: Although medical gas support is broken out by region, pricing shall be established by each individual state within a particular region. Furthermore, this means that vendors will provide fixed pricing at a “state” level, which shall apply to any/all individual facilities located within the specified state, as outlined in Attachment B.

Vendors must complete all fields for each line item number in Attachment B, even if pricing is the same throughout all states within a particular region.

The state level structure described above only applies to pricing. Therefore, any vendor submitting a proposal must still be able to provide support, at a minimum, to all the specified individual Government facilities under a particular region.

VIII. Solicitation pgs. 63-64, Section V. SOLICITATION PROVISIONS, sub-section D.

BUSINESS PROPOSAL SUBMISSION INSTRUCTIONS, paragraph (1.), sub-paragraph (I.), is hereby deleted and replaced with the following (areas updated are in bold red text):

I. Medical Gas Cylinder Pricing Requirements

Vendors shall provide pricing for various cylinder compressed medical gases, in the specified required cylinder sizes, and at the specified required purities, as outlined in Section IV. STATEMENT OF WORK, sub-section F. CONTRACT MINIMUM REQUIREMENTS, paragraph (1.) BASIC REQUIREMENTS, sub-paragraph (I.).

In order to meet the medical gas cylinder minimum requirements, any vendor submitting a proposal to support a particular region(s) shall provide all the required information and pricing for each Line Item Number by completing columns E through N under Section C. of Solicitation Attachment B. Furthermore, the medical gas cylinder pricing must be broken out by unique individual part numbers (see note 2 below for exception) and vendors shall include all the necessary information in order to allow the Government the opportunity to easily identify whether the minimum requirements have been met and whether the proposal(s) is acceptable. Additionally, the medical gas cylinder requirements, as outlined in the SOW, were pre-formatted and itemized, each as individual line items in Attachment B. Vendors are required to complete all fields under the region(s) they are submitting a proposal to provide support to, for each individual line item. Furthermore, pricing for each individual line item shall be provided for each of the seven (7) years.

NOTE 1: Rental / loss of use charges shall be applied under each gas type/cylinder combination line item, however, rental charges / loss of use charges that are the same price for multiple cylinder sizes may be identified via the same part number (as provided in the above sample chart). All other line items provided in Attachment B must be identified via individual unique part numbers.

NOTE 2: For pricing purposes, all cylinders quoted within the vendors Attachment B submission must come with industry standard valve protections caps, regulators, and valves based on corresponding offered medical gas and/or cylinder size. Additionally, all cylinders quoted within the vendors Attachment B submission must be offered in the industry standard cylinder material (i.e., steel, aluminum, etc.) based on corresponding offered medical gas and/or cylinder size. Unique or specialized valves, regulators, cylinder material, etc., that would come at an additional cost to the general cylinder price shall NOT be quoted within vendors Attachment B submission.
