J&A No. 25FY12

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES

USE OF THE AUTHORITY CITED.

Purchase of non-AVAYA products or the use of non-AVAYA approved and licensed third party service providers will void existing AVAYA equipment warranties. AVAYA requires third party service providers to be AVAYA licensed or AVAYA certified before performing services on AVAYA equipment or software. AVAYA licensed third-party service providers must possess the capability to perform at the large business enterprise solution level.

DLA requires AVAYA maintenance with AVAYA initialization and administration and

AVAYA Tier 1 through Tier 4 support. Only AVAYA maintenance can provide the level of service required to meet the existing telephone infrastructure. Only AVAYA maintenance, not partner assisted maintenance is acceptable.

6. A DESCRIPTION OF THE EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE,

INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED BY

REQUIRED BY SUBPART 5.2 AND , IF NOT , WHICH EXCEPTION UNDER

5.202 APPLIES.

This acquisition will be published as an unrestricted acquisition in FEDBIZOPS. All interested responsible, technically qualified parties are encouraged to submit a quotation.

7. ADETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE.

Given the unrestricted nature of this acquisition, the contracting officer anticipates adequate price competition to result from the forthcoming competition. Consequently, the anticipated cost to the Government will be fair and reasonable.

8. A STATEMENT OF THE MARKET RESEARCH CONDUCTED (SEE Part 10) and the results of a statement of the reason market research was not conducted.

No market research was conducted as this acquisition involves the acquisition of commercial non-personal services applies to commercial software and commercial telecommunications equipment both of which are widely and readily available in the commercial marketplace.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION SUCH AS AN ESTIMATE OF THE COST TO THE

GOVERNMENT THAT WOULD BE DUPLICATED AND HOW THE

ESTIMATE WAS DERIVED.

The risk of no service coverage for AVAYA equipment and software is unacceptable to DLA management. The monetization of non-performance risk during the non-contract period is not reasonably possible but is believed to be substantial. Duplication of the cost of service is not possible or germaine as

AVAYA is the only technically qualified source for the service.

10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN

WRITING, AN INTEREST IN THE ACQUISITON.

No sources have expressed a written interest in the instant acquisition.

11. ASTATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY

TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO

COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR

THE SUPPLIES OR SERVICES REQUIRED.

DLA has and continues to exercise competition as often as possible and is required to conduct on-going reviews to keep abreast of new technology, both in industry and in the government, as a continuing effort within DLA. DLA always uses a variety of vendors, manufacturers and contracts to fulfill its requirements and will continue its practice of surveying the market to ensure future full and open competition.
