NOTICE TO OFFERORS
1. This is a COMMERCIAL solicitation for an award of a firm-fixed price indefinite delivery/indefinite quantity contract (IDIQ) written as performance-based. Services are to provide Hazardous Waste Removal, Transportation, and Disposal/Recycling, Iwakuni, Japan. The resulting contract will provide for an 18-month base period and two 18-month option periods. The base period is estimated to begin on 21 March 2017 pending timely award.
2. This request for proposal (RFP) consists of one (1) price schedule. Offerors must furnish prices for the entire price schedule including the base and option periods. An omission of any line item pricing may result in the offer being considered non-responsive and will not be considered for award. NOTE: In the event of a discrepancy in the calculation of the extended amount, the Government will multiply the offeror’s unit price shown by the estimated quantity to ascertain the extended amount proposed.
3. It is expected this project will be performed in its entirety in the country of Japan. The successful offeror must have all the required prefectural permits, registrations and licenses to perform work in the country of Japan. Failure to submit such necessary permits and licenses as part of the prospective offeror’s proposal may render the proposal unacceptable. The successful Offeror must be licensed and registered to enter and stay in Japan in compliance with local law. The U.S. Government does not provide the contractor with Status of Forces Agreement (SOFA) stamp/letter or any logistical support under the resulting contract.
4. In order to submit a complete proposal, Offerors shall follow instructions and complete all required forms in the ADDENDUM TO SOLICITATION SP4530-16-R-0004. Offerors are advised to carefully read the Performance Work Statement (PWS) and EVALUATION FACTORS – FULL AND OPEN COMPETITION in the Solicitation and note that this is a Best Value Source Selection. See FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS for proposal format and content requirements. Proposals for this solicitation shall be submitted via electronic media. The email address for receipt of offers is DRMSHazardousContractsHawaii@dla.mil. The deadline for all proposals is on 3 October 2016, at 3:00 p.m. HST (or 4 October 2016, 10:00 a.m. JST).
5. The contract will allow the Contracting Officer to make monetary deductions and/or a negative mark on the Contractor’s Past Performance when an Acceptable Performance Level (APL) (Attachment 6) is not met.
6. Offerors must submit their prices in the Japanese local currency (yen). Proposals received in currency other than Japanese yen will be considered non-conforming and unacceptable to the solicitation.
7. SITE VISITS: A Site Visit is scheduled at Iwakuni, Japan on 9 September 2016, at 1:00 p.m. Japan Standard Time (JST). Prospective offerors are highly encouraged to attend the site visits. Please contact Mr.

(Alternate is Mr. Tomokatsu Ichida at 0827-79-3081 or email Tomokatsu.Ichida.jpn@dla.mil). Failure to provide the required notice prior to the site visit date is at the burden of the visitor. Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.
8. Offerors must submit all questions regarding this solicitation via email to Mr. Curtis Chang at Curtis.chang@dla.mil. Questions must be submitted no later than 21 September 2016, 4:00 p.m. Hawaii Standard Time (HST), (or 22 September 2016, 11:00 a.m. JST), so that corresponding Government answers can be issued via solicitation amendment before closing. a. This contract requires the removal, transportation and disposal of industrial waste as identified in the U.S. Japan Environmental Governing Standards (JEGS) and wastes regulated by Government of Japan (GOJ) as Industrial Waste (IW), Specially Controlled Industrial Waste (SCIW), Specially Handled Industrial Waste (SHIW), and listed within Attachment 01, Schedule of Services. The disposition of all waste indicated in the PWS are to be performed in accordance with the respective Japanese national, prefecture and local environmental laws and regulations, as well as any applicable international agreements governing the transportation of dangerous goods and the terms and conditions of this contract. The JEGS may be located at:
http://www.navfac.navy.mil/content/dam/navfac/NAVFAC%20Pacific/NAVFAC%20Far%20East/PDFs/PWD_Yokosuka_EVfiles/2 012%20JEGS.pdf
Definitions of terms used in this PWS are provided in Attachment 02. A list of Acronyms used in the PWS are provided in Attachment 03.
b. Profile-Based CLINs (PBCs) - DLA Disposition Services launched a hazardous waste disposal contract model for solicitation on July 1, 2013. (PBCs are replacing previous disposal CLINs that were based primarily on USEPA Waste Codes. PBCs are descriptive in nature with the intent of helping contractors pre-determine appropriate treatment and disposal technologies when formulating bids. The new model is also based more on “container size” pricing whereas the old system was predominately “per pound”. Where there are not direct correlations between USEPA waste codes and Japan waste definitions the former “J” CLINs will continued to be used.
c. The contractor agrees to provide all services necessary for the final recycling / treatment / disposal of the materials listed in Attachment 01, Schedule of Services, of this solicitation in accordance with the JEGS and respective local environmental laws and regulations, as well as any applicable international agreements governing the transportation of dangerous goods and the terms and conditions of this contract. This includes ensuring all vehicles transporting materials subject to this contract are properly placarded in accordance with applicable Japanese transportation laws applicable requirements. These services shall include all necessary personnel, including applicable joint venture partners, subcontractors, labor, analysis, transportation, packaging, equipment, and the compilation and submission of all documentation required by this contract to include inspecting, packaging, marking and labeling, loading, unloading, removal, transportation, and disposal / recycling of materials subject to this contract from U.S. Department of Defense installations throughout South Western Honshu and Kyushu, Japan.
d. All materials/wastes subject to this contract must be identified and transported in accordance with Japanese transportation and safety standards and/or those indicated in the Globally Harmonized System (GHS).
All Contract Line Item Numbers (CLINs) regardless of condition are being discarded by the government and are considered to be waste subject to recycling or disposal.
e. Contractor designated site representatives and contract mangers must speak, read, and write English at a proficiently level so as to effectively participate in conversations on practical and professional levels with U.S. DoD civilian and military personnel. All documentation written pursuant to this contract shall be in the English language.

f. The contractor shall ensure all operations conducted under this contract on U.S. Government installations are supervised by individuals with knowledge of the applicable Japanese industrial waste regulations and a basic knowledge in chemistry and be capable of resolving questions/inquiries concerning technical aspects of the work involved. This work includes but is not limited to classification of waste, ensuring correct completion of documentation (including manifests), preparation of packaging, sampling, inspection, and transportation of wastes designated for transport to the recycling/disposal facility.
g. In the absence of the contract manager, the alternate contract manager shall have authority to act for the contractor during the operation of this contract. The contractor agrees that notice by the U.S. Government to his designated contract manager or alternate contract manager shall constitute notice to the contractor and agrees to be bound by any commitments or representations made by the employees so designated. Contract personnel shall present a neat appearance and be easily recognized as Contractor’s employees. This may be accomplished by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges that display the company’s name or the employee’s name.

U.S.
holidays are presented in Attachment 04. The primary pick-up sites are listed in Attachment 05.
j. Evaluation of contract performance will be in accordance with Contractor’s Acceptable Performance Levels (APL) presented in Attachment 06 and Quality Assurance and Surveillance Plan (QASP) in Attachment 07. The purpose of the QASP is to provide guidance on administering subject contract such that the best possible quality in performance can be assured through appropriate surveillance, and addressing of any performance failures as appropriate. The Acceptable Performance Level (APL) Matrix states the surveillance methods and reductions for failures. However, certain additional explanation and detail is provided herein as necessary.

a. All references to manifests in this provision relate to the “appropriate shipping paper”. In accordance with Japanese environmental regulations the generator of the wastes shall prepare the manifest. Prior to removal from a site identified as a pick-up point in this contract, completed copies of all Japan or local government manifests, or bills of lading, whichever is applicable, shall be furnished to the contractor. d. The contractor shall complete the DD Form 1155, Order for Supplies or Services (Attachment 11) for all items ordered or services performed on a Task Order (TO). The contractor shall record the type of waste, quantities removed, waste codes, manifest numbers, and date removed. The contractor shall obtain the COR’s signature and date on DD Form 1155 to verify the wastes removed.
1.1.3 NOTIFICATIONS
a. Except as may otherwise be specified herein, the contractor shall notify the COR or other designated U.S.
Government representative for each location, at least five (5) business days before attempting site visits, sampling for analysis, or pickups. For expedited removals, notification will be as soon as possible, but not later than one (1) business day before removal.
1. In addition to the notification above for pickups, the contractor shall provide the name of the driver, the driver’s Commercial Driver’s License (CDL) number and its expiration date to the COR or other designated U.S. Government representative at least 24-hours prior to removal. The contractor may also choose to provide a list of approved, multiple drivers designated for pickups under this specific contract to the COR or other designated U.S. Government representative prior to any attempted removals. If this option is elected and the list is approved by the U.S. Government and maintained by the Contractor, the 24-hour notification requirement is unnecessary for the remainder of the contract unless otherwise modified.
2. If a driver other than the one specified 24-hours in advance for the specific task order,; or one whose name does not appear on the optional list of approved, multiple drivers arrive for pickup, the COR or other designated U.S. Government representative will verify the personnel switch with the prime contractor before the pickup commences. This may require a written notice or fax from the prime contractor.
3. The Government reserves the right to take appropriate action, such as the pursuit of monetary consideration and/or annotation of negative past performance if the Contractor fails to meet the above applicable notification timeframes and/or a different driver, other than the individual previously identified under this notification requirement, or whose name does not appear on the approval list, and/or if multiple drivers arrive at the pickup locations(s).
b. For TOs containing Expedited Removals, Services or Performance CLIN J9503, the contractor shall notify
PAGE 9 OF 59 PAGESCONTINUATION SHEET REFERENCE NO. OF DOCUMENT BEING CONTINUED:
the COR or other designated U.S. Government representative for each location, BEFORE attempting site visits, sampling for analysis, or pickups at least one (1) calendar day in advance. The contractor shall also provide the information identified in paragraph 1.1.3.a.1 at least 24-hours prior to removal. If applicable, any removals ordered under a 24-hour or one business day expedited CLIN requires the contractor to provide the information identified in paragraph a.1 at least four (4) hours prior to pick-ups if the contractor elects to provide the identity of the driver for each specific TO. If the Contractor elects to provide the list of approved, multiple drivers designated for use under this contract, as in paragraph 1.1.3.a.1, this expedited notification is not required. All other terms and conditions stated elsewhere within this clause apply to any of the aforementioned Expedited Removal CLINs.
c. In the event the US Government misidentifies a waste on a TO the contractor has the responsibility to inform the COR as soon as the contractor becomes aware of the misidentification. The contractor shall notify the COR either prior to removal or within 10 working days of the removal and prior to disposal. The contractor shall provide lab analysis and/other supporting documentation. The waste shall not be treated or disposed of until the U.S. Government has made a determination on the matter. Once a determination has been made, a TO modification will be issued with the correct CLIN. The contractor shall be paid the disposal price in accordance with the contract price of the actual waste removed.
1.1.4 TRANSPORTATION
a. Contractor-provided transportation will comply with all Japan laws and regulations for the transportation of hazardous materials and designated waste under this contract and U.S. Military Base Safety requirements, U.S. DoD Safety and Security policies while on U.S. DoD installations. Failure to meet these requirements may result in the Government halting the pick-up. A Transportation Profile Sheet, Attachment 12 shall be submitted for each additional transporter proposed after contract award for use on this contract. The Transportation Profile Sheet must be submitted for review/approval; no substitute forms will be accepted.
b. Where transportation CLINs are applicable, only one transportation charge per removal shall be allowed.
The contractor shall provide a single truck of the appropriate size to make a single removal of all waste per the task order, whenever capable. For example, if a task order is issued for a removal of 10 tons of hazardous waste, the contractor shall provide one truck with a 10-ton capacity instead of two trucks with 5-ton capacities. In situations where the contractor possesses the appropriate sized truck, but it is unavailable, and hence smaller trucks are provided for multiple pick-ups, the contractor shall only be paid one transportation fee to account for the entire removal amount.
1.1.5 TRAILER SECURITY, PADLOCKS
