PERFORMANCE WORK STATEMENT (PWS)
III.1 BACKGROUND/PURPOSE
DLA Disposition Services has the responsibility of disposing and reutilizing surplus US Department of Defense (DOD) property. DLA Disposition Services receives surplus personal property from DOD activities. In pertinent regulations, e.g. see III.6, this can be referred to as “foreign excess personal property”, but it is surplus property from US DOD activities performed outside of the U.S. DLA Disposition Services seeks to accomplish the following: (1) Redistribute this surplus property to other DOD activities (Reutilization); (2) Transfer the property to other Federal Agencies; and (3) Donate the property to authorized Donees. DLA Disposition Services Kuwait supports the Central Command (CENTCOM) Area of Responsibility (AOR). To support the DLA Disposition Services mission to dispose of DOD Surplus/Surplus property in the CENTCOM AOR requires a workforce with certain skills for excess property management and office support to allow the facility to work in a safe, efficient and user friendly manner.
III.2 SCOPE OF WORK
The contractor shall provide non-personal services to support DLA Disposition Services Kuwait as required by this PWS. The contractor will perform a variety of tasks relating to the control and accountability of items from receiving property through reutilization, transfer, donation (RTD), or other disposal action.
Based upon current workload projections, experience at the site and skills required, the Government estimates that the following number of contractor personnel will be needed at DLA Disposition Services Kuwait performing the work as required by this PWS:
82 - Personnel: 1- Site Leader, 5 - Supervisors, 11- Material Handling Equipment (MHE) Operators, 15 - Torch Cutters, 31- Laborers, 5 - Warehousemen, 7 – Receivers, 5 - Customer Service Clerks and Administrative Assistants/Escorts and 2 - Safety personnel.
The contractor is responsible for determining the proper labor mix to meet the performance requirements of the contract.
III.3 GENERAL
III.3.1 EMPLOYEE REQUIREMENTS
III.3.1.1 The contractor employees shall meet all requirements and perform the tasks below.
III.3.1.2 The contractor shall have a minimum of one on-site supervisor with authority over the other contractor employees to resolve day-to-day performance issues that may arise during performance of this contract. The contractor shall also designate at least one contractor manager to provide overall contract employee supervision and interface with DLA Disposition Services Kuwait management to ensure the contractor is maintaining control over the work.
III.3.1.3 MHE Operators shall be licensed in accordance with ASG Camp Arifjan, Kuwait, standards implementing applicable OSHA regulations and able to operate various equipment from 4k up to and including 50k forklifts, scrap handlers, front-end loaders, and RTCH used at a DLA Disposition Services yard. The MHE will be provided by DLA Disposition Services Kuwait.
III.3.1.4 Contractor employees shall possess “good customer service skills,” including sufficient fluency in english to achieve the following: being able to greet the public, determine the customer requirements, provide customer service, and direct the customer to appropriate personnel.
PAGE 3 OF 48 PAGESCONTINUATION SHEET REFERENCE NO. OF DOCUMENT BEING CONTINUED:
SP4510-13-R-0002
III.3.1.5 The contractor shall ensure that all personnel meet security specifications and force protection requirements in accordance with DLA Disposition Services Kuwait security guidelines for entry and work conducted on the camp.
III.3.1.6 The contractor shall be in full compliance with all Kuwaiti labor and related laws.
III.3.1.7 The contractor shall be responsible for obtaining base access badges for all contractor employees (See Attachment 3, Installation Access and Vehicle Registration Policy).
III.3.1.8 The contractor shall be responsible for accountability of all their personnel working at DLA Disposition Services Kuwait; e.g., all employees are continuously accounted for and performing assigned duties.
III.3.1.9 The contractor is required to immediately report any breach of security by their employees to the Contracting Officer’s Representative (COR).
III.3.1.10 Hiring of Third Country Nationals is subject to review and approval by the security personnel at the host facility of DLA Disposition Services Kuwait.
III.3.1.11 A train-the-trainer approach will be used for contractor employee training. The Government will provide the initial on-the-job training to key employees and other selected employees in a classroom setting in Kuwait, as necessary, to fulfill the requirements of satisfying the performance requirements of Section III.6 and other applicable contract terms. Training to be conducted will include, but may not be limited to:
DEMIL classroom and Basic Operations. Further training of contractor personnel will be then performed by the contractor. The Government may provide further training on a case by case basis. The Government will also provide standard operating procedures as necessary to enable the contractor to perform the contract without relatively continuous supervision by the Government.
III.3.1.12 Transition. The first 45 days after the date of award is for transition to prepare the contractor for full performance. The contractor is responsible for providing viable operational capability within the initial 45 days. The site lead, all supervisors, and no less than 50-percent of the remaining proposed workforce shall be physically onsite to perform under the contract. The contractor will have 60 days’ total from the date of contract award to have all personnel performing onsite. The transition period is for the contractor to hire the workforce, obtain badges and access for contractor personnel to Camp Arifjan, and familiarize themselves with DLA Disposition Services Kuwait operations and the tasks they will be required to perform under the contract. During the transition period the contractor may observe or ‘shadow’ employees performing the tasks required under this contract. DLA Disposition Services Kuwait personnel will also be available to meet with the contractor as needed to prepare the contractor for full performance after the transition period. Unless otherwise agreed to by the Contracting Officer, the contractor will not be allowed to perform any of the tasks in III.6 for training purposes during transition. If the contractor is provided approval to perform III.6 tasks during this period, it will be at no additional cost to the Government.
III.3.1.13 Contractor Site Leaders, Supervisors, Customer Service Clerks, and Administrative Assistants shall have sufficient fluency in English to converse with other English speaking personnel and perform the tasks required to support DLA Disposition Services Kuwait.
III.3.1.14 Contractor on-site supervisors shall direct their workforce in the tasks they are required to perform under the contract and have authority to resolve performance issues that may arise during performance of this contract. These supervisors will be the point of contact for the CORs for ensuring work is being performed in accordance with the contract and shall be able to speak English and the language of the employees they are supervising.
III.3.2. SITE LEAD/CONTRACT MANAGER
III.3.2.1 The contractor shall assign a site lead, contract manager and an alternate contract manager to the contract. The contractor shall provide their names and telephone numbers to the COR. The site lead or
PAGE 4 OF 48 PAGESCONTINUATION SHEET REFERENCE NO. OF DOCUMENT BEING CONTINUED:
designated alternate must be available during DLA Disposition Services Kuwait hours of operation and return any calls made by the COR within one hour of the COR’s call. Therefore, the contractor must provide the COR with a means to leave a message with the site lead or their designated alternate requesting a return call.
III.3.2.2 The contract manager and alternate contract manager are not required to be situated at the DLA Disposition Services Kuwait facility. The contract manager and the alternate contract manager shall have full authority to act for the contractor on all contract matters relating to the operation of this contract; e.g., all contract arrangements and required coordination. The contractor agrees that notice by the US Government to the designated contract manager or alternate contract manager shall constitute notice to the contractor and agrees to be bound by any commitments or representations made by the employees so designated.
III.3.2.3 The contract manager and alternate contract manager must be able to read, write, speak, and understand English proficiently, as well as be able to actively participate in English conversations concerning technical issues associated with this contract. All correspondence related to this contract shall be in the English language. If the correspondence contains official documents in languages other than English, they shall be accompanied by an English language translation. Permits or extracts must also be translated. All costs incident thereto are the responsibility of the contractor and shall be borne by the contractor.
III.3.3 CONTRACTING OFFICER’S REPRESENTATIVE (COR)
III.3.3.1 The COR for this project will be appointed by the DLA Disposition Services Contracting Officer (CO) prior to commencement of performance. The COR is responsible for monitoring contractor performance, providing technical interpretation of the requirements of the contract and acts under the authority of the CO. In no event, however, shall any understanding or agreement, modification, change order, or other matter deviating from the terms of the subject contract between the contractor any person other than the CO be effective or binding upon the Government, unless formalized by proper contractual documents executed by the CO prior to completion of this contract. The COR will not interfere with the contractor’s rights and ability to properly perform contract requirements.
III.3.3.2 On all matters concerning changes to contract terms, the contractor shall contact the CO. When, in the opinion of the contractor, the COR requests effort outside the existing scope of the contract, the contractor shall promptly notify the CO in writing. The contractor shall take no action unless and until the CO advises the contractor to proceed and points out the requirement in the contract or the CO issues a contract modification to the contractor.
III.3.4 TRAVEL
Contractor personnel will not be required to travel outside the DLA Disposition Services Kuwait storage areas or immediate surrounding area to meet mission requirements. Except when directed from the contract manager/lead COR to operate MHE to move property from outside the perimeter fence into the facility or in other cases where the RTCH or other heavy equipment is required to load or move property or containers.
Another exception would be to assist with the disposal of excess property on Camp Arifjan when deemed more cost effective to the U.S. government to handle in place vice bringing it to our facility. In the event that such a requirement exists, the contractor (s) must be accompanied by an authorized U.S. government employee.
These travel restrictions are a result of security concerns regarding demil- and mutilation-required property and the role of Camp Arifjan, Kuwait as an AOR hub for military operations and the resultant consolidation of excess military equipment.
III.3.5 TRANSPORTATION
Transportation of the workers and associated costs will be the responsibility of the contractor.
III.3.6 WORK HOURS
DLA Disposition Services Kuwait is open every day of the year except on Fridays. This will require one shift
PAGE 5 OF 48 PAGESCONTINUATION SHEET REFERENCE NO. OF DOCUMENT BEING CONTINUED:
of 9 hour days with staggered 1-hour lunches that allow for continuous, uninterrupted operations. The contractor shift shall be 0700 – 1600. When the Government determines a requirement for additional personnel, then the Government will exercise the appropriate optional CLINS, surge clause, via issuance of a contract modification. Each one (1) month use of this CLIN is considered its own one (1) month option, with the Government having the unilateral right to issue a maximum of up to six (6) of these surge clause options during the applicable 12-month period of performance, though not necessarily on a continuous basis (e.g. it could be ordered in the second month of the period, then the fifth and sixth months, etc., provided not more than six (months) are exercised during the 12-month period). Under optional CLINs, the contractor shall provide additional personnel within 30 calendar days of the issuance of a contract modification stipulating the period of performance and hours for work to be performed. The Government will order the additional CLIN(s), if determined to be required by the Government, up to a total of 6 months during each period of performance.
Based upon current workload projections, experience at the site and skills required, the Government estimates that the following number of contractor personnel will be needed at DLA Disposition Services Kuwait performing the work as required by this PWS for the surge, if ordered:
24-Personnel: 2 Supervisors, 5 - Material Handling Equipment (MHE) Operators, 7 - Torch Cutters, 6 - Laborers, 2- Warehousemen, 2 – Receivers.
III.3.7 CELL PHONES/PAGERS/PERSONAL COMPUTERS
With permission of the COR and consistent with Government security requirements, the contract manager/alternate is permitted to have contractor-owned computers, pagers or cell phones on-site. Contract workers may with COR permission and consistent with Government security requirements have cell phones for safety/security reasons.
III.3.8 CLEANUP OF SPILLS OR LEAKS
III.3.8.1 The contractor is responsible for the clean-up of any and all spills or leaks during the performance of this contract in accordance with standard operating procedures (SOP) established by the host installation (SOP available at the DLA Disposition Services Kuwait office). DLA Disposition Services Kuwait will provide the necessary materials used to clean up and contain any spills or leaks identified by the contractor during performance. The contractor agrees to clean up such spills or leaks in a manner that complies with applicable Host installation and host country environmental and Safety laws and regulations, US Federal laws and regulations applicable to the Host installation, in-country, and local laws and regulations.

The contractor is responsible for reporting to the COR and CO all spills/leaks of special (or hazardous) wastes, regardless of quantity within. Spills/leaks shall be reported by telephone to the COR immediately following the incident and shall be followed with a written report to the CO no later than 3 calendar days after the telephonic report. When reporting a spill/leak the following information shall be furnished:
(i) Item spilled/leaked;
(ii) Quantity spilled/leaked;
(iii) Exact date, time, and location of spill/leak;
(iv) Initial actions taken and time actions were taken;

(vi) Persons contacted or present at the time of the spill/leaks.

However, should live AEDA be discovered, the contractor shall immediately take all necessary action for protection of personnel and property. III.7 ACCEPTABLE PERFORMANCE LEVELS (APLs)
Acceptable performance levels (APLs) are the minimum performance levels of specific requirements that the contractor must achieve or risks having the Government consider performance unsatisfactory, resulting in monetary consideration from the contractor. Specification of an acceptable performance level below 100% does not allow the contractor to knowingly provide defective service, but sometimes occurs unintentionally. As long as the performance does not fall below the specified acceptable level, the Government will not deduct for poor performance. However, the contractor shall be required to correct the defective service at no additional cost to the Government. All work required by the contract is subject to surveillance whether or not specifically identified. Performance incentives for the contractor shall include, but are not limited to:
favorable impact on option exercise decisions, and future awards for the same or similar requirements by DLA Disposition Services as well as other Government and non-Government entities that may review performance of this contract.
(See Attachement 1 for APLs)
III.8 PERFORMANCE EVALUATION
III.8.1 The Government will use a Quality Assurance Surveillance Plan (QASP) to monitor compliance with contract terms and conditions, identifying nonconforming services to determine appropriate action under FAR 52.212-4. This plan sets forth the method and manner by which the Government intends to conduct surveillance of work under the contract, and is subject to unilateral change by the Government without modification to the contract. All requirements of the contract are subject to surveillance whether or not specifically included in the plan.
III.8.2 The COR shall provide the Contracting Officer monthly performance reports within 20 calendar days after the end of the monthly payment period. The report must cover all contract requirements in relation to the APLs.

STANDARDS
III.9.1 This clause sets forth the performance evaluation and payment reduction process for performance at less than the APLs for specified standards. It implements FAR 52.212-4(a), Inspection/Acceptance (See IV.1).
Nothing in this clause prevents the Government from taking reductions for performance that does not meet APLs, pursuant to the authority set forth in FAR 52.212-4.
III.9.2 The APL chart contains the standards that are considered most critical to performance that will be inspected regularly at DLA Disposition Services Kuwait and will be subject to the price reductions of this clause. However, nothing in this clause relieves the contractor of the responsibility to comply with all requirements of the contract specified in the contract or should be construed as preventing the Government from taking administrative action to ensure performance complies with all contract requirements.
PAGE 12 OF 48 PAGESCONTINUATION SHEET REFERENCE NO. OF DOCUMENT BEING CONTINUED:
III.9.2.1 Government Quality Assurance. The Government will assess the contractor’s performance by comparing it to the applicable APLs as listed in III.7. This assessment will be accomplished on a monthly basis.
III.9.2.2 Performance Evaluation. The awarded contract pricing is the method of payment by the Government for the contractor to meet the requirements of the contract to include the levels of service within the specified APLs. For the APLs, a timeliness or quality error occurs when the contractor does not meet the specific standard. If the errors caused by the contractor’s performance results in noncompliance with a monthly APL contained in III.7 of this contract, the applicable price reductions listed in the APL chart will be invoked to compute the reduction of payment. The Government grants a one-time 1-month grace period after the 30-day transition before exercising this clause.
III.9.2.3 While the Government may accept a reduced level of services at a reduced price, doing so shall not impair the Government’s right to terminate for cause at any time. Any decision by the Contracting Officer to not enforce the payment reduction shall not be considered a waiver of the Government’s right to subsequently enforce the payment reduction clause or take such other administrative actions as may be deemed in the Government’s best interests.
