About this file

This is a Questions and Answers document for Solicitation SP450026R0007, a Defense Logistics Agency Request for Proposal for hazardous waste disposal services at United Kingdom military installations. The document addresses four key clarifications submitted by potential offerors regarding contract terms and submission requirements.

The Q&A clarifies that container exchange charges are governed by PWS Section 3.5.2 and CLINs 1144RE and 1145RE, with updated guidance provided in PWS V2. The government reserves the unilateral right to exercise the 30-month option period beyond the initial 30-month base term (September 2026 to March 2029) in accordance with FAR 52.217-9. The submission deadline for proposals has been extended to Wednesday, 15 May 2026 at 5:00 PM EDT. Regarding packaging specifications, the PWS permits the use of fully certified and UN-approved reconditioned PG2 containers as acceptable alternatives to new PG1 brand packaging, provided the Contracting Officer Representative and/or Generator approve their use. This flexibility allows contractors to potentially reduce costs while maintaining regulatory compliance for hazardous waste removal, transportation, and disposal operations involving RCRA and non-RCRA wastes, universal wastes, compressed gases, PCBs, and PFAS materials.

Solicitation SP450026R0007 Questions and Answers

1. In previous contracts the charge for container provision (drums and pallets, not skips and ROROs) has been included in the total charge (per kg) when exchanged. Looking at the latest Pricing Appendix, CLINS 1250SP - 1728SP look like the container supply is now separate and the contractor would be able to charge a fixed fee for ANY container supplied at any time whether new or on an exchanged basis, can you clarify how containers on exchange are to be charged?

Answer: Section 3.5.2 of the PWS has been updated to reflect the correct CLINs 1144RE and 1145RE for the container exchange process. An updated version of the PWS has been uploaded to the solicitation as document Attachment_01 PWS V2. Please refer to this section of the PWS and the Price Schedule description for CLINs 1144RE and 1145 RE.

2. Please can you also confirm that the extension of the contract beyond the initial 30-month term will be by mutual agreement of both parties?

Answer: Per FAR 52.217-9, the government reserves the unilateral right to exercise the contract option period via written notice, provided giving written preliminary notice of its intent to extend within the timeframe written in the clause. This notice does not formally commit the government to the extension.

3. There is a discrepancy regarding the tender submission date for contract SP450026R0007:

- SAM.gov: States that offers are due by May 6, 2026, at 5 PM EDT.

- Attachment 16: Indicates a due date of May 22, 2026.

Please could you confirm the correct submission deadline?

Answer: The submission deadline has been extended and will now close Wednesday, 15 May 2026 at 5:00 PM EDT. SAM.gov and Attachment 16 have been updated to reflect the extended deadline to provide adequate time to review the answers provided in this document.

4. The tender specifies PG1 brand new packaging throughout. Could you please clarify whether reconditioned PG2 containers would be acceptable where appropriate? Reconditioned containers are fully certificated and UN approved, and are legally suitable for the vast majority of collections of this type. Brand new drums can cost up to three times more, and accepting reconditioned packaging where suitable could save the organization tens of thousands of pounds.

Answer: In accordance with PWS section 3.19, where acceptable, fully certified and UN approved reconditioned containers can be accepted with approval from the COR and/or Generator.
