FAR 52.212-4 continued Key Points:

Quality / Performance Evaluation:

The Government will use a Quality Assurance Surveillance Plan (QASP) IAW FAR 46.401, to monitor compliance with contract T&Cs and to identify conforming and non-conforming services and supplies to determine appropriate action under the terms of the contract.

FAR 52.212-4 continued Key Points:

Quality / Performance Evaluation:

When the Contractor fails to meet the contract requirements and such nonconformance is the fault of the contractor, the COR may, at their discretion, document the performance issues and forward it to the Acquisition Specialist and KO who may issue a Memo of Situational Awareness (MoSA) or Letter of Concern (LOC).

MoSAs are issued as a warning letter to the contractor, making the contractor aware of the nonconformance and the Government’s concern. The expectation is the contractor will resolve the nonconformance and prevent future occurrences. In cases where the nonconformance is not resolved or occurs again, the Government may then issue the contractor a formal LOC.

LOCs are issued to the contractor for all critical nonconformances. LOCs may also be issued to the contractor for nonconformances that seriously impact the mission, program, contract administration, or Government; for repetitive nonconformances; and for other issues or concerns at the KOs discretion.

Government contract QA actions described above in no way limits the Government’s available contractual remedies for nonconformance under any other provisions of the contract.

FAR 52.212-4 continued Key Points:

Acceptable Performance Levels (APLs):

The Contractor is responsible for ensuring performance meets or exceeds the APLs in the PWS.

The Contractor is responsible for reporting APL metrics achieved every month in TE 4.3 – CDRL A003 – Monthly Status Report (MSR).

For missed APLs, the Contractor must provide analysis and information to the COR in TE 4.3 – CDRL A003 – MSR for the Government’s review. Information shall include root cause analysis, corrective actions, and mitigation plans to ensure the APLs return to the required level and future nonconformances are mitigated.

The Government will verify that the Contractor’s APL metrics achieved are the same as what the Government team is reporting as APLs achieved. When there is a discrepancy between the two, the Contracting team and Contractor will work to come to a timely consensus. When a consensus cannot be reached, the KO will have the final decision on the APL metrics achieved.

If the Contractor identifies APLs were not met due to circumstances outside the Contractor’s control, the Contractor shall include details and a request for consideration for the specific action(s) outside the contractor’s control to be removed from the APL calculation.

Late contractor requests will not be considered and the APL will be considered unmet.

FAR 52.212-4 continued Key Points:

Unmet APLs:

In accordance with FAR clause 52.246-4(e) Inspection of Services - Fixed Price, unmet (missed) monthly APLs cannot be corrected by reperformance. As a result, the Contracting Office may-

(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and

(2) Reduce the contract price to reflect the reduced value of the services performed.

Reduction to the contract price will be applied to either CLIN 0007 (Phase-In Services) or CLIN X001 as applicable.

Based on the consensus or KO final determination of the Contractor’s APL metrics achieved during the month, the Contracting Officer will issue a modification to reduce the CLIN price (X001 or 0007) appropriately.

FAR 52.212-4 continued Key Points:

Contractor Performance Assessment Reporting System (CPARS) Requirements:

The contractor, in performing this contract, will be subject to a past performance assessment in accordance with FAR 42.15 and the Contractor Performance Assessment Reporting System (CPARS) Guide.

FAR 52.212-4 continued Key Points:

Contractor Owned HM at Off-Base Facility:
