About this file
This document is a Justification for Other Than Full and Open Competition (J&A) for a Utility Energy Service Contract (UESC) between the Defense Logistics Agency (DLA) Energy and Kodiak Electric Association (KEA) for the United States Coast Guard (USCG) Base Kodiak in Alaska. The contract's primary objective is to develop and submit an Investment Grade Audit (IGA) to assist the USCG in energy conservation and resilience efforts, focusing on identifying potential energy savings and improvements across 743 facilities covering approximately 2,191,421 square feet.
KEA is the sole utility service provider for the Kodiak area, operating an isolated grid with renewable energy resources, primarily the Terror Lake Hydroelectric plant. The contract is a Firm Fixed Price (FFP) for a six-month performance period, funded by FY 2025 Operations and Maintenance funding. The procurement is exempt from full and open competition under FAR Part 6.302-1, as KEA is the only available utility provider in the designated service area. The IGA will provide comprehensive analysis including data collection, energy modeling, and cost-benefit analysis to support informed investment decisions for energy efficiency projects.

Justification for Other Than Full and Open Competition (Cont’d) Page 4 of 7
(SP0604-24-R-0423 – KODIAK ELECTRIC ASSOCIATION, INC.)
8. Description of the market research conducted and the results or a statement of the reason market research was not conducted (FAR 6.303-2(b)(8)):
Based on direct communications with USCG Base Kodiak by the Contract Specialist and Contracting Officer, Base Kodiak has one electricity provider and does not have a natural gas supplier. USCG Kodiak Base has its own wells and water treatment system and provides water and wastewater for the base. Although there is one facility on USCG Kodiak Base serviced by the City of Kodiak; that facility is not part of the proposed project. KEA is the only utility service provider for the designated are. Pursuant to FAR 41.204(c)(1), any Federal agency having a requirement for utility services within an area covered by an areawide contract shall acquire services under that areawide contract. The General Service Administration (GSA) administers the GSA areawide contracts and provides a list of the GSA areawide contracts. Per a search of GSA’s areawide public utility contracts dated 8 July 2024, no Utilities currently hold a GSA areawide contract covering Kodiak, Alaska. In consideration of the lack of a GSA areawide contract, and pursuant to FAR 41.205 noting that in the absence of an areawide contract agencies shall acquire utility services by separate contract, the Government identified that only one source is available.
On 26 July 2024, a letter of interest was sent to KEA seeking their company’s confirmation they can perform and are interested in performing the UESC. On 2 August 2024, KEA expressed an interest in performing the UESC at USCG Base Kodiak.
9. Any other facts supporting the use of other than full and open competition, such as (FAR 6.303-2(b)(9)):
(i) Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available.
In a UESC, it is the providing service utility who prepares the statement of work for the project. The Government depends on the utility’s technical and industry knowledge to propose and investigate appropriate ECMs to meet the goals of the USCG as stated in the Letter of Interest.
(ii) When 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived.
Not applicable.
(iii) When 6.302-2 is cited, estimated cost, or other rationale as to the extent and nature of the harm to the Government.
Not applicable.

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition (FAR 6.303-2(b)(10)):
Kodiak Electric Association, Inc. (KEA) is the only responsible source available. No other sources were contacted regarding this requirement.
11. Actions that may be taken to remove or overcome barriers to competition before any subsequent acquisition for the supplies or services are required (FAR 6.303-2(b)(11)):
As the sole servicing distribution utility provider, providing services to USCG Base Kodiak there are no known actions that will allow DLA Energy to overcome the competition barriers for this UESC requirement; however, DLA Energy will continue to monitor the utility landscape at Kodiak to determine whether additional utility providers become available in the future and will reassess competition prior to any new requirements.
