Amendment 0003
Question 1. None of the current overseas bulk fuel contracts fall under collective bargaining agreements. Should a union materialize subsequent to award, would the negotiated agreement be considered a change order as in the case in the United States?
ANSWER: The Service Contract Act does not apply overseas so that there is no mechanism for DLA Energy to adjust the price of the contract to reflect wage increases under a Collective Bargaining Agreement. Contractor would be responsible for complying with all applicable German Labor laws.
Question 2. Will the winning bidder be exempt from taxes during the period of performance?
ANSWER: The contractor would not be eligible for SOFA status under the SOFA agreements with the United Kingdom, NATO or Germany. This means that the contractor would be subject to host nation tax laws. The offerors should seek their own tax advice on the applicable tax laws in the host nation which might apply to the contractor's operations and personnel.
Question 3. Who will be responsible for the provision of Defense Base Act?
ANSWER: The Defense Base Act applies overseas and the contractor is required to carry the requisite workmen's compensation insurance on its employees.
