AMENDMENT 0002 Page 2 of 8
SP0600-11-R-0331
The combined synopsis/solicitation was amended (0001) on 28 Apr 11 to update the Performance Specification to Propellant Oxygen MIL-PRF-25508G dated 21 Nov 06.
This amendment 0002 provides Government responses to questions from industry, adds a line item for Non-Routine (emergency) Orders, adds the standard clause for detention, and replaces the Statement of Objectives in its entirety.
A. Questions from Industry:
1. Question: SOO 3.3. Changes or modifications to the delivery date and time of a commodity or the volume of commodity delivered may be made by the Ordering Officer no later than 6 hours in advance for launch and wet dress rehearsal (WDR) scrub replenishments, due to usage variability. Will the ordering officer be a ULA point of contact or a delegate from Propellants North or a DESC Inventory Specialist? Will that person be available after business hours to make the changes?
Government Response: The ordering officer will be a ULA POC or a designated person on-site at CCAFS, and yes, they will be available after hours.
2. Question: SOO 4.1. Products shall be supplied in Contractor provided tankers. Upon notification by the Government assigned Ordering Officer(s), the Contractor shall be required to fill, schedule product inspection, complete all support documentation, and deliver products within a specific timeframe as requested by the Ordering Officer to meet Customers unique schedule and usage demands on a 24 hour/365 day basis. It is essential that tankers arrive on site at the pre-scheduled time since tankers are generally off-loaded in groups of tankers. Where do the tankers report for check in?
Directly to Pad 37 or to Propellants North first?
Government Response: Tankers should check in at SLC 37 and security will hold them until ULA is ready to escort them to the storage facility.
3. Question: SOO 4.2.1. Contractor shall provide 10 each LOX tankers with a minimum delivery capacity of 214 TN every 24hrs, (1 set of 10 tanker deliveries per day). Are there no limitations on supply? For example, 10 tankers could be ordered every day for an indefinite period of time?
Government Response: Yes, there is a limit of 3 days (three attempts per WDR or launch). Orders will follow the schedule provided with some variations. The 24-hour turn-around capability is only needed during WDR or launch scenario. Maximum attempts in a row is limited to three.
4. Question: SOO 4.3. Delivery communications: Contractor shall provide a Point of Contact (POC) and one back up person to be available 24 hours/365 days for the delivery location. The customer launch site will have a designated communication person to communicate directly with the Contractor POC any schedule changes, cancellation, and any other changes that will affect the delivery of the product from the Contractor. The customer launch site communication person will be responsible for notifying the Contractor of any changes for non-WDR/Launch attempt operations prior to tanker departure from Contractor facility. For WDR/Launch attempt operations, the customer launch sites communications person will be responsible for notifying the Contractor within 12 hours of any changes. Contractor shall confirm schedule changes within 2 hours. Why is the notification requirement 12 hours here and 6 hours in section 3.3?
Government Response: Paragraph 3.3 is addressing product delivery schedules and quantities, while paragraph 4.3 is addressing changes to the WDR or Launch schedule.
5. Question: Why is there no CLIN for emergency orders (less than 48 hours.
Government Response: The CLIN for emergency orders (Non-Routine Orders) will be added to the RFP within this amendment. See Paragraph B below.
AMENDMENT 0002 Page 3 of 8
6. Question: Can you clarify when delay time begins? This will depend on where the tankers are required to check in; Cape Canaveral Security, Pad 37 or Propellants North - each has an impact on potential delay.
Government Response: Detention starts after the first 2 hours. The standard detention clause, INT-F3.10 is incorporated into the RFP as set forth below:
INT-F3.10 TRANSPORT TRUCK AND/OR TRUCK AND TRAILER FREE TIME AND DETENTION
RATES (F.O.B.
DESTINATION) (AEROSPACE ENERGY) (DESC DEC 2007)
(a) The Contractor shall be paid for detention beyond free time for delays caused by the Government. Free time will commence at the time the Contractor’s transport truck or truck and trailer arrives at the delivery destination (receiving tank identified in the contract) and will end when the carrier is released. For items involving multiple drops, time between drops will not be included in the free time.
The attached Form H-14, Transport Equipment Delay Certificate, shall be completed to show the date and time the carrier arrived and departed and the reason(s) for the delays. This form must be signed by both the driver and unloading personnel. A signed copy of this form must be sent to--
ATTN: DESC-MIC (INVOICE MONITOR)
1014 BILLY MITCHELL BLVD
SAN ANTONIO, TX 78226
(b) A minimum of two hours time is required by the Government. If Contractor free time is beyond two hours, indicate here: __________.
(c) The rate for detention shall be comparable to regulated tariffs governing the local area of the receiving activity. The rate for detention shall be stated by quarter hour.
(d) The above will not be considered in the evaluation of offers for award, except that free time of less than two hours or detention rates not comparable to regulated tariffs may render an offer unacceptable/bid nonresponsive.
(e) Detention Costs: Invoices for detention costs will be forwarded directly to the address stated above.
B. Add Non-Routine Orders CLIN:
CLIN 0006 is added as set forth below. Attached is a revised schedule, including CLIN 0006.
Offerors shall use the attached revised schedule for submission of proposals.
