CONTINUED FROM PAGE 1, BLOCK 14

This solicitation amendment is issued to make three changes in the solicitation which are detailed below:

A. Establish a cut off date of 27 JAN 2010 at 2:00 PM CST for receipt of questions from industry.

B. Remove the Attachment 1 that was included with the initial solicitation and replace it with the

Attachment 1 that is included with this Amendment.

C. Provide seven Industry Questions and nine Government Responses to all interested parties.

INDUSTRY QUESTION 1:

Are email proposals acceptable?

GOVERNMENT RESPONSE 1:

Yes. E-Mail proposals are acceptable. Details governing E-Mail proposals are provided in clause L2.11-4 on page 58 of the solicitation.

INDUSTRY QUESTION 2:

Which Schedule do we use?

GOVERNMENT RESPONSE 2:

Please use the schedule on pages 2 thru 20 of amendment 0001 when preparing your company’s proposal.

INDUSTRY QUESTION 3:

As a result of the government’s response to Industry Question 3 in amendment 0002, will DESC be posting a correction to Attachment 1 – Estimated Quantity By Type and Location, identifying Los Alamos Lab, New Mexico as a Western Non-BLM Delivery Location? Also, should requirements for this delivery location now fall under Group 5?

GOVERNMENT RESPONSE 3:

A new Attachment 1 is provided with this amendment 0004.

INDUSTRY QUESTION 4:

As a result of the government’s response to Industry Question 5 in amendment 0002, will DESC be posting a correction to Attachment 1 – Estimated Quantity By Type and Location, listing the CCP for Soto Cano as Cumberland PA since transportation to Soto Cano is from the East Coast? Also, do requirements for Soto Cano remain under Group 1?

GOVERNMENT RESPONSE 4:

A new Attachment 1 is provided with this amendment 0004.

AMENDMENT 0004 Page 3 of 4

INDUSTRY QUESTION 5:

Does the BLM Helium requirement (Groups 3, 4, & 6) require the helium for these CLINs be helium from the BLM source?

GOVERNMENT RESPONSE 5:

Yes. The helium requirement in Groups 3, 4, and 6 are considered major helium requirements, i.e. their quantity exceeds 200,000 SCF. Therefore, the helium must come from a BLM source.

INDUSTRY QUESTION 6:

Does the company have to be on the Federal Helium Supplier list (for BLM helium requirements)?

GOVERNMENT RESPONSE 6:

Yes. FAR Subpart 8.5, which implements the Helium Act, mandates that major helium requirements be purchased from Federal Helium Suppliers.

INDUSTRY QUESTION 7:

Can companies on the Federal Helium Supplier list also source helium from other sources in the United States?

GOVERNMENT RESPONSE 7:

A Federal Helium Supplier is defined as a private helium merchant who has an In-Kind Crude Helium Sales Contract with an effective date of January 1, 1998, or later, with BLM, and who has helium available for sale to (1) Federal agencies; or (2) Private helium purchasers for use in Federal Government contracts. Please see Paragraph 3 of the Important Notices to Offerors which states “only Federal Helium Supplier, as designated by BLM, will be eligible for award of BLM CLINS 0019, 0028, 0046, and the associated non-recurring services CLINS.”

An In-Kind Crude Helium Sales Contract is a written contract between BLM and a Federal Helium Supplier requiring that whenever a supplier sells a major helium requirement to a Federal agency or its contractors, the supplier must purchase a like amount of crude helium from BLM.

Further information regarding the BLM and Federal Helium Suppliers may be found in FAR Part 8.5 and the Code of Federal Regulations (CFR), Title 43, Section 3195. The CFR can be accessed electronically at http://ecfr.gpoaccess.gov/.

INDUSTRY QUESTION 8:

Are companies not on the Federal Helium Suppliers list prohibited from receiving a contract award for any BLM portion of the requirement?

GOVERNMENT RESPONSE 8:

Yes. Please see Paragraph 3 of the Important Notices to Offerors.

AMENDMENT 0004 Page 4 of 4

INDUSTRY QUESTION 9:

What is the service location for the western region? Where will gaseous helium cylinders be delivered?

GOVERNMENT RESPONSE 9:

The Government Owned gaseous helium cylinders, once filled with helium, will be shipped from the awardee’s facility to the CONUS locations detailed in Attachment 1 as revised in amendment 0004. The Government will deliver the product to the customers identified in Attachment 1.

INDUSTRY QUESTION 10:

Can you clarify if this RFP is soliciting:

a. the helium gas itself, or

b. the helium cylinder itself, or

c. The helium cylinder filled with the helium gas.

GOVERNMENT RESPONSE 10:

The government is soliciting the helium gas itself delivered FOB Origin into Government owned cylinders. The successful offeror will store government owned cylinders, perform associated services on the government-owned cylinders, and fill them with gaseous helium when orders are placed. Please see the Statement of Objectives (SOO) on pages 40 thru 45 of the solicitation. The SOO provides the best overview of the requirement.

INDUSTRY QUESTION 11:

Are partial proposals acceptable?

GOVERNMENT RESPONSE 11:

Yes. Offerors are encouraged to submit proposals for as many of the six groups as desired. Please see paragraph 2 of the Important Notices to Offerors.

INDUSTRY QUESTION 12:

Do contractors who submitted proposals before the solicitation was extended thru 5 Feb 10 have to resubmit?

GOVERNMENT RESPONSE 12:

No. Offerors who already submitted proposals have two choices. They may allow the proposal to stand as is, or they may revise it at any time up to the date and time specified for receipt of proposals (February 5, 2010 at 2:00 PM CST). Offerors, who submitted proposals prior to the extension and who choose to allow their proposals to stand as is, must provide email verification stating that their proposal stands as is.
