c. A sample of the gaseous nitrogen and gaseous oxygen shall be drawn from a sample port located as near the laser cutter as possible whenever a bulk liquid delivery is made. One copy of the Certificate of Analysis shall be provided to the end-use customer and one copy shall be sent to DESC-QT/QA within three days after the analysis of that sample. The analysis report shall be e-mailed to tech.prop@dla.mil or faxed to the attention of DESC-Q at (210) 925-8048.

3. DELIVERY OF PRODUCT: This contract calls for the uninterrupted delivery of GOX and GN2, 24 hours a day, 7 days a week to the point of use at two laser cutting systems. Delivery is FOB Destination at the meter interface in building 1C3 at Tobyhanna Army Depot. Product shall be delivered to the following address:

Tobyhanna Army Depot

11 Hap Arnold Blvd.

Tobyhanna, PA, 18466-5025

Building 1C3 (U Area)

4. TECHNICAL REQUIREMENTS: The Contractor shall furnish all equipment, materials and labor for a turnkey installation of a GOX and GN2 bulk delivery system on Tobyhanna Army Depot to provide 24 hour 7 day a week gas service for 2 each Strippit LVD Axel laser cutters; model AXEL 4020S linear with a 6000 watt laser cutter. The system shall be designed so that there is no interruption of gas service or any pressure fluctuation to the cutter machines at any time including when deliveries are being made of any bulk liquid products.

a. The piping and equipment shall be sized to provide 24 hour seven day a week uninterrupted gas service to two laser cutting machines (second to be installed at a later date). The contractor is responsible to verify gas consumption data by contacting the laser cutter equipment manufacturer (Strippit LVD Axel laser cutter; model AXEL 4020S linear with a 6000 watt laser cutter).

1) Base tank sizing on cutting .625 inch aluminum and cutting 1” carbon plate steel

2) Include nitrogen as the beam purge gas for tank sizing

3) Sized for a delivery cycle of three to four weeks

b. In areas where there is a high risk of damage to the piping there needs to be additional protection provided. The piping will start at chest level near the bulk tank farm and depending on the route will be raised overhead at a minimum of 10 feet along a roof line.

c. The system shall incorporate a safety shutoff system (E-stop) so that the gas supply can be shut off in case of an emergency. The E-stops are to be located on the fence line outside the tank area, inside the building where the piping penetrates the wall from the outside, where the piping enters the 1C3 area and at each laser cutter. The system shall also be equipped with an automatic shutoff which activates when an abnormally high gas flow is detected. For maintenance purposes, manual shutoff valves are to be incorporated into the system. These valves are especially important at the point of use for the maintenance of the laser cutters. The system equipment and installation is to meet or exceed all Occupational Safety and Health Administration (OSHA), National Fire Protection Association (NFPA), American Society of Mechanical Engineers (ASME), American National Standards Institute (ANSI) and other national and state standards for bulk Liquid Nitrogen (LN2) and liquid oxygen (LOX) storage systems, and GOX and GN2 bulk gas delivery systems. The Contractor shall use a non-petroleum base approved liquid oxygen compatible sealant between joints and install grounding points for the LOX storage tank in accordance with the above standards.

d. The Contractor shall own and maintain the tanks and any equipment associated with the system including the piping that transports the product to the point of use. The Contractor shall own and maintain the gaseous pipelines to the point of use until the end of the contract period when the pipelines shall revert to Government-ownership.

e. Tobyhanna Army Depot will own and maintain the concrete pads, lighting, fencing, railings, signage, and bollards after acceptance of the conversion facility.

f. Conversion facility acceptance will consist of inspection of the facility by the appointed Tobyhanna Contracting Officer’s Representative (COR) to determine that all physical, safety and environmental requirements specified herein have been met and it has been determined that the gaseous products being produced by the conversion facility meet specifications.

1) During the performance of this contract, the Contractor and the contractor-provided facility shall comply with all federal, state, county and Tobyhanna Army Depot rules, regulations, and management plans essential to performance on a Government installation. Directives and compliance are deemed essential for but not limited to environmental, security, fire, base safety, base access and transportation concerns as well as the physical requirements set forth in the contract. The appointed COR at Tobyhanna will provide guidance to the Contractor for applicability and access to essential directives as may become necessary during the performance of this contract. Directives and compliance are deemed essential for but not limited to environmental, security, fire, base access and transportation concerns.

2)(a) Immediately upon completion of the Contractor’s bulk gas delivery and liquid storage system, the Contractor shall draw samples in Hoke cylinders of both of gaseous oxygen (GOX) and gaseous nitrogen (GN2) from a sample port located on each pipeline as close to the laser cutter as possible. The sample shall be taken in accordance with CGA G-10.1 (Commodity Specification for Nitrogen) and MIL-PRF-25508G (Propellant Oxygen) and shall be sufficient in size to perform all required specifications tests identified in CGA G-10.1 for Type I, Grade L, Nitrogen Gas, and in MIL-PRF-25508G for Type I, Grade F, Oxygen Gas. The Contractor shall notify the Government prior to sampling the products in order to allow a Government representative to witness the sampling. The Contractor shall submit the samples to the following Government lab for specification testing:

AEROSPACE FUELS LABORATORY

HQ AFPET/PTPLA

2430 C STREET, BUILDING 70 AREA B

WRIGHT-PATTERSON AFB, OH 45433-7632

(b) All costs associated with meeting the sampling requirements and transporting samples to the assigned U.S. Government laboratory identified in paragraph (a) above shall be at the supplier’s expense.

(c) If the initial results meet contract requirements, the Government shall notify the Contractor that the product specifications of the contract have been met.

(d) However, if the initial sample fails to meet contract requirements, the Contractor may be authorized by the Contracting Officer to submit a second sample with analytical results, with a Government representative witnessing the sampling. If the resample fails a second time, the Contractor may be allowed to make necessary repairs, changes, modifications and/or other alterations to the Contractor’s bulk storage and delivery system in order to remedy the defects.

(e) If the Government authorizes the Contractor to modify the bulk gas storage and delivery system in the expectation of meeting contract quality requirements, in lieu of termination for cause, such efforts on the part of the Contractor will not result in equitable adjustment. Upon completion of the bulk storage and delivery system modification and/or adjustment of the Contractor’s process, the Contractor shall then prepare more samples. NONCONFORMING SUPPLIES AND SERVICES (DESC JAN 2004)

(a) The Government may, at its discretion, accept nonconforming supplies or services. In such cases, the Contractor must obtain a deviation or waiver from the Contracting Officer prior to acceptance.

(b) The following procedures shall be used to request a deviation or waiver to the applicable nonconformance(s). A deviation is a request by a Contractor to deviate from the contract requirements after contract award, but prior to initial production of each product (for the duration of the contract). A waiver is a request by a Contractor to deviate from the contract requirements after initial production or each product (on a case-by-case basis or for a set period).

(1) Requests for deviations and waivers shall be submitted by the Contractor to the Contracting Officer with a copy to the Quality Representative (QR). Each request shall provide the following information: Contractor name; contract number; contract line item and product, if applicable; clause number, paragraph and subparagraph, as appropriate; the nature of the request; the reason for the request; the corrective action being taken by the Contractor to correct and prevent recurrence of the condition(s) causing the nonconformance; and equitable price adjustment offered over the administrative fee. In extraordinary situations, the Contractor may initially submit the request for a waiver, not a deviation, through the cognizant QR to the Contracting Officer or the Contracting Officer's Representative (COR) in the Quality Operations Division (DESC-BQ) of the Defense Energy Support Center (DESC). Extraordinary situation requests shall be submitted formally to the Contracting Officer prior to close of business of the next normal DESC workday (0800 to 1630 hours EST, Monday through Friday, Federal Holidays excluded). As used in this clause, the term extraordinary situation means the matter cannot await resolution until the next normal DESC workday. In addition, if either the Contracting Officer or the COR cannot be reached, the Duty Officer shall be contacted and provided the necessary information to forward to the proper individuals as soon as possible. The Duty Officer's telephone number is (800) 286-7633 or (703) 767-8420; (DSN) 427-8420.

(2) If a deviation or waiver is granted, the contract will be modified to provide an equitable price reduction or other adequate consideration commensurate with the deviation or waiver being granted. If the situation dictates, a deviation or waiver may be granted without prior agreement on price adjustment or other consideration subject to agreement by the Contractor, or its representative, to subsequent negotiation. Such agreement shall be documented on the receiving document or other appropriate correspondence. After negotiations, failure to agree on adequate consideration shall be a dispute concerning a question of fact within the meaning of the Disputes paragraph of the CONTRACT TERMS AND CONDITIONS – COMMERCIAL ITEMS clause of this contract.

(3) If a deviation or waiver is granted and the nonconforming supplies are accepted, then in no event will consideration be less than $250 to cover administrative costs, plus any additional cost of Government reinspection or retest, if necessary.

(4) If a deviation or waiver is granted modifying this contract but the supplies accepted are subsequently determined to be in conformity with contract specifications, the Contractor shall still be obligated to pay the consideration originally agreed upon in support of the deviation or waiver. If, however, this consideration exceeds $500, a second contract modification shall be issued reducing the Contractor's obligation to $500 (the administrative cost of issuing the two required modifications).

(c) When notification of nonconforming supplies is received after the supplies have been accepted, and the Government determines not to exercise its right to reject or to require correction under the INSPECTION OF SUPPLIES – FIXED-PRICE, INSPECTION AND ACCEPTANCE OF SUPPLIES (SHIPS’ BUNKERS), or CONTRACT TERMS AND CONDITIONS – COMMERCIAL ITEMS clause, then in no event will consideration be less than $250 to cover administrative costs. This $250 fee is in addition to—

(1) Consideration commensurate with the extent of nonconforming supplies; and

(2) Cost of Government reinspection or retest, if necessary.

The administrative fee will apply to each claim letter issued for off-specification product delivered to an activity.

(d) Contractors shall be held responsible for payment of any fines or penalties imposed on a receiving activity by an environmental enforcement agency, resulting from the delivery of nonconforming supplies under a DESC contract.

(e) Repeated tender of nonconforming supplies or services, including those with only minor defects, will be discouraged by appropriate actions, including, but not limited to rejecting the supplies or services whenever feasible and documenting the Contractor's performance records.
