Instructions to Offerors
IAW FAR 52.212-1(g) Contract award. The Government intends to evaluate offers and award a contract without interchanges with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct interchanges if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest technically acceptable offer; and waive informalities and minor irregularities in offers received.
In accordance with FAR 13.106-2(b)(4)(ii), The Government reserves the right to make an award to other than the low-priced firm if the superior technical solution, or the solution indicating a reduced performance risk based on past performance and/or experience, warrants paying a premium. The Government’s objective is to obtain the highest technical quality considered necessary to achieve the project objectives, with a fair and reasonable price.
Non-price evaluation factors are more important than price. As non-price factors equalize, price will become a more important factor in selecting the offer most advantageous to the Government. Each firm should recognize that its initial price and technical quote may be used as the sole and final basis for award and should quote accordingly.

52.212-2 Evaluation—Commercial Products and Commercial Services.
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Technical (Acceptable or Unacceptable)
Past Performance
Price
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
ADDENDUM
BASIS FOR AWARD: The evaluation process shall determine the most advantageous offer based on technical acceptability, past performance, and price in that order of significance. The offeror must pass the technical evaluation to be considered for the award. Secondly, the offeror’s past performance will be evaluated based on recent and relevant experience. Finally, the offeror’s price will be considered.
Evaluation Criteria: Evaluation criteria consists of factors and subfactors. Each proposal will be evaluated against three evaluation factors: Technical, Past Performance, and Price.
1. Factor 1: Technical. Initially, the Government’s Technical Evaluation Team shall evaluate each offeror’s technical approach on a pass/fail basis, assigning ratings of Acceptable or Unacceptable. Each proposal shall be evaluated against the following subfactors:
Subfactor 1: CONDUCT WASTEWATER TREATMENT PLANT OPERATIONS. Wastewater treatment facility operations shall be conducted in order to provide continuous, cost-effective treatment of all wastewater delivered to the facilities. The contractor shall be responsible for ensuring that both treatment plants (main Shaw AFB and Wateree) are properly operated in accordance with state and federal law as well as SC DHEC-issued NPDES permits at all times. The contractor must ensure that at least one certified operator is always on site and available at the main Shaw AFB facilities. Thus, the main Shaw AFB wastewater treatment plant facilities will be manned 24 hours per day, 7 days per week, 365 days a year including holidays (i.e. at no time shall the main Shaw AFB facilities be left unmanned).
Wastewater Treatment Plant operations shall include general operation of plant equipment, valves and piping, sampling and lab analyses, waste and effluent disposal, and other related services. The areas around all equipment shall be maintained free of oil, grease, dirt, and other debris at all times. All electrical maintenance and repairs must be performed in accordance with NFPA 70, the National Electrical Code. The contractor shall replace or repair items not functioning properly or needing repair. This must be conducted in a timely manner considering the complexity of the repair and the normal lead time for obtaining replacement parts/equipment and/or specialized technician/sub-contractor support required.
The contractor shall be responsible for all maintenance and problems that may arise due to spikes in customer facility operations and effluent discharge practices shall comply with all applicable federal and state regulations, including the National Pollution Discharge Elimination System (NPDES) permit requirements. The contractor’s staff must be trained regarding confined space entry requirements. The contractor shall coordinate with the Shaw AFB Fire Department to obtain confined space entry permits.
Subfactor 2: SAMPLING AND LABORATORY ANALYSIS. The contractor shall provide sampling and laboratory analytical services for process control and to support base civil engineer and regulatory agency operating and sampling requirements. Such sampling and testing procedures shall be accomplished in accordance with applicable operating permit requirements and conditions and as directed by the base civil engineer. Unless otherwise directed, all sampling and laboratory analyses shall be accomplished as described in 40 CFR l36 (Code of Federal Regulations) and South Carolina Department of Health and Environmental Control (SCDHEC) Regulation 61-9 (NPDES Permits).
Maintain a complete set of laboratory records for all laboratory analyses to include: date and time of sampling, type of sample, name of sample, location of sample, test performed, test results and analytical method used. Assemble results of the laboratory analyses and complete the paper version of the monthly Discharge Monitoring Reports (DMR) to conform to the procedures and requirements of the NPDES permit. Deliver the DMR and supporting data including AF 1462 (Water Pollution Control Utility Operating Logs) for each WWTP to the 20 Civil Engineering Squadron Water Program Manager no later than (NLT) the 20th of each month for submittal to the SCDHEC. The Water Program Manager must submit the DMR to the SCDHEC on or before the 28th of each month. (SC Regulation 61-9 and 40 CFR 122).
Subfactor 3: WASTEWATER LIFT STATIONS. The contractor shall operate and maintain the wastewater Lift Stations in proper operational condition at all times. Maps, as-built plans, and records shall be kept up-to-date by the contractor and shall indicate all preventive and lift station repairs performed. A list of the Lift Stations is included in Appendix A.
Subfactor 4: PREVENTIVE MAINTENANCE (PMP) PROGRAM. The contractor shall implement a preventive maintenance inspection program to help prevent and correct deficiencies with equipment items, minimizing breakdowns and service interruptions, extending component service life, and maximizing operating efficiency. The contractor’s PMI plan shall include inspections and services of lubrication, minor adjustment, and minor repair of components. A completed PMP plan shall be submitted to the contracting officer (CO) for approval within 30 calendar days after contract award. This plan shall include a 52 consecutive week schedule indicating specific maintenance/inspection items to be accomplished. At the end of each year, each equipment item within every system included in this contract will have been addressed. The PMP is to be established based upon manufacturers' recommendations, handbooks, operation and maintenance manuals, contractor expertise, and general engineering judgments. The submitted plan shall include equipment components to be inspected and maintained, inspection and maintenance techniques, inspection and maintenance frequencies, and reporting methodology. The contractor shall update schedules as necessary to reflect any changes in equipment inventory.
Subfactor 5: ENVIRONMENTAL COMPLIANCE. The Shaw AFB Environmental Requirements are in Appendix D. The Government will provide local information on Shaw AFB Environmental Protection and Environmental Management System (EMS). Contractor must comply with all safety requirements and regulations when removing hazardous materials. The contractor is responsible for any permit or fees associated with the use of off-base disposal locations.
Subfactor 6: SLUDGE. The contractor is responsible for drawing digested sludge from holding tanks into a tank truck and transporting it to the Pocotaligo Wastewater Treatment Facility, per Shaw AFB NPDES Permit. The contractor is responsible for coordinating disposal times. The contractor is responsible for properly completing a “Load Verification Form” for each load and entering the correct number of gallons of sludge to be disposed of. The contractor shall verify the volume and /or sample the load content. Contractor must maintain and make available to the Government, a copy of the load verification form. Sludge generated at the Wateree Recreational Wastewater Treatment Plant shall be transported back to Shaw Air Force Base for complete digestion prior to transporting to the City of Sumter’s Pocotaligo Wastewater Treatment Facility for disposal.
Subfactor 7: GRIT AND SCREENINGS. After drying, grit and screenings shall be put into contractor provided containers and disposed of at an appropriate landfill site as specified in the NPDES permit.
Subfactor 8: EMERGENCY SERVICES. Upon Government notification, the contractor on-site at main Shaw AFB must respond immediately to emergencies and begin corrective actions. Additionally, the contractor must be able to respond to emergencies and begin corrective actions at the Wateree facilities within one hour of receiving notification from the government. Emergency services are defined as an unforeseen occurrence, a sudden and urgent occasion(s) for action. These situations require quick action and sound judgment. For purposes of this PWS, an emergency situation is defined as any condition that requires immediate action to eliminate life threatening hazards or other hazards representing risks of serious injury to personnel; or damage to Government property; to restore essential services; prevent violation of discharge permit or a violation of the permit.
2. Factor 2: Past Performance. Provide a list of similar projects completed by your firm over the past three years.
Include a brief description of the requirement, dollar amount, year completed, and project owner information (name, phone, and email). The Contracting Officer shall seek recent and relevant past performance information based on (1) the past efforts provided by the offeror and (2) data independently obtained from other Government and commercial sources. Relevant past performance evaluation is to allow the Government to assess the offeror’s ability to perform the effort described in the solicitation, based on the offeror’s demonstrated present and past performance. The evaluation shall consider the quality and extent of the offeror’s performance with the same or similar size and scope to the requirements of this solicitation.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/ unacceptability, “unknown” shall be considered “acceptable.” Past Performance will be rated on an “acceptable” or unacceptable” basis. The offer’s proposal must be rated “Acceptable” in order to be eligible for award.
3. Factor 3: Price. The Government shall evaluate all technically acceptable offers by price, including option prices. An offeror’s proposed prices will be determined by multiplying the quantities identified in Section B by the proposed unit price for each Contract Line-Item Number or Subcontract Line-Item Number to confirm the extended amount for each. Copies of the Pricing Schedule will be necessary to submit a proposal for each Option Year.
Price will be evaluated in order to determine if it is fair, reasonable and balanced. Offers should be sufficiently detailed to demonstrate their reasonableness.
Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The total evaluated price will consist of the sum of all Contract Line Items for base year and option years. Offerors shall include pricing IAW FAR 52.17-8 Option to Extend Services, for a maximum of a six-month period.
Note: Offerors shall not change pricing for the Cost Reimbursable contract line items. The reimbursable amounts have been established by the Government based on historical need and funding amounts available. The cost reimbursable amounts will be calculated/evaluated toward the TEP on all proposals.
Note: Evaluation of options shall not obligate the Government to exercise the option(s).
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
The Government intends to award a contract without discussions with respective offerors. The Government, however, reserves the right to conduct discussions, if deemed in its best interest.
