Part 1

General Information

1. General: This is a non-personal service(s) contract under which the personnel rendering the service(s) are not subject, either by the contract’s terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees.

1.1 Description of Services/Introduction: This is a non-personal service(s) contract to provide a Laser Induced

Fluorescence (LIF) System capable of mounting to the USACE owned drilling equipment, either the Vertek CPT system or the Geoprobe DPT System.

1.2 Background: The US Army Corps of Engineers is conducting a Light Nonaqueous Phase Liquid (LNAPL) investigation at the Petroleum Oil and Lubricant (POL) Facility located at the McEntire Joint National Guard Base located in Eastover, Richland County South Carolina. The goal of the investigation is to accurately delineate the horizontal and vertical extent of the LNAPL contamination in the subsurface. Figure 1 is a map showing the site location. Figure 2 is a map of the POL site showing the estimated extent of the LNAPL based on the existing site wells.

1.3 Scope: The Contractor shall provide non-personal service(s). The Contractor shall provide a Laser Induced

Fluorescence (LIF) System capable of mounting to the USACE owned drilling equipment, either the Vertek CPT system or the Geoprobe DPT System. The contractor will provide all necessary equipment and personnel to collect and interpret LIF results in real time allowing for identifying step out locations and informing drilling depths and locations for delineating LNAPL. Upon completion of the investigation the contractor will provide a detailed report of the LIF data including logs of the collected data, technology descriptions, data interpretation. The logs will also include lifetime and wavelength information as well as cluster plots of the collected data.

1.4 Objectives: The goal of the investigation is to accurately delineate the horizontal and vertical extent of the

LNAPL contamination in the subsurface.

1.5 General Information: All drilling operations will be conducted by US Army Corps of Engineers drill crews and the site Geologist. USACE will be responsible for marking and clearing all utilities and obtaining all required drilling permits prior to initiating investigation activities. Initial LIF borings will be located in areas of known

LNAPL contamination. Step out locations will be based on a grid in all directions and on the real time results of the

LIF data. Borings are anticipated to extend approximately 50 feet below ground surface but may change based on the results of the LIF data. During the field investigation the contractor personnel will work closely with the site geologist and drill crew to provide LIF results and data interpretation to allow the team to make decisions on drilling locations and depths.

The LIF equipment use and personnel is anticipated to be required for 7 days plus mobilization. The contractor will only be paid based on number of days used since the overall number of days (7) are estimated based on the current customer needs. Customer needs may change during the course of the project based on drilling data.

Subsurface soils within the POL facility at McEntire JNGB consist mostly of sand, clay and silt with a lesser amount of gravel. Review of the geologic logs (Trinity, 2014) indicate that the upper 3 to 4 feet of soil is predominantly fill material consisting of well graded medium to coarse grained sand with silt and gravel. Below this layer, extending to approximately 20 feet below ground surface (bgs), is a well‐graded, dark reddish brown, sandy clay and clayey sand, mostly medium to coarse and angular to sub‐rounded, which transitions into a more silty sand to a depth of approximately 25 feet bgs. A poorly graded, medium to coarse grained sand with some clay and gravel beds is present from 25 to 35 feet bgs followed by approximately 5 feet of light gray silt with a high percentage of mica.

Below 40 feet there are wet poorly graded fine to coarse grained silty sand with silt layers ranging 1 to 7 feet thick.

Groundwater depth varies from 40 to 50 feet below ground surface. The terrain is level and finished with maintained lawn/grass.

SERVICES (NOV 2023)

(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post-acceptance rights-

(1) Within a reasonable time after the defect was discovered or should have been discovered; and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(b) Assignment. The Contractor or its assignee may assign its rights to receive payment due as a result of performance of this contract to a bank, trust company, or other financing institution, including any Federal lending agency in accordance with the Assignment of Claims Act (31 U.S.C. 3727). However, when a third party makes payment (e.g., use of the Governmentwide commercial purchase card), the Contractor may not assign its rights to receive payment under this contract.

(c) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties.

(d) Disputes. This contract is subject to 41 U.S.C. chapter 71, Contract Disputes. (FAR) 52.233-1, Disputes, which is incorporated herein by reference. The Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract.

(e) Definitions. The clause at FAR 52.202-1, Definitions, is incorporated herein by reference.

(f) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the

Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.

Government bill of lading;

Management, or 52.232-34, Payment by Electronic

Funds Transfer--Other Than System for Award Management), or applicable agency procedures.

(see 32.607-2).
