-Bid Bond - The amount of the bid guarantee shall be 20 percent (20%) of the bid price or $3 Million, whichever is less. Bid Bonds (SF24) must be accompanied by a Power of Attorney containing an original or electronic signature from the surety, which must be affixed to the Power of Attorney after the Power of Attorney has been generated. Computer generated and signed Powers of Attorney will be accepted if accompanied by a certification from a current officer of the surety attesting to its authenticity and continuing validity.

1. GENERAL INFORMATION

Competition for this solicitation is set aside for all eligible 8(a) firms ONLY.

2. GENERAL DESCRIPTION OF WORK

The Special Projects Branch of the Seattle District Contracting Division, U.S. Army Corps of Engineers (hereinafter known as Seattle District or the Government) has a competitive requirement for a Firm Fixed Price (FFP) contract to Repair Ghost DFAC (Building 3757), located on Joint Base Lewis-McChord, Lewis-Main, WA in accordance with the contract, contract specifications, Statement of Work (SOW), and identified drawings. This requirement will be solicited via an Invitation for Bid

(IFB).

3. COPIES OF SOLICITATION DOCUMENT AND AMENDMENTS

Copies of the IFB and any amendments are available by INTERNET ACCESS ONLY. The Government will post all IFB documents to the U.S. Government's Contract Opportunities website at: https://SAM.gov under Solicitation Number W912DW25BA013. A list of interested vendors (potential offerors and subcontractors) is available on the web site (registration required) with the solicitation announcement.

4. BIDDER TECHNICAL QUESTIONS AND COMMENTS

All inquiries regarding this IFB are to be submitted via ProjNet. The Government will not accept telephone and email inquiries.

ProjNet is a web- based program that allows bidders to post questions regarding the solicitation and to view all questions by other bidders and answers by USACE. Bidders can access ProjNet at https://www.projnet.org.

5. SMALL BUSINESS SIZE STANDARD/NAICS CODE

The North American Industry Classification System (NAICS) code for this acquisition is 236220 - Commercial and Institutional Building Construction; Small Business Size Standard, with a small business size standard of $45M.

6. BID EXPENSES AND PRE-CONTRACT COSTS

The issuance of this Invitation for Bid (IFB) does not commit the Government to pay, as a direct charge, any costs incurred in the preparation and submission of the Contractor's bid.

7. PRE-BID CONFERENCE AND SITE VISIT (FAR 52.236-27)

The Government will conduct a one-time pre-bid conference and site visit for this solicitation at Building 3757 (Ghost Warrior Restaurant DFAC), Joint Base Lewis-McChord (JBLM), Washington, on August 21, 2025, at 1:00PM local time. Building 3757 is generally located south of Grey Army Airfield on JBLM. From the JBLM Visitors Center, proceed south on 41st Division Drive. Turn left/east onto Stryker Avenue, then turn right/south onto S. 17th Street. S. 17th Street will dead end into the parking lot for the Ghost Warrior Restaurant (Building 3757). The site visit will begin on the northeast side of Building 3757.

The Site Visit will be held immediately following the pre-bid conference. The Government will not be providing transportation to the site visit location. Bidders are urged to inspect the site where construction is to be performed and to satisfy themselves as to the general and local conditions which may affect the price of performance of the contract, to the extent such information is reasonably obtainable. In no event will a failure to inspect the site constitute grounds for withdrawal of a bid after opening or for a claim after award of the contract. Attendance at the site-visit or pre-bid conference is not mandatory.

8. BASE ACCESS

Joint Base Lewis-McChord (JBLM) is a controlled access installation. For current information regarding JBLM Visitor and Gate Information, please visit the following website https://home.army.mil/lewis-mcchord/about/Directorates- support-offices /directorate-emergency-services/provost-marshal/gate-information.

If a conference attendee/bidder does not already have access to JBLM, a temporary 1-day vehicle pass is required to drive on Joint Base Lewis- McChord (JBLM).

Vehicles entering Joint Base Lewis-McChord are required to have either an adult authorized ID cardholder in the vehicle or an authorized visitor pass. To obtain the pass, the vehicle operator must process at a visitor center and present the following: A valid vehicle registration, proof of current vehicle insurance, valid driver's license. In the case of a rental vehicle, attendee must have rental agreement. The Lewis-Main Visitor Control Center (VCC) is located on Exit 120 off I-5 near Liberty Gate (Lewis- Main) and is open from 5 a.m. to 10 p.m., daily. Visitor Passes will be issued to all non-DoD persons with a valid reason for entering the installation. A visitor pass can be issued for up to 90 days for all non-DoD personnel. A security-vetting process will be completed on each non-DoD individual prior to receiving a visitor pass. This includes all non-DoD passengers riding in a non-DoD person's vehicle. In addition to providing passes for non-affiliated visitors to JBLM, the Visitor Control Center also conducts Automated Installation Entry registration, weapons registration, and vehicle registration. During the hours that the VCC is closed, visitors should proceed to Liberty Gate for processing.

The McChord Field Visitor Control Center (VCC) is located on Exit 125 off I-5 near McChord Field Gate and is open 6:00 a.m.

to 7:30 p.m. daily. This VCC also provides passes for non-affiliated visitors to JBLM.

Other gates available will be the Dupont Gate at exit 119 and the MAMC gate located at Exit 122 (Berkley Street). Gate personnel can direct you to Pendleton Ave. Access these gates AFTER you have received your pass as described earlier in the previous paragraph.

Real ID Act of 2005. Joint Base Lewis-McChord is fully enforcing the provisions of the Real ID Act of 2005. Under provisions of this act, driver's license and ID cards from certain states and territories are not valid for unescorted access to JBLM. The Department of Homeland Security website provides information on the status of each state and territory (https://www.tsa.gov /real-id). The USACE will not provide escorts. Bidders/site visit attendees should consider processing times at the Visit Control Centers, and gate entry times, when planning for its site visit attendance/bid submittal.

9. BID SUBMITTALS

BIDS OR MODIFICATIONS TO BIDS THAT ARE RECEIVED BY FACSIMILE OR ELECTRONIC MEANS, INCLUDING E-MAIL, WILL NOT BE CONSIDERED. All Sealed Bids must be submitted in accordance with the procedures set forth in Block 13 of Page One (1) of the Standard Form 1442, Solicitation Document, and comply with all other instructions provided herein. Due to system limitations, we are unable to include the correct address for the delivery of bids on the SF 1442. For delivery, either by hand or by mail, please see Section 10 below for delivery instructions.

Bidders are required to acknowledge the receipt of all amendments to the Solicitation on the Standard Form 1442 in the space provided, by completing Blocks 8 and 15 of the Amendment (Standard Form 30) or by separate letter prior to opening of bids.

Amendments: Ensure that you have acknowledged receipt of ALL amendments to the solicitation on the Standard Form SF1442, Page 2, Item 19, Acknowledgement of Amendments.

Represent the Unit Price and Amount with two decimal positions only. Example: $5.00, not $5 or $5.00123. Ensure the SF 1442 is signed.

Bid Acceptance Period: The minimum bid acceptance period is specified in Block 13D of the SF1442, Solicitation, Offer and Award.

10. PUBLIC BID OPENING

The public bid opening will take place in the Dallas Conference Room, Room #140 on the first floor of Building 2015, JBLM, WA, at the time and date specified in Block 13 of the SF1442.

SEALED BIDS: Regardless of the method of delivery (mailed or handcarried), bids and all other documents called out in the Solicitation shall be enclosed and sealed in an envelope that is clearly marked "Bid" and shall include the assigned Solicitation Number, and the Bid Opening Date and Time.

MAILED BIDS: It is the responsibility of each bidder to ensure that its Sealed Bid is received by the Seattle District's- USACE Contracting, Special Projects Branch, prior to the date and time set for the opening of the bids - See Block 13A of Page One (1) of the Solicitation. Mail bids to:

HANDCARRIED BIDS DELIVERED PRIOR TO THE DAY OF THE BID OPENING: For bids being handcarried and delivered prior to the date and time prescribed for the public bid opening, bring bids to Room 342 on the third floor of Building 2015.

Follow base access procedures as prescribed in section 8 above and allow additional time to process through the Vehicle Control Center located on Lewis-Main.

11. GOVERNMENT SECURITY REQUIREMENTS

Bidder(s) must ensure that ALL mail sent to the Seattle District, U.S. Army Corps of Engineers, either pre-contract or post-contract award, has a return mailing address on the outside of the envelope, package, box, etc. ANY MAIL addressed to the U.S.

Army Corps of Engineers, including but not limited to bids, modifications to bids, proposals, revised proposals, bonds, correspondence, etc., will be REJECTED by the US Army Corps of Engineers personnel, if it does not contain a return mailing address. There will be no exceptions.

12. ACCURACY IN BIDS

Bids must set forth full, accurate, and complete information as required by this solicitation, (including attachments). The penalty for making false statements is prescribed in 18 U.S.C. 1001.

13. MAGNITUDE OF CONSTRUCTION

The Magnitude of Construction for this project is between $5,000,000 and $10,000,000.

14. JOINT VENTURE BID REQUIREMENTS

When proposing as a Joint Venture, all members of the Joint Venture shall sign the SF 1442, Corporate Certificate, and the Bid Bond unless a written agreement by the Joint Venture is furnished to the Government with the firm's bid designating one firm with the authority to bind the other member(s) of the Joint Venture. In addition, the Joint Venture shall submit a copy of its Joint Venture Agreement with its bid. Failure to comply with the foregoing requirements may eliminate the contractor's bid from further consideration.

The following requirements for Joint Ventures are as follows:

a. Provide the complete names, addresses, phone numbers and email addresses of all firms in the joint venture.

b. Signature requirements: SF 1442, SOLICITATION, OFFER, AND AWARD, Block 20 requires that the name and title of the person authorized to sign the Bid for the Joint Venture be provided.

c. In addition to the requirements stated above, and to assure a single point of contact for resolution of contractual matters and payments, submit a certificate signed by each participant in the Joint Venture that includes the following statement:

"The parties hereto expressly understand and agree as follows:

a. (Name, title, and company) is the principal representative of the joint venture. As such, all communications regarding the administration of the Contract and the performance of the work there under may be directed to him or her. In the absence of (same name, title, and company), (enter name, title, and company of alternate) is the alternate principal representative of the joint venture.

b. Direction, approvals, required notices, and all other communications from the Government to the joint venture, including transmittal of payments by the Government, shall be directed to (enter name, title, and company of principal), principal representative of the joint venture."

The bid bond form, Block "Principal" requires that the name and title of the person authorized to sign for the joint venture be included.

15. SYSTEM FOR AWARD MANAGEMENT (SAM)

In accordance with FAR 4.1102, bidders, including those that are a Joint Venture, are required to be registered in SAM at the time they submit their bid. If the bidder is not registered in the SAM database at the time it submits its bid, the Contracting Officer will proceed to award to the next otherwise successful registered bidder. Bidders may obtain information on registration and annual confirmation requirements via the internet at http://www.sam.gov. Bidder's SAM registration must be current at the time of award.

16. BASIS OF AWARD

The Government anticipates awarding a Single Award Firm Fixed Price (FFP) Contract as a result of this IFB in accordance with FAR Part 14.408-1 (a)(3). The contracting officer will make a contract award to that responsive and responsible bidder whose bid conforms to the requirements of this IFB and is found to be the most advantageous to the Government, considering only price and the price related factors included in the solicitation. For purposes of evaluation, the Government will add the price for the Base Contract Line Items (CLINs) to develop the total price of the proposal, no options CLINs are associated with this requirement.

Per FAR Clause 52.232-18 - Availability of Funds (APR 1984), funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purpose can be made. The bidder shall furnish a bid guarantee in the form of a firm commitment, bid bond supported by good and sufficient surety or sureties (b) e.g., acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds-

To unsuccessful bidders as soon as practicable after the opening of bids; and(1)

To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as (2) required by the bid as accepted.

The amount of the bid guarantee shall be percent of the bid price or whichever is less.(c) 20 $3,000,000.00

If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual (d) documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.

In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the (e) bid guarantee is available to offset the difference.

(a) Cost or pricing data requirements. After initial submission of offers, if the Contracting Officer notifies the Offeror that only one offer was received, the Offeror agrees to-

(1) Submit any additional cost or pricing data that is required in order to determine whether the price is fair and reasonable (10 U.S.C. 3705) or to comply with the statutory requirement for certified cost or pricing data (10 U.S.C. 3702 and FAR 15.403-3); and

(2) Except as provided in paragraph (b) of this provision, if the acquisition exceeds the certified cost or pricing data threshold and an exception to the requirement for certified cost or pricing data at FAR 15.403-1(b)(2) through (5) does not apply, certify all cost or pricing data in accordance with paragraph (c) of DFARS provision 252.215-7010, Requirements for Certified Cost or Pricing Data and Data Other Than Certified Cost or Pricing Data, of this solicitation.

(b) Canadian Commercial Corporation. If the Offeror is the Canadian Commercial Corporation, certified cost or pricing data are not required. If the Contracting Officer notifies the Canadian Commercial Corporation that additional data other than certified cost or pricing data are required in accordance with DFARS 225.870-4(c), the Canadian Commercial Corporation shall obtain and provide the following:

(1) Profit rate or fee (as applicable).

(2) Analysis provided by Public Works and Government Services Canada to the Canadian Commercial Corporation to determine a fair and reasonable price (comparable to the analysis required at FAR 15.404-1).

(3) Data other than certified cost or pricing data necessary to permit a determination by the U.S. Contracting Officer that the proposed price is fair and reasonable ____[U.S. Contracting Officer to provide description of the data required in accordance with FAR 15.403-3(a)(1) with the notification].

As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and (a) similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that-

Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, (1) and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the (2) conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
