5152.233-4703 - AMC-LEVEL PROTEST PROGRAM (SEP 2019)
AMC-LEVEL PROTEST PROGRAM (SEP 2019)
If you have complaints about this procurement, you are encouraged to first attempt to resolve those concerns with the responsible contracting officer. However, you can also protest to Headquarters, Army Materiel Command (AMC). The AMC-Level Protest Program is intended to encourage interested parties to seek resolution of their concerns within AMC as an alternative to filing a protest with the Government Accountability Office (GAO) or other external forum.
Under this program, an interested party may file a protest directly with the AMC Command Counsel. The protest will be handled outside of the procuring activity's chain of command. The AMC Command Counsel will appoint a neutral attorney as the deciding official for the protest.
To be timely, protests must be filed within the time periods specified in FAR 33.103(e). If you file a protest under the AMC-Level Protest Program, the following procedures apply:
(1) Protests must be submitted to:
Headquarters, Army Materiel Command Office of Command Counsel 4400 Martin Road Redstone Arsenal, AL 358985000 Email: usarmy.redstone.amc.mbx.protests@army.mil
(2) The protest must include the information required by FAR 33.103(d)(2).
(3) The deciding official will issue a written decision within 20 working days after the protest is filed.
The AMC-Level Protest Program does not affect your right to file a protest with the GAO or other appropriate forum. Filing a protest with AMC does not extend the time for obtaining a stay at GAO.
The Contracting Officer shall not consider a protest under the AMC-Level Protest Program as a substitute for a protest to the GAO. Instead, it is an additional forum for interested parties to seek resolution.
