Evaluation - Commercial Products and Commercial Services

FAR Clauses Incorporated by Full Text

52.212-2 Evaluation-Commercial Products and Commercial Services. (Deviation 2026-O0038) (Feb 2026)

Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)

(a) The Government intends to award a single Firm-Fixed-Price (FFP) Indefinite Delivery Indefinite Quantity (IDIQ) contract resulting from this solicitation to the responsible Quoter whose quote conforms to the solicitation and represents the best overall value to the Government, price and other factors considered.

The evaluation procedures will be in accordance with FAR 12.203, The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation is the most advantageous to the Government, price and non-price factors considered, in compliance with the specifications attached to this solicitation.

B. Reasonableness: Prices are fully justified, supported and considered fair and reasonable under current market conditions.

A quote that meets and exceeds the Government's minimum needs may represent the best value than a quote that just meets the Government's minimum needs. The Government may consider awarding to the best value quote for a higher price. The Government may also award to the lowest priced quote if all quotes are equal in non-priced factors, where there are no added non-priced advantageous from one quote to the other. The Government will make comparative evaluations, weighing the advantages and disadvantages of each quote in making the award decision.

As such, quoters are encouraged to submit quotes that meet and exceed the Government's minimum need to be considered for award and represent the most advantageous quoter.

Moreover, the Government reserves the right to award no contract at all, depending on the quality of quotes submitted and availability of funds. The Government reserves the right to only evaluate non-price factors of the quoters most likely to receive an award based on price.

The following factors shall be used to evaluate quotes:

a) Factor 1: Technical Capability

i. Subfactor A: Physical "Stitch-Out" Sample

ii. Subfactor B: Salient Characteristics

b) Factor 2: Price

c) Factor 3: Past Performance

Factor 1 Technical Capability - Evaluation Methodology

The Government will evaluate the Quoter's Technical Capability based on two subfactors to determine if the proposed apparel, footwear, and customization meet or exceed the minimum requirements of the Statement of Work (SOW).

Technical Ratings: The Technical subfactors will be evaluated using the following adjectival ratings:

a) Exceeds the Requirement (E): The quote meets the minimum solicitation requirements and includes features, performance metrics, or quality standards that exceed the minimum requirements in a way that yields a tangible, beneficial value to the Government (e.g., significantly higher fabric durability, enhanced safety features, or extended commercial warranties).

b) Meets the Requirement (M): The quote meets the exact minimum requirements of the solicitation.

c) Does Not Meet the Requirement (DNM): The quote fails to meet the minimum requirements of the solicitation.

Note: A rating of "Does Not Meet" in any subfactor renders the entire quote technically unacceptable and ineligible for award.

Subfactor A (Physical "Stitch-Out" Sample) Evaluation:

a) The Government will physically evaluate the submitted fabric swatch sample to determine the quality of customization workmanship.

b) The sample will be evaluated against the following objective criteria:

i. Fabric Suitability: Stitched onto stretchy knit or moisture-wicking polo-style fabric (not stiff canvas/twill).

ii. Thread Material: Embroidery executed using 100% polyester thread (no shiny rayon).

iii. Stitch Density: Logo has high stitch density with no gaps or underlying fabric showing through.

iv. Lettering Clarity: Letters are crisp, properly aligned, and highly legible.

v. Fabric Integrity: Surrounding fabric lies flat, without puckering, warping, or pulling.

vi. Backing Material: Stabilizer backing is cleanly trimmed and free of sharp or stiff edges.

Subfactor B (Salient Characteristics) Evaluation:

a) The Government will evaluate the Quoter's written technical documentation, cut-sheets, and point-by-point comparisons.

b) The evaluation will verify that the proposed items meet or exceed all salient characteristics, NFPA 1975 safety standards, and material specifications listed in the SOW.

Factor 2 - Price

Quotes will be evaluated in accordance with FAR 12.203. The quoted prices will be analyzed for Completeness and Reasonableness.

A. Completeness: Because this solicitation will result in an IDIQ contract with two (2) separate, consecutive twelve-month ordering periods (Ordering Period 1 and Ordering Period 2), the Government will evaluate the Quoter's Total Evaluated Price across the entire two-year lifecycle of the contract. The total firm-fixed-price shall include all applicable taxes, shipping, and handling costs to the shipping address listed at the top of this document. In the event the unit price(s) and extended price(s) are ambiguous, the Government shall use the indicated unit price(s) for evaluation purposes.

Factor 3 - Past Performance

The Government will evaluate each Quoter's past performance history to assess the level of risk associated with successful contract execution. Evaluation will be conducted utilizing the Supplier Performance Risk System (SPRS) and the System for Award Management (SAM) Responsibility and Qualification database. The Government reserves the right to obtain past performance information from other public or non-public sources deemed necessary. The past performance evaluation may be limited only to those Quoters who are determined more likely to receive an award based on Price and Technical Capability factors.

Past Performance Ratings: The Government will assign one of the following adjectival ratings to the Quoter's past performance record:

a) Exceeds the Requirement (Purple): The Quoter possesses a highly favorable, low risk past performance record in SPRS. This rating is designated for suppliers categorized in the top tier of their commodity group (representing the highest 15% of quality scores in SPRS), with no significant documented negative performance.

b) Acceptable (Green/Yellow): The Quoter's past performance record indicates a reasonable expectation of successful contract execution. This rating applies to suppliers with a standard, low-to-moderate risk rating (representing the middle 70% to next 10% of quality scores in SPRS) with minor, resolved performance issues.

c) Neutral (Green*): A Quoter without a record of relevant past performance history in SPRS for the required FSC or PSC will not be evaluated favorably or unfavorably. A Neutral rating will be treated as "Acceptable" for evaluation purposes.

d) Unacceptable (Red): The Quoter's past performance record indicates a high risk of unsuccessful performance. This rating is designated for suppliers in the lowest tier of their commodity group (the lowest 5% of quality scores in SPRS) or those with a history of significant, uncorrected performance issues, default, or terminations. (Note: A rating of Unacceptable in Past Performance may render the entire quote ineligible for award).

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(c) Contractor Responsibility.

To be eligible for award of a contract hereunder, a Quoter must be determined by the Contracting Officer to be a responsible prospective contractor in accordance with FAR 9.1. and DFARS 209.105-1.
