TWO STEP SEALED BIDDING

Baumholder Military Community

Solicitation Handout (Step One):

GDP-B0683-6P Replace Chillers Training Center #8280

TWO-STEP SEALED BIDDING PROCEDURES

This solicitation and resulting contract are utilizing a Two-Step Sealed Bidding procurement method as described in RFO FAR Part 14.211. This document is Step One, which is a request for technical proposals only. Offerors determined to be acceptable in Step One will be notified of Step Two via receipt of the Invitation for Bid (IFB) solicitation document.

The two-step procedure is a combination of competitive procedures designed to obtain the benefits of sealed bidding while ensuring only technically acceptable firms participate in the priced sealed bid. The process allows for prospective bidders to participate in Step One, technical proposal submission and for the Government to conduct a technical evaluation. Step One ensures that only technically acceptable contractors participate in Step Two of the sealed bid process.

The submission requirements of Step One, Request for Technical Proposal, shall not include any prices or pricing information. Under the procedures of RFO FAR Subpart 14.211, Step One consists of the request for submission, evaluation and (if necessary) discussion of a technical proposal.

Bidders are welcome and encouraged to submit multiple proposals (see RFO FAR 52.214-24). The proposals will be evaluated for technical acceptability. Bidders should submit technical proposals that are acceptable without additional explanation or information. The Government may make a final determination regarding a technical proposal's acceptability solely on the basis as submitted.

A rating of “acceptable”, “unacceptable”, or “reasonably susceptible of being made acceptable” will be forwarded to each Offeror who submits a proposal pursuant to Step One. The Government may proceed with the second step without requesting further information from any bidder; however, the Government may request additional information from bidders of bids that it considers “reasonably susceptible of being made acceptable” and may discuss bids with their bidders. Proposals remaining “reasonably susceptible of being made acceptable” at the time the Government initiates Step Two shall be considered “unacceptable” and will be ineligible to participate in Step Two.

In Step Two, the Government will issue the amendment specifications to those bidders whose technical proposals are determined to be acceptable in Step One.

The sealed bidding process in RFO FAR Part 14, including submission of pricing, representations, and certifications, will be followed in Step Two. Only bids based upon technical proposals determined to be acceptable, either initially or because of discussions from Step One, will be considered for award. Each bid in Step Two must be based on the bidder's own technical proposal that was submitted, evaluated, and determined to be acceptable in Step One.

1. First Step: Solicitation for Technical Proposals

During step one, the Government conducts a site visit with as many interested contractors as possible, to have them submit technical proposals for evaluation and acceptance. Brainstorming and sharing information between the contractor and Government at the site visit is desired.

The intent of the site visit is to clarify any work issues before submission of technical proposals.

Step one concludes with the receipt, evaluation and acceptance of contractor technical proposals.

If no time is specified in the IFB, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that bids or revisions are due.

(b) (1) Any technical proposal under step one of two-step sealed bidding, modification, revision, or withdrawal of such proposal received at the Government office designated in the request for technical proposals after the exact time specified for receipt will not be considered unless the Contracting Officer determines that accepting the late technical proposal would not unduly delay the acquisition; and—

(i) If it was transmitted through an electronic commerce method authorized by the request for technical proposals, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or

(ii) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt; or

(d) If an emergency or unanticipated event interrupts normal Government processes so that technical proposals cannot be received at the Government office designated for receipt of technical proposals by the exact time specified in the request for technical proposals, and urgent Government requirements preclude amendment of the request for technical proposals, the time specified for receipt of technical proposals will be deemed to be extended to the same time of day specified in the request for technical proposals on the first work day on which normal Government processes resume.

(e) Technical proposals may be withdrawn by written notice received at any time before the exact time set for receipt of technical proposals. If the request for technical proposals authorizes facsimile technical proposals, they may be withdrawn via facsimile received at any time before the exact time set for receipt of proposals, subject to the conditions specified in the provision at 52.214-31, Facsimile bids. A technical proposal may be withdrawn in person by a bidder or its authorized representative if, before the exact time set for receipt of technical proposals, the identity of the person requesting withdrawal is established and that person signs a receipt for the technical proposal.

52.214-24 – Multiple Technical Proposals (Apr 1984)
