About this file

This is a memorandum documenting the use of other than full and open competition for a simplified acquisition threshold procurement. The contracting action involves Purchase Request Numbers N2991K60724004 and 1301345698 for OEM technical services from Rolls-Royce Solutions America, Inc. to provide reactivation maintenance on all four Main Propulsion Diesel Engines (MPDE) on seven FGRR EPF class ships. The period of performance runs from 11 May through 30 September 2026, with an anticipated dollar value listed as $XXX.xx (specific amount redacted).

The determination to use single-source procurement is justified under multiple criteria: exclusive licensing agreements (Rolls-Royce Solutions America, Inc. as the sole OEM with required technical data and diagnostic tools), critical ship equipment designation per SMS Procedure Number SMS 10.6.002-01-JHSV, standardization requirements per MSC's initiative (MTU 20V8000 MPDE specification used across all EPF class vessels), and form, fit, and function compatibility requirements. The memorandum emphasizes that the repair and maintenance is essential for the ship to continue supporting tenant commands and operate safely, that CTF-53 prioritizes maintaining full functionality of the power system for mission-critical operations, and that introducing alternate, untested products poses unacceptable risk to mission success and would create additional sustainment costs to the enterprise. The contracting officer identifies no other known vendors capable of providing the required services for this integrated system.

USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN ACQUISITION UNDER

THE SIMPLIFIED ACQUISITION THRESHOLD

(a) PR Number(s):N2991K60724004 1301345698

I. BACKGROUND:

1. In considering the references, FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contacting Officers may solicit from one source if the Contracting Officer determines that, under the circumstances of the contract action, only one source is reasonably available (e.g., urgency, exclusive licensing, brand-name, or industrial mobilization).

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition because only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE:

1. Provide a description of the item or service required, to include

a) the name of the required source or brand name

Rolls-Royce Solutions America, Inc.

b) the required delivery date/period of performance and

11MAY - 30SEP2026

c) its intended use.

Request OEM technical services through, Rolls-Royce Solutions America, Inc. to provide perform REACTIVATION maintenance on all 4 Main Propulsion Diesel Engines (MPDE) on 7 FGRR EPF ships.

2. List the source(s) or known vendor(s) who are able to provide the above described item or service.

OEM - Rolls-Royce Solutions America, Inc.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION IS BASED

ON THE FOLLOWING (select all that apply):

A. X Only one responsible source (select all that apply):

1. RESTRICTIVE RIGHTS: the source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service.

2 Ver 2.0 (01 July 2018)

a. Explain what is subject to the restrictive rights.

b. If drawings are included, who is identified as “owning” the drawings?

2. X EXCLUSIVE LICENSING AGREEMENTS: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is ONLY ONE authorized distributor or technical representative for the OEM.

a. Identify the OEM and explain the circumstances surrounding why the item or service is only available from the OEM.

Rolls-Royce Solutions America, Inc. is the O.E.M. Other engine companies do not have the required technical data, diagnostic tools to review, test, and repair this system. The identified representative is the only known representative for the combined system components known to provide support in this AOR.

b. Identify the distributor / authorized technical representative for the item or service.

Provide evidence of the exclusive licensing agreement as an attachment to this document.

(NOTE: If there is more than one distributor / authorized technical representative, then use Part B – Brand Name.)

3. XOTHER REASON:

a. X CRITICAL SHIP EQUIPMENT: The required item is critical ship equipment, the failure of which poses a hazard to the ship, the crew or the environment.

i. SMS Procedure Number: SMS 10.6.002-01-JHSV

b. X STANDARDIZATION: Per MSCs standardization initiative, only the specified make/model of the equipment/parts will satisfy the Government’s needs for additional units or replacement items.

i. Identify Make / Model Number(s):

MTU 20V8000 MPDE

ii. Identify other vessels with this Make / Model:

All EPF class vessels

3 Ver 2.0 (01 July 2018)

c. X FORM, FIT, AND FUNCTION: Item is direct replacement parts / components for existing equipment and must be compatible in terms of form, fit, and function with existing equipment / configurations.

i. Identify Make / Model of existing equipment:

MTU 20V8000 MPDE

ii. Describe how the equipment must be compatible with the existing configuration.

d. OTHER:

B. Brand Name: Item required must be a brand name product, or feature of a product, particular to one manufacturer. Discuss why you are precluding consideration of a product manufactured by another company.

Describe how the particular brand name, product, or feature is essential to the Government’s requirements and why a “brand name or equal” purchase description cannot be used (see FAR 11.104). Describe how market research indicates other companies’ similar products or products lacking the particular feature do not meet, or cannot be modified to meet, the agency’s needs.

C. Unusual and Compelling Urgency: The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits. Urgent requirements are supplies or services that will result in work stoppage, or are mission critical and the routine processing time would injure the Government. The determination that the procurement for the above is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was identified:

2. Period of Performance:

If the difference between a. and b. is more than one week, explain the delay in submitting the requirement.

3. Estimated production lead time: N/A

4. Explanation of why delivery / commencement of services by the date required is needed: (explain the impact to the mission, any special circumstances or conditions, etc.)

4 Ver 2.0 (01 July 2018)

This repair and maintenance is needed to allow the ship to continue to be supportive of tenant commands and continue to operate safely.

CTF-53 strongly urges all ships (particularly PM1/PM8 ships) to maintain full functionality of ships power system. This system is vital in its support of CTF53 associated missions.

Rolls-Royce Solutions America, Inc. is the only capable OEM technical services that are fully compatible of providing this service and repairs with the existing Ships Diesel Main Engines infrastructure for the USS BRUNSWICK and the other 6 FGRR ships. The shipboard diesel main engines to be placed in OPERATIONAL condition will form part of an integrated enterprise, which already contains similar components. Introducing alternate, untested products is not authorized and poses an unacceptable risk to the success of the missions to be performed and would impose additional costs to the enterprise as a whole in terms of sustainment support. Obtaining Rolls-Royce Solutions America, Inc.’s expertise for MPDE repairs and maintenance will repair important equipment that and will ensure that General Technical Requirements (GTR) can maintain compliance with JHSV.

5. CASREP Number:

IV. ANTICIPATED DOLLAR VALUE OF PROCUREMENT: $XXX.xx
