USAID/PERU –PROMOTING JUSTICE AND INTEGRITY IN PUBLIC

ADMINISTRATION

To All Prospective Offerors:

The United States Government, represented by the U.S. Agency for International Development (USAID), is seeking proposals from qualified organizations to implement USAID/Peru’s project Promoting Justice and Integrity in Public Administration (hereto referred to as the “Project”). The overall purpose of the Project is to strengthen the capacity of the judicial system in Peru to promote justice and integrity in public administration. This Project is defined in the Statement of Objectives (SOO) in Attachment J-1 of the attached Request for Proposals (RFP).

This procurement will be conducted under full and open competition procedures pursuant to Part 15 of the Federal Acquisition Regulation (FAR) (48 CFR Chapter 1). Both for and nonprofit, local and international organizations are eligible to bid. Offers must be submitted in accordance with Section L of this RFP. As per the instructions found in Section L, the Offeror is required to develop and submit their own Statement of Work (SOW). As part of the evaluation process, USAID will select the offer that demonstrates the best method to achieve the required objectives at a reasonable cost to the U.S. government. Upon award, the successful offeror’s SOW will be incorporated as part of the award. The SOW must be written with clear objectives and deliverables. It will be written from the perspective that this SOW will be incorporated as an integral part of the award, using such language as “the Contractor will”, or “the Contractor must”, as opposed to “we will” or “we propose”.

USAID/Peru anticipates awarding a cost plus fixed-fee completion-type contract as a result of this solicitation. The estimated performance will be a period of three years (subject to availability of funds and successful performance). The estimated cost for this procurement is $4 million to $6 million (please note that this is a standardized range and it does not necessarily mean that offers at the top range will be considered “fair and reasonable”). Cost will not be a separate evaluative factor, but costs will be used as part of a best value determination. Offers submitted must be realistic and reasonable for the work proposed.

Offerors must pay particularly close attention to Section L - Instructions to Offerors and Section M - Evaluation Factors for Award. Sections B through I of the solicitation will become a substantive part of the anticipated contract with blanks to be completed by the Contracting Officer (CO) upon award. As noted above, the successful offeror’s SOW will become Section C.

Proposals must be signed by an official who is authorized to bind the Offeror’s organization.

Please also pay careful attention to, and complete in full, RFP Section K - Representations, Certifications and Acknowledgements.

To the maximum extent possible, USAID encourages the participation (as the prime contractor or as subcontractors) of small business concerns; veteran owned, service-disabled veteran, HUBZone, women-owned and small disadvantaged businesses.

It is the responsibility of the Offeror to ensure that the solicitation has been downloaded from the Internet in its entirety. USAID bears no responsibility for data errors resulting from download or conversion processes. Any amendments to this solicitation will be issued and posted on the Federal Business Opportunities (FBO) website (http://www.fbo.gov). Offerors are encouraged to check this website regularly.

A USAID maintained Interested Vendor List (IVL) is not included in this solicitation. The IVL is a means for firms to be able to contact one another for teaming arrangements and/or small business subcontracting opportunities. Interested offerors can register and use the IVL on the FBO web page.

It is extremely important that all submissions be submitted by the designated date and time indicated in Block 9 of the RFP cover page (Standard Form 33). Proposals received after the closing date and time will be processed as late and handled in accordance with FAR 15.208.

Only electronic submissions will be accepted. Submissions must be sent to the following address:

LimaSolicitations@usaid.gov

In the subject field of the email, you must put: SOL-527-12-000010 USAID/PERU PROMOTING JUTICE AND INTEGREITY IN PUBLIC ADMIN. No other form of submission will be accepted.

The USAID email system can only accept up to 8 megabytes. If your submission is larger, you must send multiple emails. They must be additionally labeled in the subject field with the transmission number and then the total number being transmitted, for example for a transmission that has three emails and attachments: 1/3, 2/3, 3/3, etc.

Any questions regarding this RFP are to be submitted in writing to LimaSolicitations@usaid.gov, with a copy to the attention of Ms. Laura Slaughter at lslaughter@usaid.gov or Mr. Troy Tillis at ttillis@usaid.gov by the date and time specified herein. Answers to questions will be provided in writing on the FBO internet site.

Issuance of this solicitation does not obligate the U.S. Government to make an award, nor does it commit the U.S. Government to pay for costs incurred in the preparation and submission of a proposal. Furthermore, the Government reserves the right to reject any and all offers, if such action is considered to be in the best interest of the U.S. Government.

SECTION D - PACKAGING AND MARKING

D.1 AIDAR 752.7009 MARKING (JAN 1993)

(a) It is USAID policy that USAID-financed commodities and shipping containers, and project construction sites and other project locations be suitably marked with the USAID emblem.

Shipping containers are also to be marked with the last five digits of the USAID financing document number. As a general rule, marking is not required for raw materials shipped in bulk (such as coal, grain, etc.), or for semi-finished products which are not packaged.

This guidance will be provided through the cognizant technical office indicated on the cover page of this Contract, or by the Mission Director in the Cooperating Country to which commodities are being shipped, or in which the project site is located.
