(a) Evaluation factors: The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

(i) price;

(ii) Delivery Date

SEE AWARD SELECTION PROCESS section below

(b) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

AWARD SELECTION PROCESS

Award will be made in accordance with FAR Part 12 to the Offeror that provides the best value to the government based on price, and delivery date. This solicitation is not stating nor required to state the importance assigned to each evaluation factor and/or sub factor (FAR 12.203(c)(2)).

1. Price: A price evaluation will be performed to determine the reasonableness of the proposed price. If multiple contract line items are included in the price schedule, prices will also be evaluated to determine whether any line items are unbalanced. Offerors are cautioned to distribute costs appropriately.

2. Delivery Date of parts to YELL

Quotes will receive a preliminary review to determine whether the quote contains sufficient information, as required by the solicitation, to allow the government to perform a meaningful evaluation. If the results of this preliminary review indicate that the quote lacks sufficient information to allow a meaningful evaluation to be conducted, the Contract Specialist/Contracting Officer may eliminate the quote from further evaluation and consideration for an award.

Certification:

7. Authority:

a. 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.

b. FAR Part 11.105: The Brand Name products are essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet and cannot be modified to meet the agency’s needs.

c. FAR 6.302-1: The use of the name brand products are essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

8. The description of the product’s unique qualifications or the unique nature of the acquisition:

Brand Name: Caterpillar (CAT) Requirement: Procurement of Caterpillar engine replacement components for government-owned heavy equipment.

Justification The Government requires genuine Caterpillar replacement components for the repair and maintenance of Caterpillar-powered heavy equipment. These components are essential to ensure compatibility, reliability, and continued operational readiness of existing equipment.

The use of genuine Caterpillar components is justified for the following reasons:

Compatibility and Fit Caterpillar replacement components are specifically engineered and manufactured to meet the original equipment manufacturers (OEM) specifications. The use of non-OEM or aftermarket components may result in improper fit, reduced performance, or installation issues that could adversely affect equipment operation.

Reliability and Performance Genuine Caterpillar parts are designed and tested to maintain the performance characteristics, durability, and efficiency of

Caterpillar engines. These components help ensure the equipment continues to operate under the demanding conditions required for Government missions.

Safety Heavy equipment is used in environments where equipment reliability directly affects operator safety and mission success. OEM components reduce the risk of premature failure that could result from the use of non-approved replacement parts.

Warranty and Manufacturer Support Use of genuine Caterpillar replacement components preserves applicable manufacturer warranties and ensures continued access to Caterpillar technical support, service documentation, and product updates. Installation of aftermarket parts may void warranty coverage or limit manufacturer support.

Lifecycle Cost Although aftermarket components may have a lower initial purchase price, they may result in increased maintenance costs, shortened service life, additional downtime, and more frequent repairs. Genuine Caterpillar components provide the best overall value through improved reliability and reduced lifecycle costs.

Market Research Market research identified the availability of aftermarket replacement components; however, these products do not provide sufficient assurance of equivalent quality, durability, compatibility, or manufacturer support. Genuine Caterpillar components are available through Caterpillar's authorized distribution network and represent the only products fully certified by the OEM for these applications.

Impact if Other Than Caterpillar Components Are Used The use of non-OEM replacement components could result in:

• Reduced equipment reliability and availability.

• Increased maintenance requirements and repair costs.

• Potential safety hazards due to component failure.

• Loss of manufacturer warranty coverage.

• Increased equipment downtime affecting mission readiness.

• Potential damage to existing Caterpillar engines and related systems.

Conclusion Based on the technical, operational, and lifecycle requirements of the Government's Caterpillar-powered heavy equipment fleet, genuine Caterpillar engine replacement components are the only products that satisfy the Government's minimum needs.

Therefore, a brand-name acquisition is justified in accordance with applicable procurement regulations governing brand-name procurements (e.g., FAR 11.105 and FAR 13.106-1, 8.405-6, or 16.505, as applicable to the acquisition method).

b. Presolicitation notice per FAR 5.2:

For acquisitions over $25,000 a PR solicitation notice shall be posted on the Government’s Point of Entry, sam.gov unless the exception noted at FAR Part 5.202(a)(13) applies.

13. Interested Sources:
