COMBINED SYNOPSIS/SOLICITATION – CONTINUED – 140P1425Q0011.

This is a COMBINED SYNOPSIS / SOLICITATION for commercial items prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subpart 12.6and 13.5, as supplemented with additional information included in this notice. The National Park Service (NPS) contemplates award of a firm fixed price (FFP) purchase order as a result of this combined synopsis/solicitation to the vendor.

This announcement constitutes the only solicitation issued as Request for Quotation (RFQ) 140P1425Q0011. A written solicitation will not be issued.

FAR clauses and provisions enclosed within this RFQ are those in effect through Federal Acquisition Circular (FAC) 2025-03 and are available in full text through Internet access at FAR | Acquisition.GOV.

This RFQ is posted on SAM.gov’s Contracting Opportunities and is a not set-aside. The North American Industry Classification System (NAICS) code is 342121 – Asphalt Paving Mixture & Block Manufacturing. The small business size standard is 500 employees.

Description:

Yellowstone National Park (YELL) conducts road repairs on an annual basis to keep the parks roadways safe for visitors and staff. As such YELL requires 6300 tons of hot mix asphalt meeting the specifications in this solicitation. The mobile asphalt plant will be located at Norris Junction Pit, 22 miles south of Mammoth Hot Springs, Wyoming (WY).

This is approximately 22 miles south of Mammoth Hot Springs, WY. All deliveries shall be F.O.B.

Awarded contractor shall independently, and not as an agent of the government, provide all labor, materials, and equipment necessary to provide the required hot mix asphalt and operation and management of a mobile hot mix asphalt plant in accordance with the SOW attached to this solicitation, and additional requirements & terms and conditions stated herein.

PROVISIONS AND CLAUSES APPLICABILITY

FAR provisions 52.212-1, Instructions to Offerors – Commercial Products and Commercial services apply to this requirement and is incorporated by reference (IBR).

FAR 52.212-1 Addendum – Instructions to Quoters:

SAM Registration Requirements:

To be considered for award a firm shall obtain a Unique Entity Identifier (UEI), shall have an active registration, and shall have completed the representations and certifications section in the System for Award Management (SAM) via https://www.sam.gov at the closing date and time of the solicitation; as well as, at the time of award and throughout performance of this requirement.

Evaluation Procedures:

This procurement will use Simplified Acquisition Procedures (SAP) in accordance with FAR 13.106- 1(a)(2) and FAR 13.106-2(b). Evaluation procedures in FAR 13.106 provide broad discretion in establishing suitable evaluation procedures. Using price and other factors, ensure that quotations can be evaluated in an efficient and minimally burdensome fashion using comparative evaluations of quotes.

Comparative evaluations encourage the use of “best value”, are not required to state the relative important of evaluation factors or subfactors, nor is required to use subfactors. This solicitation will evaluate:

1. Price.

2. Technical Capability: This includes at minimum: meeting the minimum requirements of the

SOW, Size of Plant, Timeline of Set-up, Sample Daily Work Schedule, and the Ability to Meet the Period of Performance.

Quotes will receive a preliminary review to determine whether the quote contains sufficient information, as required by the solicitation, to allow the Government to perform meaningful evaluations. If the results of the preliminary review indicate that the quote lacks sufficient information to allow a meaningful evaluation to be conducted, Contracting Officer as the sole deciding authority may eliminate a quote further evaluation and consideration for an award.

It is the responsibility of the quoter to thoroughly read and submit sufficient information and documentation in their narrative.

Quoters shall not copy the Scope of Work and state the firm can meet the requirement. Nor shall the Quoter copy the Scope of Work and add comments to specific areas.

Award Selection Process:

Award will be made in accordance with the procedures established in FAR 13 to the quoter who is determined to be the overall best value at a fair and reasonable price based on comparative evaluation procedures.

The Government reserves the right to consider a quotation other than the lowest priced that provides a benefit to the Government that meets the minimum requirements of the solicitation but is not required to do so. Each quote shall meet the minimum requirements of the solicitation.

If multiple quotes are determined to be technically acceptable with all being determined comparatively equal, the award will be made to the firm with the lowest price.

Service Contract Labor Standards:

The Service Contract Labor Standards Act applies to line-item 10. Wage Determination 2015-5407 for Park County, Wyoming is attached.

Quotes must be in accordance with and in the order detailed in this section. Failure to submit quotes according to the instructions provided within the solicitation may result in the respondent’s quote not being considered for award.

All questions shall be submitted in writing by Noon (12:00 PM, Mountain Time (MT)) on 3/5/2024, via email to the CO, sally_leitch@nps.gov. Phone calls shall not be accepted.

b) Price Schedule:

Pricing shall not be listed anywhere else in your quote submission except for the prompt pay discount price table below. All pricing shall be all inclusive.

Contractor shall hold quoted pricing firm as anticipated award date is 6/2/2025.

Quoters are encouraged to provide additional discounts in quoted pricing. Quoters best pricing including any additional discounts shall be provided in the table below.

Variation in Quantity – Line-Item 20:

The government reserves the right to decrease or increase the number of tons above or below the quantity listed in Line-item 20 no more or less than 20%. Any increase in tonnage above the 6300 tons shall not be ordered or delivered prior to the effective date of a bi-lateral modification adding funding. Any increase in tonnage shall not exceed 1,260 tons.

Billing shall be completed as follows:

• Invoice 1: After Mobilization is complete and plant is ready to begin work on 8/1/2025 (line-item 10). Note: Line-item 10 for purposes of invoices 2-4 shall not exceed the aggregate total listed in in line-item 10.

• Invoices 2 – 4: Monthly submission after the last day of the month for operation of plant (line-item 10, see note above), monthly cost for hot mix asphalt (line-item 2). (This will include any additional tonnage added based on the Variation in Quantity FAR Clause 52.211- 16)

• Invoice 5: After demobilization of hot mix plant is complete.

The Contractor is responsible for the delivery of each item quantity within allowable variations, if any. If the Contractor delivers and the Government receives quantities of any item in excess of the quantity called for (after considering any allowable variation in quantity), such excess quantities will be treated as being delivered for the convenience of the Contractor. The Government may retain such excess quantities up to $250 in value without compensating the Contractor therefor, and the Contractor waives all right, title, or interests therein. Quantities in excess of $250 will, at the option of the Government, either be returned at the Contractor’s expense or retained and paid for by the Government at the contract unit price.

ADDITIONAL REQUIREMENTS & CONTRACT TERMS AND CONDITIONS

The National Park Service contemplates award of an open market, firm-fixed-price, purchase order as a result of this combined synopsis/solicitation to the vendor.

Contractor shall not bill/invoice for amounts over the awarded/obligated amount for all items delivered.

Undelivered items shall not be billed or invoiced. Contractor shall not be reimbursed for services performed in excess of obligated funding. Contractor shall bill as stated in the Price Schedule section above.

The Government reserves the right to increase the quantity of line-item 20 through the Variation in Quantity Clause listed in the Clause section below and as stated in the Price Schedule.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.

Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
