DESCRIPTION:

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice.

This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This combined synopsis/solicitation is being issued as a Request for Quote (RFQ) and the solicitation number is 140P1425Q0004. Evaluation Procedures and Award Selection Process:

This procurement will use Simplified Acquisition Procedures (SAP) in accordance with FAR Part 13. Award will be made in accordance with FAR Part 13 to the lowest priced quote that meets technical specifications and prior experience.

A. Provide technical specifications that demonstrate that the quoted equipment meets or exceeds the specifications set forth in the statement of work.

B. Provide resume of the operator that meets or exceeds the requirements set forth in the statement of work.

3. Prior experience (Non-price): Prior experience is the factual documentation or narrative of a firm’s experience, qualifications, and capability in performing similar scope. Provide at least 3 prior experience examples.

It is the responsibility of the quoter to thoroughly read and submit sufficient information and documentation. Information that is missing or unclear may result in the quote not being accepted for evaluation. The contracting officer/contract specialist is the sole authorities on determining a quote package acceptable or not acceptable for evaluation.

For purposes of price evaluation, the Contracting Officer will evaluate the quoted fixed unit prices multiplied by the estimated quantities for each ordering year. ADDITIONAL REQUIREMENTS & CONTRACT TERMS AND CONDITIONS

The National Park Service contemplates single award of a Firm Fixed Price (FFP), Indefinite Delivery, Indefinite Quantity (IDIQ) contract as result of this combined synopsis/solicitation.

This IDIQ does not contain options; the resulting award will contain a five-year ordering period.

The contractor shall furnish at least the stated minimum quantity. In addition, if ordered, the contractor shall furnish additional quantities, not to exceed the stated maximum.

Ordering Procedures - Issuance of Delivery Orders Orders may be issued at the discretion of the government during the period set forth elsewhere in this contract.

Single award delivery orders will be made in an ordering period on an Optional Form 347 (OF347). The total amount of each order shall establish a firm-fixed price for the order. Any changes to the fixed price will be issued in writing by the Contracting Officer (CO). When the government requires orders under the IDIQ contract, an inquiry will be sent to the contractor by the CONOPS CENTRAL Contracting Officer or Contract Specialist. All inquiries shall be priced in accordance with the IDIQ Price Sheet attachment.

The CO shall furnish the Contractor with a written inquiry that includes the following:

1. A description of the anticipated task order scope including the designated Yellowstone project location;

2. The anticipated construction project schedule, if available;

3. The applicable wage determination;

4. The required contractor response due date; and,

5. Any other pertinent information.

The Contractor shall, within the time specified, provide the CO with a response that:

1. Confirms description of the anticipated task order scope;

2. Provides or confirms pricing according to the anticipated task order scope and IDIQ price sheet attachment;

3. Confirms schedule and/or availability if anticipated construction project schedule is provided; and,

4. Any other applicable information or assumptions.

Note: If the schedule for the funded number of rental days is not expressly stated at time of task order issuance, then the schedule for the funded number of rental days shall be coordinated with the park point of contact and within the task order’s period of performance.

(a) Definitions. As used in this clause— Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public websites) or simple transactional information, such as necessary to process payments.

Safeguarding means measures or controls that are prescribed to protect information systems.

(b) Safeguarding requirements and procedures.

(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.

(xii) Identify, report, and correct information and information system flaws in a timely manner.

(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.

(xiv) Update malicious code protection mechanisms when new releases are available.

(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.

(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial products or commercial services, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
