52.212-2 Evaluation — Commercial Products and Commercial Services (Nov 2021) (DEVIATION Mar 2026)

(a) Evaluation factors: The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

(i) price;

(ii) technical capability of the item offered to meet the Government requirement;

(iii) past performance

SEE AWARD SELECTION PROCESS section below

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

AWARD SELECTION PROCESS

Award will be made in accordance with FAR Part 12 to the Offeror that provides the best value to the government based on price, technical, and past performance. Per FAR 12.203(c)(2) evaluation will be conducted by comparative evaluation of offerors. This solicitation is not stating nor required to state the importance assigned to each evaluation factor and/or sub factor (FAR 12.203(c)(2)). The government reserves the right to award to other than the lowest price offeror if the evaluator determines that it is in the best interest of the government to do so.

1. Price: A price evaluation will be performed to determine the reasonableness of the proposed price.

Reasonableness will be determined considering other competitive prices received and comparison to the independent Government estimate. If multiple contract line items are included in the price schedule, prices will also be evaluated to determine whether any line items are unbalanced.

Offerors are cautioned to distribute costs appropriately.

2. Technical: Provide a Capability Statement specific to the requirement – two (2) pages MAX.

Provide Refrigeration & A/C Mechanical License(s) with quote for individual(s) that will be performing on site services – This can be held by a subcontractor but still must be submitted with the quote.

3. Past Performance: Complete section c) Contractor Core Data and submit with quote. The UEI number provided will be used by the evaluator to consult records from CPARS, FAPIIS, and or any other resources deemed relevant specific to past performance. Any results of the consultation will be compared among other quoters. Do not provide past performance information the evaluator will obtain what is needed to assess.

https://www.napex.us/ https://www.apexaccelerators.us/#/

140P1326Q0033 ARHO Bunker HVAC Page 10 of 13

Quotes will receive a preliminary review to determine whether the quote contains sufficient information, as required by the solicitation, to allow the government to perform a meaningful evaluation. If the results of this preliminary review indicate that the quote lacks sufficient information to allow a meaningful evaluation to be conducted, the Contract Specialist/Contracting Officer may eliminate the quote from further evaluation and consideration for an award.

The government will evaluate quotes in groups of three (3), starting with the lowest priced quotes, proceeding upward, incrementally in price, until an awardee is selected. At that point, the evaluation process stops, and award will be made to the selected Offeror.

52.237-1 Site Visit (Apr 1984)

(a) Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

(b)

Site Visit Date and Time: 9/15/2026 at 0900 HRS ET Site Visit Location: Arlington House, The Robert E. Lee Memorial
